  • It appears luxury brand Louis Vuitton has been cracking down on Instagram content creators. Many social media users (myself included) have experienced issues on the platform including post removals and account suspensions, even terminations in some instances. I've been operating the @sunshinefashionlove Instagram account since April 2023, and up until recently, was posting photos & videos of my handbags and accessories for fun. With only 500 followers, I experienced several Louis Vuitton (and one Gucci) posts being removed by Instagram for allegedly breaking Terms of Service for "Using a trademark, without the owner's permission, in a way that could cause confusion about your affiliation with them."
    Instagram also noted: "You can still infringe someone else's trademark rights even if you give credit to the owner, or disclaim you don't intend to infringe trademark rights."
    In this video, I breakdown what happened to me, and share observations & theories about what I suspect is happening with Louis Vuitton & Instagram behind the scenes. There are lots of rumors floating around online, so this is only my opinion and speculation.

    Definitely confirmed a lot of what I was thinking, that the issue is showing brand logos in the photos/videos themselves, so it doesn't necessarily help just to avoid naming the brand in the caption or not using hashtags. The technology already exists to scan the actual content and detect brand IP. Yes, it's crazy that luxury brands do not want us sharing photos/videos of items we purchased, but clearly they want tight control over their image. They are using trademark laws to pressure social media platforms like Instagram and justify removing this type of content.

    When their sales fall because people can’t get enough information about the bag, or what fits in it, or how functional it is… and then choose not to buy something… Then maybe they’ll realize how shortsighted they are

    This is such a short-sighted move on their part. I’ve NEVER wanted to buy something from their runway shows, model photo shoots, or advertisements. But have been “influenced” by social media “regular” people.

      Yes, I can't imagine it would fly if say... Coca Cola tried this with their customers or Apple, Toyota, etc.

    I got two of my recent IG posts deleted aswell: the first one was a picture of two bags, some turquoise boxes and a twilly. One bag was by LV & the other one by Tiffany&Co (and I probably # the brands). Reuploaded with another text and the picture is still online.
    A few days later I posted a pic of me with a Chanel classic flap as part of my outfit (didn’t # Chanel this time, but tagged my Prada sunglasses 🤦🏻‍♀️). Deleted. Still waiting for a response after my complaint.
    Those brands are not doing themselves a favor: social media has been a huge catalyst to boost luxury sales in recent years. If people are not allowed to post pictures with their purchases anymore - why should we support those brands with our money?!

    Love this video! TBH I’ve decided to stop posting on IG entirely (at least for now)
    I don’t really see the point anymore….
    however, related to the posts getting taken down- it’s very clear that these are being flagged by some sort of AI, and it’s doing a terrible job. It’s clear that the software is not able to differentiate between commercial or scam accounts and actual fans and customers of the brands. And rather than erring on the side of caution and prioritizing the desires of the consumers they’re removing everything.
    Just a reminder that we don’t need to shop these brands, especially if they’re going to just suck all of the fun out of it.

    I've had a few posts taken down last year, so I stopped tagging or hashtaging the brand's but I'm still scared to post. Which sucks because my whole account is vintage luxury bag finds & how to shop luxury, so I'm always posting pics of my bags. I've seen so many accounts taken down completely 😢

    Thanks for this very informative and insightful video! In the last few weeks, LV and Chanel both settled lawsuits regarding TM infringement. As you mentioned in your video, LV lost their lawsuit, but Chanel just won theirs for $4m against well-known reseller What Goes Around Comes Around citing “brand confusion”. I think you hit the nail on the head as to why certain social media accounts are being targeted first. I’m now planning changes to my content strategy and branding going forward. I agree with you that what they’re allegedly doing an overreach, but I think it’s good in a way to force us content creators to make our personal brands about what WE bring to the table and not rely on the brand names. And to also not rely on platforms to protect us.

      Thank you for stopping over here! I think you have a smart content strategy in that it’s clear people follow your account for you and not just to see designer items. It’s a good example of what more of us should be doing.

    There is no way LV should be able to do this to ppl. There is nothing wrong with posting photos of your own property.

      You know, the more I think about this... it could potentially be a free speech issue? That's how media outlets often fight lawsuits. Instagram content creators are micro media outlets, and we could argue this is our right to free expression.

    Thank you for sharing and I’ve had the same issue with posting a vintage Gucci bag. This situation with LV doing this on IG and the recent Chanel lawsuit success it is going to get very interesting with all of us in the luxury community regardless if you’re selling or not.

    What LV is doing is a complete over correction. I will be starting a handbag channel soon. I have a few LV pieces and want to purchase the Neverful, but after that I won't be purchasing anymore LV products. I can't allow any company or brand to treat me like a step-child and I keep buying from them. Thank you for this video; it was informative! 👍🏽

    My theory: Louis Vuitton does not feel that these content creators are "on brand." Remember that LV is an aspirational brand, and their marketing team thinks is that if you see a bunch of average Joe's online owning LV merchandise, the LV brand will lose their perceived exclusively / cashe. They only wants us consumers to see celebrities/selected models to be seen with their wares--and aspire to be a little bit like them, if only by purchasing an LV bag.

