    This all became an issue due to all the kids tearing up the neighborhoods and streets on their Suron type bikes which are actually electric dirt motorcycles and not bicycles.

      Exactly. I went to the local bmx track, and there were about 5 teenagers in their electric dirt bikes. I told my grade school kids to wait it out, the dirt bikes were going too fast for comfort.... And I'm not complaining, I too would like to buy my boys those bikes. We had fun watching them.😅😅

      Seriously. Saying "Boo California" is about as saying "Boo Biden/Trump" - shows a clear lack of understanding of the actual problems and causes.
      Parents need to be held accountable for the actions of their children - 90% of the issues would stop right there and society would be better off.

    Of course you should still be able to buy them in Cali. For "off-road use." Class 3 ebikes have never been legal in Canada. But you can buy them all day long. For "off-road use only."

      Large ebike companies actually want strict laws. They can make changes to comply while small business can’t afford to take the hit. This is how California operates. They are trying to kill small business. California does this to every type of business they can.

    Mark read about Hoboken New Jersey’s new class 3 e-bike laws , it’s geared towards a 5 dollar registration sticker, mainly to slow down delivery drivers who are a bit reckless . So as it’s stands on the left coast as well as the right coast, class 3 bikes are under a microscope.

    Electric bicycles are great, but it helps if you use the pedals instead of using them as foot rests. If Oregon follows California laws then don't forget no more gas lawnmowers, leaf blowers, and chainsaws. Also full width speed bumps.

      If you got pedals and aren't speeding on surface roads, you will be fine.
      When on roads with possible police presence, take it slow and pedal. When you aren't around any other cars or on straight shots, let it rip.
      I usually ride late at night and cruise. My dual-motor ebike can hit 48mph but now I'm only going to do that in more rural spots or in areas where I know I can dip into an alley and zip home 😅
      Also look into police ordinance in your city - in some places, cops are not allowed to pursue in any manner (Oakland for example)

    An ebike is either Class 1, Class 2, or Class 3. Class 3 has a higher speed limit but isn't allowed a throttle. The only ebikes that have ever been allowed a throttle is Class 2. There are manufacturers trying to pretend a horse turns into a zebra at 21 MPH. It's a horse or it's a zebra. If people want to go faster than 20 MPH with a throttle, or 28 MPH pedaling, there are these things called "motorcycles". There are even electric motorcycles.

      @@oregonebikermark8953 That additional 8 MPH means 75% more energy to dissipate in a crash.
      That rule is intended to avoid the sort of situation I saw on my bike trail last summer, where an older guy, who probably hadn't ridden a bicycle in 30 years before he got his ebike, completely screwed-up an intersection where cars have the right of way, hit an old 12x12 wooden bollard, breaking it off at ground level, his front wheel was eight feet from his bike, his front fork was mangled all to heck and of course he was really banged-up. I saw the aftermath, not the actual crash. I don't know exactly how fast he was going but I saw his bike was built for speed. He didn't have the riding skills to go with the speed he had. As heavy as that dude was, he would probably not buy a bike that required pedaling, where a bike that requires pedaling is appealing to people who are regular riders, and just want to go a little faster.
      It's not a perfect system. Maybe the best thing would be to get rid of the Class 3's altogether. If people want to go faster than 20 MPH, they can get a motorcycle license and motorcycle.
      The idea of motorcycle rider licensing is to ensure that people have the required riding skills for faster riding.

    I don’t see how they’d enforce this on the purchase side. One of the reasons why you can buy “illegal” devices is because you can operate basically anything on private property. They can’t know you aren’t planning to ride on private property, so they can’t stop the sale. I just can’t see them enforcing this at the purchase side for that reason. If they feel like wasting their time on enforcement of riding on a public road, I guess they could do that, but I doubt they will.

      it's not illegal its just not an ebike. it will need motorcycle or moped registration now even though some high powered models are still under the moped power output. just another cash grab by the state.

