      Sounds like they’re acting like a law abiding government. The law is the law ALL the time. As mentioned in the hit piece there are avenues to change that law, but the folks want to follow the age old American tradition of please make an exception just for me.
      Here in lies the problem. Once an exception is made for them, who else gets exceptions? And to which laws?
      Propose an amendment…it will be voted on and either passed or not.
      It amazes me how so many people who think this country is the first/only democracy in the world forget so easily how a democracy works.
      PS: I doubt this village is surviving solely on the taxes generated by this bar, and the loss of a booze dealer is not going to do the town in.

      The wise choice is to move the business and signs to a nearby community. The waiver request will cost money and isn't a sure thing. If the town council can't look at an ordinance before adopting and see the law of unitended consequences (Robert K. Merton) then it's time to move on. That council can find the lost tax revenue from another clearly non existent business, as the report notes that he is the only one in town. @@meangene98

    • @jcclark2060
      @jcclark2060 Місяць тому +2

      And that is a problem? If you look at state and local laws around the US you will figure out pretty quickly that most of the laws are copies of another jurisdiction. Just because something has been there for a long time or something gives joy to someone doesn't mean it should be accepted or allowed to continue. The video shows a cluttered storefront and most municipalities have sign laws limiting the number and size of signs allowed on each business.

    • @peach495
      @peach495 Місяць тому +26

      To be fair, this bar is the ONLY business providing tax revenue to the town. I'd bet money the council is either volunteer or part time.

    • @NotTheRealRustyShackleford
      @NotTheRealRustyShackleford Місяць тому +13

      @@jcclark2060 There is nothing wrong with copying laws from other places, but it needs to be a good fit for the constituency. A lot of copied laws differ in their final text as they can be altered as needed to fit the local sensibilities. For example many states "copied" constitutional carry in concept, but the laws for carry varry quite a lot state by state. This sounds just like a copy and paste being abused by representatives so lazy they can't be bothered to actually do their jobs imo.

ACLU of Florida associate legal director. “The city had no right to stifle the owners’ free speech, and we are very pleased that the court enjoined the city’s unconstitutional conduct.” If it's deemed non-commercial speech, it can't be regulated under a sign ordinance. Have the owner put up a sign with the American flag on it, then have the town council order him to take that down, then watch what happens. Local governments should take care to define the boundary between commercial and non-commercial speech, using distinctions found in case law applicable to the local government.

      Unfortunately that isn’t the case if you are a business. Pretty much all cities have ordinances that regulate the signage that is allowed to be displayed by a business. There are regulations on how high a sign can be, how close it can be to a road, if it can be lighted or not, what is allowed on the sign, etc. Now if this was someone that had a bunch of signs that were around his shop in his backyard, or by his home, it would be different. And for the most part, these regulations are re a good thing. They keep a business from putting up some large neon sign that will shine into a person’s bedroom, or some gaudy looking sign that takes away from the appeal of the neighborhood. Stuff like that is what these regulations and ordinances are meant for. And remember, you run a business with the permission of the city/country so they have the final word. In this case the village is cutting their own throat by threatening to close or fine the only business that brings in revenue and is pretty stupid. And it doesn’t sound like it is what the majority of the people living there want, it sounds like someone is making this personal. You may not agree with it, but it is legal and the village has the authority to either fine him or revoke his business license. So no, you cannot put up any sign you like if you are a business owner, even if it is on your own property.

    • @johnchambers8528
      @johnchambers8528 Місяць тому

      @@TheCrazyMoparDude68You are partially right. The regulations you are citing are usually in place in larger towns and cities and also in areas listed as historic so as not to disturb the tone of the town or area. In a small town like this these type of regulations are not usually needed unless as stated earlier someone wants to put up a bright sign that may intrude on another persons property. It seems to me the town council should be happy for what he has done. As he stated in the video it encourages visits to the town and his business that helps raise the tax revenue for the town. Also who knows it may also lead to other classic automotive type of businesses to start up in this town.

    There is a concept known as "grandfathering" if the town adopted these laws after the signs were already in place. A really clever lawyer might be able to argue that the grandfather clause applies to all the zoning in place when he bought the property and that these new zoning rules can only apply after the property changes hands. Who knows. Lawyers can be tricky like that.

    remember folks, "zoning laws" and "signage laws" are just legal ways that people YOU elected exercise petty tyrant power over YOU. Those signs are not hurting anyone, yet some Karen or Joey wants to be able to be the tyrant and decide what this guy does on HIS property.
    Collecting thousands in tax revenue just isn't enough for them.

    There are 1.968 million (2022) people who live in all of Nebraska, I really don't think the signs are going to cause any harm to any one of them to leave them up. It just shows how little the village council has to do with their time.

    These signs bring me joy too!
    The footage shows they’re carefully displayed and arranged to be attractive, versus some some careless, jumbled mess. I think the town council mentioned here would be foolish, disappointingly consumed by their own “power”, and incredibly short-sighted to pursue the removal of these signs. That would be a sad display of the “worst” side of representative government.
    Council, listen to the people you represent and CORRECT your mistake… don’t COMPOUND it!

    We have had a sign ordinance in my town since before I moved here. The primary stipulations are no billboards, and signage must be attached flat to the face of your business.
    When I first moved here I didn't notice the difference a sign ordinance makes and just went along living life. But when I left town to a place without a sign ordinance I almost felt nauseas by seeing billboards and signs blocking every view. Driving through it felt like being on a website with too many pop-up ads.
    I wonder if their new ordinance permits the signs at lower heights or wall-mounted. It does seem odd for such a small town to worry about the ordinance, but if tourism is a big part of the economy it will pay off to keep that small town vibe.

    They sortof did the same thing in another city in my area. The council basically adopted a new code that bans new tobacco and vape shops from opening within 1000ft of schools or daycare facilities but are grandfathering any existing locations. It's more or less to prevent the kids from seeing all the advertisements which is just even more govt censorship. As long that the signs are within the code I don't see how it matters how many he has on his property.

    The town council that opposes it is absolutely unhinged. They are in a unremarkable town in a unremarkable state. I gurantee that everybody who drives through the town agreea with that statement, and the only thing that gives the town any class or interest is the antique signs that aren't littering the property they are on, but are actially beautifully displayed. Shame on them.
