      They have Qualified Immunity. Yes. Qualified immunity applies to all government workers, whether local, state, or federal (some of them might get even greater protections, like prosecutors and judges, but all can take advantage of qualified immunity at a minimum).

      If she has been doing stuff like this her staff are likely to be close friends and family.
      It's difficult to get away with this for so long without support. She will have hired them to protect her.

    I knew someone who'd committed a petty crime as a teenager, was put on probation, and while on probation he and some friends were accused of trespassing on private property, and the guy was charged with violating his probation. However, the property owner declined to press charges on the teens, and the probation violation was voided. The guy completed his probation without further issue, and never got in trouble again. YEARS later, in his 20s, he was stopped for a minor traffic infraction, and they noted he had a warrant. He had no clue what it could be for. They arrested him and took him to jail for the night. Later, everything was dropped because they learned that the warrant, which was more than five years old, was for the violation of probation charge, that had been voided by the probation officer. However, a Clerk of the Court had never updated that information, and this man had a warrant for more than five years without his knowledge. The probation office had even successfully ended his probation without issue, five years earlier. This warrant should never have existed. He was arrested, years later as an adult, for NOTHING. So, keeping court records updated is a VERY imortant matter.

      I believe your account. I have heard of that happening before. These over paid officials should be punished for not doing their jobs. Other officials over look way too much laziness, corruption and just STUPID UNQUALIFIED people in these positions.

      As someone who's had a lot of experience with the criminal justice system,It's not unusual for warrants to be dismissed but remain active in adjacent cities.I once went to court with an attorney over it,the judge suggested the baileffa arrest me ,then release me to "Re-dimiss"

      @@paulmccarter908 I don't know, and mind you, this was decades ago, before the internet, even. As I understood it, it was simply a clerical error, where the probation office was originally filing with the court to violate him, but then voided it. Thus, the probation office knowing he completed probation and was finished with his sentence. But, a clerk of the court went ahead and left the violation warrant active, and never updated when the probation office cancelled it. The guy only spent about 9 hours at the jail, and later was notified by the State Attorney that they'd realized it was a mistake and dismissed the charge. He still got arrested over it. He shoud have sued, but I don't think he ever did.

    The clerk should’ve done her job. It may be a comfy government job where you only have to work for about 2 hours a day while getting paid for 8, but you still have to do what your job requires you to do.

      It's not even a matter of laziness. She had the info the court was requiring her to produce but she was refusing to provide it. Rather than do what she was supposed to do, she wastes time and energy to be noncompliant.

      Clerk of court job isn’t a 2 hour job a day. You could work 60-80 hours a week and never catch up. Nothing cushy about that office. Having said that, she is suppose to follow court orders or show just cause. They need to audit everyone in that office and clean house.

      @@cargopilotguy305he acted because he found out because he was threatened with the fine and contempt himself that she’s just not doing her job, up to that point it had not come across his desk. Until after she was already in jail for contempt of another matter.
      Because he held her in contempt for not giving the courts the requested information, she stupidly created her own landslide into how she has been doing her job, if she had just done as the court requested, it would have been a lot longer before she was finally outed at not doing her job, as it was because she went to jail it gave others an insight to the bigger issue when people started coming forward. As for her lawyer he’s a joke, if you cannot pull together all the required information in the small window that the judge gave then he’s not doing his job. She had been given enough time to do her job in the first place. It’s not the first time someone who appeared in court was held over night for contempt and it will not be the last time either.

    Makes you wonder…why would she be so blatantly indifferent about the lives she has effected. What does she have to gain by NOT doing her job? I think the reason why she didn’t want to provide the court with the information was because it would show her incompetence

      Not even incompetence. It's just a matter of following clearly spelled out procedures. She has an agenda other than incompetence, because her lawyer got the information easily from her computer. She had it, but refused to hand it over.

She has employees who typically do the work, but she controls the information and is willfully attempting to control and withold it. Just like in the courtroom, she was ordered to produce the info or be held in contept. She chose not to provide it and go to a jail cell, even though she had the info which her attorney then provided to the judge.

    A petty bureaucrat under the delusion that they have the right to do whatever they want with impunity and in this case mishandling records and her responsibilities to apparently just maliciously cause people trouble. Compying by finally releasing the information shouldn't get her off the hook. She should face real consequences for the damage she's done and for tying up the court.