      @ That would be true if you want to ride on public roadways. You can buy a gas dirt bike and you don’t have to register that if you aren’t going to ride it on the road. The place you buy it might tell you that and offer to help you register it, but you can tell them you’re only going to use it on private tracks and they’d let you buy it without registering it. There have been people who have tried to register e-bikes and get a plate, and they are often told they can’t because they don’t have a VIN and don’t meet some of the design criteria mopeds/scooters/motorcycles do. If you want to buy a Sur Ron and utilize it entirely on your property, that is perfectly legal and you don’t need to do anything as far as registering it goes, so I don’t see how they could enforce this law at the point of sale. Owning a faster device isn’t illegal, riding it unplated on the public roads is.

    Not sure what CA law your reading as there is no change to the Federal Regulations on the Classes of ebikes. CA added a pilot program in San Diego County that talks about Class 3 & kids 12 years or less can't ride any ebike which is unconstitutional banning kids from riding bicycles which Class 1, 2 & 3 ebikes are under Federal Law trumping state "law" in contradiction of actual law.

      More people riding them, so a bigger target. To be fair, your scooter is probably illegal to operate on public roads in your state, police just don’t waste their time enforcing that if you’re not tearing around on a mixed use path close passing pedestrians. I have electric unicycles, it’s not permissible to operate them in public faster than 20 mph in my state. I do, but by myself out on the road. If I go on the sidewalk or bike path I go 10 or 15 mph and slow down around pedestrians, and so police have no reason to give me a hard time. But I am technically operating illegally every time I ride when I go 30+ out on roads.

Police have seen me riding my EUCs 100+ times, to the extent they’ve ever said anything it was younger cops who say it looks awesome; there is absolutely no will to enforce these laws on people riding like a car on the road and following traffic laws. If I start seeing people blasting at 25+ mph on a bike path, I have no problem with them getting in trouble for that.

      Yeah, I agree nobody’s gonna enforce this. If you go to the heart of downtown Los Angeles or Hollywood, you see many people commuting to work or delivering on an E bike or scooter. I guess you just have to come across the right asshole cop.

      The police may not have time to bother you, but… if you hurt someone while operating an illegal vehicle on the road, the other guy’s lawyers will tear you apart. That’s why adults will pay to own a real motorcycle, have a license, and get insured, rather than try to exploit some (temporary) gray area in the law.
      Full-size full-power electric motorcycles will be becoming more common, and they’ll be classified as motor vehicles of course. The vehicle code has to draw a line somewhere.

    I just tried almost purchasing a 28 mph throttle ebike on amazon with the same result. I'm in California. All they have to do is sell the bike with the 28mph throttle locked out like they always do and just change the sells pitch to 28mph with pedal assist and use cadence sensors. Does the rule say anything about ebike kits?

    EBikes should be class 1 only because you have to pedal a bike to go. If it's got a throttle and moves without pedaling or doesn't have pedals at all it's a motor vehicle. I think this is coming to every state, and the throttle puts everyone in the motor vehicle category with insurance and license requirements.
    My guess is you will have to have a license plate and insurance for what you are on and only ride it where motor vehicles are allowed. If you live in a state that requires a helmet be dot approved then that also will apply.
    It's pretty clear, get a pedal assist class 1 only, or get a motorcycle and all that goes with it.

    The new law is not much different than the old law from 2015, all it adds is requirement for safe batteries and places more liability on companies selling non-compliant bikes, or people modifying bikes so they violate the law, plus a walk mode is acknowledged. The actual definition of e-bike classifications is identical to the 2015 law aside from a walk mode allowance. Because the language is a little inconsistent in different provisions in the new law, some companies are reading it as a Class 3 e-bike can have a low-speed throttle similar to what is found on Class 2 e-bikes as long as it cuts out at 20 mph. The last 8 mph is pedal assist only in Class 3.
    In general, high speed drains the battery fast, so speed and battery life mutually exclude one another. I'd rather save my battery for the hills, not to go 28 mph. And for me the only purpose of a throttle is to start from a complete stop so there's no hesitation in the middle of a traffic intersection. So for me, an even lower speed throttle is fine, no more than 10 or 15 mph.
    Aside from the wonderful high battery capacity of most Class 3 e-bikes, I do not like the design of most of them as they seem to all want to look like mini-motorcycles or heavy-duty sand and dirt trail bikes. I personally just want (1) high battery capacity, (2) high motor wattage for hills, (3) a LIGHT weight frame for touring with wheel widths smaller than 2 inches. No front or rear shocks, but a good cantilever seat post suspension with a wide touring seat.

