Fun fact, these loopholes are why real life laws love the "a reasonable person" argument. So, a real law version of one of these Minecraft EULAs would be written instead as "You may not include what could reasonably be considered gambling" or "what a reasonable person would consider to be an unfair competitive advantage." It adds a layer of ambiguity that prevents these "well TECHNICALLY" excuses.

Case in point, what is a "competitive advantage" could change drastically depending on the nature of the server: one with heavy survival mechanics would see a way larger advantage in buying food items with real money, than a server with vanilla survival mechanics. A "reasonable person" would understand this, and recognize being able to buy food in a permadeath server where you could starve to death gives a competitive advantage while being able to buy food in a vanilla server does not. It essentially allows the same rule to be applied differently based on the nature of what it is applying to.

Mojang is specifically breaking Swedish law as Mojang is a Swedish company and Kian lives in Sweden so Kian has the right to sue them. If Mojang were to allow gambling (crate keys) under their EULA then Minecraft would be rated PEGI 18 in Europe due to the EU's gambling laws

As someone who used to frequent towny servers, I’m delighted that the crate key situation is FINALLY getting bad press. Kids would pour hundreds of dollars into crates and ranks for a social status modifier, and it would make bank for the owners. Lots of drama and regret. If Microsoft/Mojang is going to pretend to start caring what happens on MC servers, I’d think this issue should take priority.
The "gambling loophole" is exactly what allows real giveaways to exist with paid entry. The fact that they DO have a way of entry that isn't payment, is what makes it _legally_ not gambling. The same rule applies to Minecraft's definition of gambling.

The only reasonably legal option for them is a flat ban on Crates, however they could sidestep it by transferring the Intellectual Property Rights for Minecraft to Microsoft which would make a region block viable.
They keep being quiet because they've done it before and it keeps on working when they do a idiotic or controversial change. The combat update, chat reporting, when they actually changed the Eula, the gun drama, now this. Big difference this time is that its legal stuff.
Chat reporting was more than enough to make me quit playing Minecraft online entirely. As I played anarchy servers, I shouldn't lose my account for saying naughty words on a server that cursing is okay, because on another server it doesn't allow it. Better yet, LOSE ALL MY ONLINE ACCESS TO IT. This is why I say vintage story is a better game. Similar, but very different.
@MaoRatto most servers I play on just use a mod that outright disables it. They haven't done anything about it so either they don't care or they know how dumb it is and were forced to do it. Also yeah, vintage story is great. Wish it had a more active multiplayer scene, but the creator did say growing slow is the idea.

The parent can tell the child what to do and what rules to follow, but the child can make the descision to follow those rules and orders, ignore them, or do their own thing. Besides the wiki which is just a win all around, Mojang and microsoft are just shoehorning their way into the community to control it. They made the server list specifically to stop this shit, but instead just did what every server list before them has done and worked behind everyones back to keep them on the official list and others off. The chat moderation that was entirely unnecessary on a mass scale as well. Make it a option for servers to use then it might be okay but not enabled by default. I can see a server wanting to be actually child friendly using the filter, but for more adult servers just does nothing. Mojang and Microsoft are just pulling a Bethesda and trying to control the community, which was built off of freedom. They want to control the narrative and get a slice of the pie they don't need or deserve.
Mojang is just as complicit as microsoft. The insistence to make a distinction just harms people and the game's quality. These people aren't cool, and they are not your friends. They're performers in front of a camera doing a mr beast bit. Like, c'mon. The only way i can think of why they hide these rules and don't tell anyone publicly about them is to appeal more family friendly; probably to appeal to investors/parents.

Also, take notice these steps are REPEATING (hence why Grinding word is there) due to the nature of only one-time for each player for each vault and not cooldown based like the trial spawner

yeah passive mobs that were in game before Microsoft bought Mojang like the sheep, cow, pig, chicken. dropped Experience and meat. however new passive mobs that are added don't drop anything upon unaliving, and this is intentional as the way to get a goat horn in survival is to have the goat ram into a wall and have it's horn break off. Mojang before would of made the Goat's horn a drop upon unaliving. and some of Mojang's development rules are either restrictive or contradictory.

if you don´t make all of your rules and guidlines publically available, you can not enforce these rules and punish violations. you just can´t punish and ban people for alledgedly breaking rules, they didn´t even know exist. and any argument of "Mojang / Microsoft is a private company" should not and shall never apply because even private companies are operating under the law and not outside or above it - now matter how famous and rich they might be.
Adding to Red Magic overall, I 100% recommend them. I'm a proud member of the RM family. I started with the 3 and stayed. Definitely pick one up. Even if you have not a lot of money, the base phones are at a low price but the tech is so good that you would think you ordered their mid/top phone by accident. You get the best value for your money. But the cameras aren't the best but also, if you're buying a gaming phone specifically, you're not getting it for the camera. Just go buy a professional camera with a mid range phone attached to it (IPhone 14+)

Mojang attempting to exert this level of control is why I was concerned when the Player Chat Report feature was added in 1.19.1. They were vague on what constituted certain violations of their chat guidelines and I suspect the real reason it was added was not so much to keep players safer online - which mind you is a fair reason to implement it, given that a lot of Minecraft players are kids and can be exploited even on servers with good rules and enforcement - but to shut up anything they deemed "inappropriate", which seemed rather convenient for a certain American company with a political bias that also happens to own Mojang. I could be wrong - and I'd like to be - but I have a very strong negative opinion of that feature and these hidden server rules only reinforce that opinion.

