      Probably not. They’ll get it pled down to a misdemeanor but it’s pretty clear this guy did it. And all the prosecutor really has to do is either prove he’s got a bad temper or that the witness is reliable. A jury will convict this dude pretty easily

      ww2fan18 you have him admitting to everything up until pulling the gun, you have the victim saying he pulled a gun and describing the gun, you have a gun in his car and you have a witness positively identifying the gun. That’s plenty of reasons to make an arrest it’s up to the lawyers from that point.

      A 360 view camera. I have a front and back camera. Still wouldn't have been enough to prove I'm innocent in this situation. I'd need a third camera pointing right at myself to show I didn't brandish a weapon.

      Seriously. He might've been lying or telling the truth. The cops don't know that and he only got punished for having a gun and her testimony. That can be a coincidence, many people own guns and he could've said he carried it for protection as an uber driver. They have 0 actual proof that he did it, it wasn't even fired.

      And not on cars, but London has the most cctv cameras per capita or per sq ft, can't remember, BUT London is the MOST surveillanced city in the world.

      A dash cam wouldnt capture a side on window to window brandishing of a gun unless he was ahead of her by a good distance,an easy access monitored compartment would be better. If the driver needs it quickly,its there at the touch of a button,but monitors when its removed.

      Why would she specifically mention a firearm unless she knew for a fact that he had one. If she hadn't seen him brandish the gun and the cops pulled him over and he was unarmed, she'd be putting herself in jail for false police report. The facts don't support your conclusion.

      how? He doesnt need proof. He needs reasonable suspicion that a crime took place. Which is the defendants statement. Highly unlikely that she just guessed that he had a gun and was right. She knew he had one because he pointed it at her. It's up to the courts to sort this out, not the police. They did there job 100 percent correctly.

      @@mikederkonig Nooo lol. It takes probable cause to arrest someone, not reasonable suspicion. Reasonable suspicion is reason for detainment/investigation, not arrest. It's the south. Everybody has a gun. It's fairly likely that guessing that would be accurate. As far as the courts sorting it out, what will happen is he will spend the night in jail, mugshot will be online forever unless he can get it expunged years later, he will be out thousands with attorney fees and bail, and have a felony charge on his record. As long as he doesn't admit to doing it, this case will get dropped. It is purely he said vs she said and nothing is proveable.

      Innocent until proven guilty. Arresting him doesn't mean he's guilty, it just means there is enough evidence against him to put him to trial which is where they will (hopefully) find out what really happened, whether he did it or not

      Michael Ferguson yea but for some reason you can't be pulled over for it. You have to be pulled over for doing something else wrong and then if they've seen you on the phone they can write you a driving while texting or on phone ticket.       Number Eight or Nine?, that’s all circumstantial. It is likely a coincidence. He has every right to have a weapon in his vehicle. The woman’s eyewitness account is bias and likely false. Eyewitness accounts are some of the most unreliable evidence, studies prove it. Anything hanging out the window at night can look like a gun. Please educate yourself.

      The gun itself is circumstantial evidence. She has no proof it was that gun in particular or a gun at all. A tape recording of the street this happened on would be actual evidence . If my television got stolen, the missing tv itself is not evidence. The busted in back door would be evidence of a robbery or my security system tripping when the burglar walks in and videos him taking my tv and running.
      Fortunately for this man, this will not fly in court. With his driving record being clean (and if we are lucky, her record wont be) this case will be dismissed almost immediately

      If im showing u my phone to say "hey get off the phone" i wouldnt hold it as a gun. So, he lied and actually did brandish the gun. Probably held up the phone after the gun so he could use that as an excuse.