    Do your job, or face the consequences. In our county, our clerk (or one of the deputy clerks) on order of the judge, they will take that file, and while the next case is getting underway, they will make the proper entries in the computer, scan the physical documents into the computer file, and tag the file for movement into its next location (closed, future hearing, notifications, follow-up, etc.) When the court takes a recess, they will go into their office and file the hard copy. EVERYTHING applicable to that day is done before the end of business that day. Expungements are entered before the individual leaves the courtroom, and the individual goes home with the verification. And our clerk does not have the gaggle as this one apparently does.

    She deserves to go to jail, this is a huge problem in Texas where stuff doesn't get filed right or things get lost and then people get arrested for not paying tickets that they actually paid, all sorts of crazy shit.
    This poor lady has something on her record that shouldn't be there and it's destroying her life.

      Sorry but it is that simple, you pull a stunt like that in the privet sector you would get 2 warnings, if it came to a 3rd warning you were terminated from the company. End of story, you would be lucky if they would give you a reference to help when looking for another job.
      Nope in the government sector they would transfer your bu tt onto someone else, and they would keep doing that. I’m sorry if a person cannot/will not do their job then give the job to someone who WILL do the job.

      ​@kpal2946 That's the way civil contempt works. Sometimes, it's a daily monetary fine until the respondent complies with the court's order. Sometimes, it's jailing an elected official or company owner until the office or company complies.

      I actually never had issues at any county clerk's office in NYC. They seemed competent and did their job swiftly. The only pain was for them to answer the phone. Since I lived nearby, I just walked in to ask questions.

      WRONG WRONG WRONG. Do your homework for gods sake. The judge has zero to do with who occupies the role of County Clerk. For starters, the County Clerk doesn’t sit in the Judicial branch of government it sits in the Executive branch to provide external oversight of the Judiciary specifically to ensure the separation of powers and avoidance of influence on the Judiciary. Second, the County Clerk of Courts is an *elected* position, voted on by the residents of that county. The Judge has absolutely nothing to do with who becomes County Clerk. Nor does he have any power or right to terminate individuals in the Clerks office. Disciplinary actions against elected County officials are proposed and carried out by County Administrative entities such as Boards of Review or County Mayoral leadership.

    The defense attorney goes out in the hall and tells reporters that the Clerk needs ten days to organize and provide the information in issue. Then, the judge puts the Clerk in jail until the info is provided to the Court, and the same attorney within a couple of hours delivers a flash drive with copies of the documents and info required directly to the judge's chambers. Looks like they may need a jail suite for two. Although county clerks (court clerks) are elected, and there are literally no qualification requirements t hold the office, in my 40+ years as an attorney, I never ran into a court clerk who was not capable and helpful. Just lucky, I guess.

      If you notice all offenders who are appearing in court from the cells are all cuffed in front, or they have the leg, waist and wrists shackles on which keeps their hands down at the side of the body. So they would nit cuff her behind her back when leaving the court.

    I find it curious that the defense atty says "we didn't have time to prepare" but *suddenly, miraculously,* they find the information the Court requested later that day. Like they were hoping to further delay the case and not have to comply. All those Crying Karens need to be fired as well, or re-assigned to a real job like digging ditches and picking up trash.

    District and county clerk offices all over seem to be staffed with slackers. I had a situation where a hearing that had to be rescheduled because the date the officer had written on a traffic ticket was a date courts were closed due to some judges' training event or something. .
    1- The case was not rescheduled until a couple weeks after I called to ask about the reschedule that I had never been notified of.
    2- The new date assigned was for a few years before the ticket had even been written, meaning that at that moment records actually could have shown me as a failure to appear, subject to arrest.
    3- When I called to get the error corrected, the only person in the clerk's office who could fix it, supposedly, was on vacation for two weeks - during which time records indicated I had not appeared at a hearing I could not possibly have appeared at.
    I finally did get a new and valid case, presented to an arrogant young jerk of a judge, with a ridiculous poodle perm, a copy of insurance, got the ticket dismissed - but for months afterward I expected every cop I saw to stop me and arrest me for failure to appear. just because of a series of bungles in the clerk's office.

      No, someone just made a fvcking GENIUS legal maneuver here: Normally, you goto the Clerk (of Court) to get a FOIA request. But here, some 200 iq Chad actually subpoena'd the COURT itself, which meant that the JUDGE was legally "on the hook" for noncompliance: Which is what motivated him into actual ACTION here. Otherwise, the Judge would have had ZERO incentive to do anything.