      Agree, they definitely seem to want an air of exclusivity and don't want the LV products to be everywhere.

      They seem to be working hard at losing a lot of money. Their sales are at a record low after their price increases.

      Pulling this stunt is a good way to alienate customers even more. Imagine if other large corporations tried to police how you use their products...

      I think their strategy now is to target customer who make more money. Which is why they’re raising prices so. Boutique stores for LV are nothing more than marketing material and have people pining over how much they want a piece. They’re def stepping away from the base of customers they used to have. I mean the lack of new luggage items and accessories is telling. They keep pushing bags and clothing. Which LV you’re not an expert in making clothes. You were an expert in the luggage making space. Overall Bernard (the owner of LV) doesn’t need more of my money. Plus, seems like they don’t care for the Damier Graphite color way anymore.

    LV is over reaching and should be stopped… it is a total BS … one thing is copy pasting and stealing and another is just making a post of your own stuff … isn’t it enough they over charging these plastic bags ?!

    I wouldn’t even have my Louis Vuitton bags and agendas if it wasn’t for thirsting after them on instagram and UA-cam. I think they are killing their brand and it’s making me wonder if I should stop buying them 🤔

    When their sales fall because people are not buying something because they can’t get enough information about size, fit, functionality, etc because they don’t have a boutique near them or access to seeing the bags before they buy it… Then maybe they’ll see how shortsighted this is

    Wow! I think you’re right! A lot of influencers gain followers from posting pictures/videos with luxury brands. And these same influencers receive sponsors from more affordable brands ex Dooney, vegan bags , etc.

    And then on the flip side LV gives bags to influencers to showcase on social media to get buzz going for sales. - I personally think anyone on IG that uses LV hashtags is what’s getting removed. Just don’t use hashtags.

      First off, so sorry to learn that Instagram shut down your main account. You deserve transparency and some way to contact a real human with Meta.
      I'm honestly quite surprised your account was targeted, because I thought the type of content you posted seemed "safer." Like you did Reels showing outfits and styling different accessories, but the focus was clearly you and not necessarily the brands.
      My account is personal and I somehow got flagged, so I don't think it matters what type of account you have. If I hadn't removed all of my LV and Gucci content, I suspect the account would have been eventually shut down or at the very least suspended.
      I've been experimenting with having branded items in new posts, and so far none have been removed. The designer item is either a very small element of the overall content or the logo is blurred out.

    It is possible that posting your items without being in the photo makes it look like they are for sale

      It does seem like it's "safer" for you to be in the photo with the items and they are not prominently featured. LV is not trying to argue that we are selling the items, they are using the argument that us simply posting pictures/videos with their trademarked property (the logo) is justification alone to remove the content.
      The reason photos with close ups of bags or where the item is the main focus are the ones that seem to be most affected is because it's pretty easy for the AI detection tools to identify those. It's harder for the AI to detect content where the branded item is much smaller, out of focus, angled so the logo isn't very clear, etc.

    I looked at your Instagram, and the style of your photos looks as if the items are for sale. I haven’t seen the photos that were taken down but if they were done in the same style that might be why.

    It’s not just LV. I posted a new Chanel item I bought and it was taken down by IG. It came up the same as your infringements message. Basically telling me to be careful or my account can be deleted at any time.

    I have posted my bag and hashtagged the brand in my personal account with no issues but that may be because it’s my personal account and my posts varies from food to travel to my unique limited ed purchases or souvenir from a trip. I don’t often post bags but I did on some occasions and hashtag the brand so people know where I bought that accessory - normally I get limited editions .. but I don’t own LVs I go for Dior, Chanel, Loewe, Hermes

    I think Instagram is trying to crack down on fake bags etc it took down my local second hand designer store Instagram thinking they were selling fakes. if they post something they put the brands name on the actual picture so it wont get flagged anymore. Happened to me with with my Dior beauty cluch i mentioned the brands name in the caption and the Instagram AI flags it. I got my post back but will never mention them in captions again.

    I think they have selected a handful of influencers they want to rep the brand. All the big fashion influencers are still posting the brand.

    I came from Lula’s video but it seems rather than the House coming for you, other people could be copying yours and Lula’s content to link to counterfeit items or even con people into thinking they’ve won some LV or Gucci item and “… all you have to do is pay for shipping…”. This would make more sense and is much easier to do if you aren’t in the photo. Sadly, a lot of people would be scammed out of $20 postage for a designer item they think they’ve won 😢.

    I suggest not posting these designers items anymore its ridiculous people I The sneaker community going through the same thing the only thing that kinda help was not putting the brand name or spelling it incorrectly but it doesn’t matter it still get taken down posted yesterday and instantly got a notification they didn’t take the full post down but they took the first picture down you have to question supporting these designers brands when they treat us like this