      Maybe he was pointing his phone at the women at a sideways angle when telling her to get off the phone, and since the phone is a dark color and it’s nighttime, it’d be easy to mistake it for a small handgun, especially if it was pointed sideways. It’s unlikely that the man is actually a danger to anyone, but as for the women, if she was texting in driving I would say that she’s a danger to someone. Texting while driving is the number one cause of fatal automobile accidents in the U.S. Not to mention that the male in this incident is an Uber Driver, a great percentage of Uber Drivers carry a weapon for purposes of defending themselves against unruly passengers, so it’s not at all suspicious for him to be carrying a gun, because perhaps someone could look at that fact and think that he’s of the type to brandish that weapon in an act of road rage, but given his status of employment, I don’t believe that’s the case.

Judgement of either individual out of your past emotional experiences with some aspect of this incident is not valid judgement.

But if the cop was to show her something else like his own gun or the phone, what would she have said, think about that. So that's the thing and plus she was texting and driving (from what the guy had said) she could've put your life in danger, because she wasn't paying attention to her surroundings. But all I could say is that both is at fault, he was road raging, and she wasn't careful. And ain't no one is gonna aim a gun at me I got one strap.

    I had a guy brake check me for honking at him when he passed us on double yellow. I passed him as he brake checked instead of slamming my brakes. Next thing I knew I looked in my side mirror and saw a revolver pointed directly at me I could see right down the barrel. I had my daughter call 911 and I dropped my speed to 35 and escorted him to the police and he and his son were thrown to the ground and he was arrested. Funny thing is the guy only lost that particular gun not his ability to carry. Seems to me he isn't responsible enough or mature enough to carry. But hey... Midwest BS in love with their weaponry. In fact the cops asked if I knew him. Not because of the altercation but because I fully described the gun including probable caliber size. They asked how I could tell the caliber.... Idk have a gun pointed at you and tell me you can't tell the caliber... Pretty easy when you've owned many guns as I have in the past. They were incredulous and then asked how long did he point the gun at me. I didn't know exactly but wasn't long but long enough to take a mental inventory of the gun. It was desert color, large caliber (40/45/50) most likely a Taurus given the color and grip. They really thought I was just ratting on some guy I was beefing with lol. They had the hardest time buying I could identify the gun with only a few seconds of seeing it.

My leg muscles still hurt. I wanted to head butt her teeth down her throat! But what would I have accomplished? More problems. It’s becoming common now for us all to be extremely reactive & negative & violent vs kind and considerate, say thane for letting. Me go! My opinion of course.
      I personally would’ve also called the popo 👮‍♀️ because I know I would’ve felt enraged & threatened by someone waving or flashing a gun at me! IMO

      The charges will be dropped due to lack of evidence. YOu cannot prosecute on eyewitness testimony and a coincidence. In all honesty the officers shouldn't have arrested him.

      I don't know... it seems kinda straight forward to me. Someone called the police complaining of a road rage indecent and a gun being pointed at them.... the cops show up and confirm the road rage story (by his own admission) and then find a gun in his center-console (just like she described). That's plenty of evidence for an arrest. If you were the cop, what differently would you have done? Yes, maybe she was lying (they have courts for that) ... but all the evidence thus far suggest she is telling the truth.

      @@amark350 Ask better questions to determine if he actually brandished the gun. What color was the gun? Was it a rifle, shotgun, handgun? Was it sleek looking, blocky, revolver, semi auto? Even someone with minimal to no knowledge of guns could answer these questions. It was poor detective work. I disagree about plenty of evidence for an arrest. The case is going to get dropped quickly. There is no proof.

      @@okstate999 Perhaps you are correct that they will lose in court... but that depends on a lot of factors (what attorney is hired, the judge, his criminal record, etc).
      However, as I said, there was plenty of evidence for an arrest (admission of road rage and eye-witness testimony of a gun - which had corroborating evidence i.e. they found a gun in his car). That's enough. The more detailed analysis is saved for courts.

      We weren't there so we don't know if she made a lucky guess, or was just trying to get him in trouble. But him actually having a gun only further corroborates her story to the police, and makes it that much more likely that he did actually wave it at her, because again, it was otherwise a total lucky guess. It is a he said/she said, but based on the stories and the evidence, her story just seems more likely.