    My opinion is that enforcement starts Jan 1, 2026. So approximately a year from now. So I think they can sell it still without penalties. The classes seem to already have changed but the enforcement is a year away. Approx $1,000 fine for each offense.

    I was under the impression vendors and sellers had to be in compliance by jan of 2026 but i might have read it wrong. All they will have to do is change the wording from e-bike to e-moped or e-motorcycle and start selling them with vin numbers so they can be registered as mopeds or motorcycles and even then I really don't think California is going to enforce this right away outside of stopping people riding on bike paths etc. The good thing is most class 3 ebikes can just have the throttle unplugged and it will still work with pedal assist so there's an easy fix for many vendors. I would just sell them online outside of california still listed as ebikes to get around the funky new rules.

    I have been so entertained by all the hoopla over this. Garden City Utah was where I saw the first unfolding live I worked a season and rode my class 2 recumbent everywhere. Surrons and talaria and similar flooded in halfway through the season, by the end of the season garden City Utah had applied a bunch of knee jerk legislation and laws to bring needed community safety to the situation. We're talking thousands of people on paths walking and riding, and all the overpowered not legal stuff was zipping around through people like fools at speeds that clearly demonstrated their blatant disregard for others in their pursuit of their quest for velocity. The ebike speed limit throughout garden City is now 15. And they enforce every time they get the chance. It's probably making decent money in the citations.

    I have 9 assistance levels with 11-34 rear and 56 tooth front. I can pedal up to my bikes full speed at about 37 mph. I imagine that I could cut the throttle and replace it with a full grip if I had to. Just a pain to always need to adjust levels and to turn my legs. 😂.

    I watched another video saying it didn't going into effect till Jan 2026. Also I can still buy bikes through Amazon and I live in California. From what I've read and heard so far, it mainly affects new manufacturing of ebikes after Jan 2026 and it does not affect current ebikes purchased before that date. But this is all just from what I've gathered, I might be completely wrong

I can't even buy better down pipes on my truck because they give me better performance California law makers are out of their mind! They are literally becoming the evil empire from star wars.     Obviously the CA legislature lacks e-bike owners because this law is really stupid.
    And, yes, I worry about smaller companies like Lectric and Velotric, as well as the larger companies Trek, Cannonale, Specialized, etc. who all offer class 3 bikes, some with throttle, some without, but many models that reach 28 MPH with or without throttle assistance. And, yes, I wonder about companies' and bike shops' current inventories of class 3 e-bikes, and class 3 e-bikes currently being manufactured, are on the way to US shores, etc. I think that there needs to be at least a grace period to implement the new legislation to avoid hurting companies/businesses, but still believe this is too broad of a piece of legislation.
    If they want to target a higher risk class of e-bikes, perhaps target those that exceed 28 MPH and merely target them for DMV registration for a license, not prohibit them. But, this would bar kids under 16 from owning and riding such e-bikes, unfortunately, and annual DMV renewal may be an added expense that some folks might have difficulty affording?

    A couple of thoughts about the CA nonsensical over regulation. Why not sell the class 3 e-bike without the throttle. There would be a market for after-market controllers and throttles. Also, some companies sell on-road and off-road bikes. Sell on-road bikes without the throttle and off-road bike with the throttle.