Should the lawsuit succeed and a change go through, brighter days can be seen for those without excess cash, and especially brighter days for Timmy's mom's credit card. This issue should get as much attention as possible to fuel the flames, Possibly even turn into a class-action or whatever the Swedish equivalent of a class-action is -- idk I'm not Swedish -- so it starts making waves on media outlets as well. If we reach that point, the negative press may skyrocket and either force a change or force a settlement, the latter I'm sure Kian will not settle for, and the fundraiser will gain even more ground. Remember; commenting boosts the algorithm, comment when you can, even if it's just something small, to raise awareness further.
The people are in control, it doesn't mean the people will the control. It's more of an issue of, people not really caring enough to criticize a big company, or not having enough faith in what they as an individual can do, when there is LOTS of things you can do. And a lot of people will choose not to do any of it.

The "gambling loophole" is exactly what allows real giveaways to exist with paid entry. The fact that they DO have a way of entry that isn't payment, is what makes it _legally_ not gambling. The same rule applies to Minecraft's definition of gambling.

Correct me if I am wrong, but from my understanding Mojang doesn't get a cut from servers selling crates. So why do they defend those servers?
Because it keeps people playing their game, people have more fun playing a modded server so someone will write a good review of the game, making profit go higher.
Because crates are not gambling under the law thus they could not care less. But they can’t attack them.

@@iskeptical5698 Mojang as a company is based in Sweden which is beholden to E.U. gambling law. Even if they region block those servers leaving them up in general puts them in violation anyways. The only reasonably legal option for them is a flat ban on Crates, however they could sidestep it by transferring the Intellectual Property Rights for Minecraft to Microsoft which would make a region block viable.

Chat reporting was more than enough to make me quit playing Minecraft online entirely. As I played anarchy servers, I shouldn't lose my account for saying naughty words on a server that cursing is okay, because on another server it doesn't allow it. Better yet, LOSE ALL MY ONLINE ACCESS TO IT. This is why I say vintage story is a better game. Similar, but very different.
@MaoRatto most servers I play on just use a mod that outright disables it. They haven't done anything about it so either they don't care or they know how dumb it is and were forced to do it. Also yeah, vintage story is great. Wish it had a more active multiplayer scene, but the creator did say growing slow is the idea.

It's like a parent and child. The parent can tell the child what to do and what rules to follow, but the child can make the descision to follow those rules and orders, ignore them, or do their own thing.

Mojang, Roblox, and UA-cam all have in common a practice of removing content that follows the rules without providing a consistent reason why, while practically laughing in the face of people who point out content that actually breaks the publicly stated portion of their rules (examples: pay to win servers (minecraft), ERPers (roblox), and Elsagate (youtube))
This is exactly what I have been saying. Microsoft, Roblox, Epic Games, EA, and many more corporations that develop online games should be sued for child exploitation.

Besides the wiki which is just a win all around, Mojang and microsoft are just shoehorning their way into the community to control it. They made the server list specifically to stop this shit, but instead just did what every server list before them has done and worked behind everyones back to keep them on the official list and others off. The chat moderation that was entirely unnecessary on a mass scale as well. Make it a option for servers to use then it might be okay but not enabled by default. I can see a server wanting to be actually child friendly using the filter, but for more adult servers just does nothing. Mojang and Microsoft are just pulling a Bethesda and trying to control the community, which was built off of freedom. They want to control the narrative and get a slice of the pie they don't need or deserve.
I think Bethesda is owned by Microsoft so.

The only way i can think of why they hide these rules and don't tell anyone publicly about them is to appeal more family friendly; probably to appeal to investors/parents.

yeah passive mobs that were in game before Microsoft bought Mojang like the sheep, cow, pig, chicken. dropped Experience and meat. however new passive mobs that are added don't drop anything upon unaliving, and this is intentional as the way to get a goat horn in survival is to have the goat ram into a wall and have it's horn break off. Mojang before would of made the Goat's horn a drop upon unaliving. and some of Mojang's development rules are either restrictive or contradictory.

if you don´t make all of your rules and guidlines publically available, you can not enforce these rules and punish violations. you just can´t punish and ban people for alledgedly breaking rules, they didn´t even know exist. and any argument of "Mojang / Microsoft is a private company" should not and shall never apply because even private companies are operating under the law and not outside or above it - now matter how famous and rich they might be.

Mojang attempting to exert this level of control is why I was concerned when the Player Chat Report feature was added in 1.19.1. They were vague on what constituted certain violations of their chat guidelines and I suspect the real reason it was added was not so much to keep players safer online - which mind you is a fair reason to implement it, given that a lot of Minecraft players are kids and can be exploited even on servers with good rules and enforcement - but to shut up anything they deemed "inappropriate", which seemed rather convenient for a certain American company with a political bias that also happens to own Mojang.
I could be wrong - and I'd like to be - but I have a very strong negative opinion of that feature and these hidden server rules only reinforce that opinion.

Tbh it's not just Minecraft, almost every online video game today has some sort of p2w system. These companies (Microsoft, Epic Games, EA, Roblox, etc.) should all be sued for child exploitation.
Should the lawsuit succeed and a change go through, brighter days can be seen for those without excess cash, and especially brighter days for Timmy's mom's credit card.
This issue should get as much attention as possible to fuel the flames, Possibly even turn into a class-action or whatever the Swedish equivalent of a class-action is -- idk I'm not Swedish -- so it starts making waves on media outlets as well. If we reach that point, the negative press may skyrocket and either force a change or force a settlement, the latter I'm sure Kian will not settle for, and the fundraiser will gain even more ground.
