If the standard was set by sentencing guidelines, based on facts presented to the jury at time of trial, ONLY, were sufficient in establishing sentencing, then an enhanced sentence, based on further determination of the presiding judge, may be unconstitutional, because not all of the new or expanded findings of the judge, might have been presented as fact before the jury, before the conclusion of the trial. The bias is in the judge's history on the bench, and with subject matter. They have insight to criminality, that perhaps a jury, would not have, therefore, the sentence would be expanded based on judicial bias, rather than procedural law and statute.

So think again about what is left out of their (Booker and Jackson's) conversation. His questions are too easy and not a challenge. The easy questions and answers do not give an honest picture who will determine life long decisions our children will be introduced to.
