- China has said the Philippines has seriously violated its sovereignty, after Manila accused a Chinese navy ship of shadowing and trying to block a Philippine naval vessel near disputed islets last week. Beijing said the Philippine side had illegally occupied the islands. The Philippine ship was on a resupply mission when the Chinese vessel came as close as 300m as it crossed the front of its path.

Thitu Island or what Philippines called Pag Asa island is not just an outpost. It is a town proper of the municipality of Kalayaan group of islands. With a mayor leading them the island has more than a hundred filipino civilian residents with a school, municipal hall, police station, health center and homes were people raise their livestocks and crops other than working as fishermen.
Based on the Hague ruling is not island but a rock.

Because even though the PH is known for having an average of 20 typhoons per year, that sea area is not a typhoon path. It is extremely rare that a typhoon ends up taking that route. That's in Palawan, the least affected region by natural disasters in the PH.

United Nations Convention for the Law of the Sea (UNCLOS) said there is no legal basis for China to claim historic rights to resources within the sea areas falling within the “nine dash line”. (Present day ten dash line)
Every coastal state or country in the world can only claim up to 350 nautical miles of territory including the extended continental shelf and the exclusive economic zone (EEZ). It is not allowed to claim more beyond that with respect to United Nations Convention for the Law of the Sea.
The historical narrative of China’s claim is false.
The Philippines is the first ever country to name the islands in the West Philippine Sea such as the panacot (Scarborough shoal) and the Los Bajos de Paragua (Spratly islands) in the 1734 Murillo Velarde map. There is no older map from any other country showing that Scarborough shoal or the Spratly’s belonging to them. The 1734 Murillo Velarde map has the cartouche of the kingdom of Spain, it is the official map of Spain to the Philippines under the regime of Spain. China’s oldest official maps shows that their southernmost territory is only up to Hainan which tells us that even if China wants to push their historical narrative, history itself is contrary to their narrative. The Chinese territory extended no further south than Hainan.
The Chinese 1914, 1924, 1937, and 1947 republic constitution provides that “the republic of China continues to be the territory of the former empire” this quote refers to the Qing dynasty territory which was the largest expansion of Chinese territory and that we know only extends until Hainan. Their own constitution clearly declares where their boundaries can only extend and this fact makes the claiming of the whole of south china sea contrary to their own constitution or in other words unconstitutional.
There was no evidence that China historically exercised exclusive control over the waters of south China sea or their resources. The tribunal is unable to identify any evidence that would suggest that China historically regulated or controlled fishing in the south China sea, beyond the limits of the territorial sea. China’s historical claim of the whole of south China sea is so inconsistent and at times contrary to each other that it is not even valid enough for their narrative. Thus, China never had historic rights in the south China sea.
The Philippines on the other hand have a strong case to present to the tribunal to the West Philippine Sea issue. The Philippines have factual evidence that they own the Spratly islands and Scarborough shoal, not only historical evidence but also legal rights. Two of the strongest Legal basis of the Philippines is the Washington Treaty between Spain and The United States of America and the Treaty of Peace of Paris.
The Treaty of Peace of Paris’ frame of reference is the 1734 Murillo Velarde map because it is the official Philippine territory under the Spanish regime and this is what they have ceded to the Americans under the Treaty of Washington and the Treaty of Paris which includes Scarborough shoal and the Spratly islands. Basically the Murillo Velarde map is still the basis that determines the territory of the Republic of the Philippines.
In the 1900 Treaty of Washington, Spain had relinquished to the United States all title and claim of title, which Spain may have had at the time of the conclusion of the Treaty of Peace of Paris, to any and all islands belonging to the Philippine Archipelago, lying outside the lines of the Treaty of Paris. These territories outside the lines, included Scarborough shoal and the Spratly islands.
The Philippines have absolute exclusive rights over the West Philippine Sea. The tribunal decision by the UNCLOS is clear that the West Philippine Sea is rightly owned by the Republic of the Philippines and not of China based on the clear evidence that the Philippines represented. China’s actions in the West Philippine Sea is not recognised by the UNCLOS and is therefore illegal under the eyes of international law. China by bullying small nations because of its greed and expansionist agenda is a bad example to the whole world and shouldn’t be tolerated by the United Nations. The law must always be upheld and the violators must always be punished and face the consequence.

UNCLOS does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory.
@@annan7728 If China is confident of its legal title to the Spratlys and Scarborough Shoal, then it should submit the territorial dispute with the Philippines to voluntary arbitration before the International Court of Justice. This is in accord with the UN Charter which mandates the peaceful settlement of disputes between states through negotiation, mediation, or arbitration, and outlaws the threat or use of force in settling such dispute.

These are just a few definitions you can find of what "jurisdiction" means. They mention everything about legal authorities. Scs is the traditional fishing ground by the nearby countries that are near to that areas of the sea and not those that are far from it.
The U S granted independence to the Philippines but the US did cede the Spratly group of islands to the Philippines.

Those who think that Philippine territory is limited to the islands lying within the Treaty of Paris lines have neither read the 1900 Treaty of Washington nor the correspondences between Spain and the United States that led to the 1900 Treaty of Washington. In any event, China is bound by its judicial admission in its Position Paper that Philippine territory is also defined by the 1900 Treaty of Washington, which expressly includes as Philippine territory all islands belonging to the Philippine archipelago lying outside the Treaty of Paris lines.

Fourth, China submitted to the Arbitral Tribunal at The Hague a Position Paper stating that Philippine territory is defined by three treaties - the 1898 Treaty of Paris, the 1900 Treaty of Washington, and the 1930 Treaty between the United Kingdom and the United States. China claims that under these three treaties, all the island territories of the Philippines are found only within the 1898 Treaty of Paris lines, and since the Spratlys and Scarborough Shoal are outside the Treaty of Paris lines, the Spratlys and Scarborough Shoal do not form part of Philippine territory.
China is gravely mistaken.

How will China claim its legal rights over those islands if they were parts of the EEZ (Exclusive Economic Zone) of the Philippines? Can the United Nations leaders call the leaders of the Chinese government and have a lecture about EEZ (include the Nautical Mile water Territory) and ask for a Chinese to English interpreter or vice versa so they can fully comprehend what EEZ means. For so many centuries we FILIPINOS have rightfully claimed over those islands and only now the Chinese government is trying to steal it from us. But we will NOT let anyone destroy the sovereignty of our country. because the Law of the Sea defines what is legally belongs to the Philippines. 🇵🇭