    Reason why i believe california lawed this. Is cause people have modified the throttle to be 28mph. Which as known Class 3 is PAS ONLY up to 28mph. IE cannot use throttle up to 28mph. Which is why they likely saw people trying to get away with by pretending to use PAS but under throttle. It's not really a big deal cause most companies don't really include throttles for Class 3. Those that do likely try limiting them to 20mph for whatever reason, But people find ways to override the default limitations and unlimit them.
    Again. It's cause morons just like the whole deal when E-scooters, E-skateboards/One wheels were going about. Ever fricken moronic prick started doing dumb crap and messing up stuff that states and places had to strict the laws down because of peoples dumb crap.
    As the saying goes. You give someone room to do something. They take it to the next mile. Which is what people do and done and still do. And the Honest people who try to obey such get Fricked.
    Anywho. This doesn't really change much. I'm sure the companies will just remove the option of having a throttle on Class 3's. Simple solve. Or they'll specifically remove it for Cali state users. But then again this wouldn't really change people from remodifying it with a throttle again. Unless they use a ESC that doesn't have the throttle cable to. Which would be wise choice to force people to switch to a different Speed controller. But finding such for something on a larger company bike might be tricky.
    Least Department stores won't be bothered. Since they don't really sell C3 bikes. Or even C2 for most cases. So they'll still be getting buys. And the Hyper E-Ride is still the golden Department store bike that's epic. Mine i have made into a monster since i bought it years ago.

    When questionin* laws in cali, the answer that makes the least sense and screws you hardest is the answer… the state banned certain flavors or cigarettes (menthol) yeah. Make sense of that. Try mail ordering ammo…. I hate my state.

      I am not a fan of ebikes, because they are powered by batteries. I ride home made gas powered bikes. But I don't have a problem with others riding ebikes, as long as they don't ride them faster than a pedal only bike might be reasonably expected to go. Beyond that, they no longer fit the description of bicycles.

    They should sell the ebikes with no motors on the wheels. Sell it as a normal bike with throttle and all, and with the battery. No marketing on top speeds or motor. Then sell the motors separately that it's just plug and play lol. Sell the motors based on wattage since the law doesnt state people cannot buy motors above 750 watts.

      a dual motor 750 watt ebike could also get around the rule since it doesn't have wording for the output of dual motors or motors exceeding 750 watts COMBINED output power. Youre getting the same speed with just more torque lol.

These lazy law authors are uninformed of the stats autos trucks buses are judged not by capability to go fast but by operation why are bikes segmented by capability. The law assumes random and situational inspection which is always a bad practice of enforcement! Also, It is the association problem where you are assumed to be the same as other pev riders. I respect others and though I can go 50mph I go 10 or less around pedestrians and stop for elderly or small kids to pass. I wave to every biker hold my hand up to receive a wave back. I’m no saint but I look like I’m respectful of others. 1 in 20 bikers sneer at me they are the ones that assume I am an enemy just by virtue of being on a PEV

      Doesn’t matter, you have a throttle and that motor is able to top out over 750 watts.

      Doesn’t matter because according to the law you are able to alter motor in the settings to go over 28mph. I don’t like this law and the people that made it a law probably never even rode an e bike. Those law makers are hypocrites because they are pushing go green use less gasoline but than they make this law.

    They sale a class 2 sticker , get one an put on your bike an don't get caught speeding, also don't see why they could not take the throttle off an sale them with cruise control, then u don't need the trottle.

    I don't ride ebikes, or battery powered anything. I'm an internal combustion guy. A carbureted internal combustion guy. I am in AZ. I have built a number of gas powered bikes, both 2 stroke and 4 stroke. In AZ, maximum speed for a motorized bicycle, whether gas powered or battery powered is 20 mph. I usually ride considerably slower than that. When riding in town, and using bike lanes, I don't exceed the speed of pedal only bikes. Sadly, I'm one of the few that do that. Just about everybody with a motorized bike, gas or battery, does everything they can to make them as fast as possible, with many of them going 30 and 40 mph. And they ride in a very reckless manner. IMO, anything that goes over 20 mph is no longer a bicycle, it is a motorcycle, and should require a motorcycle license, insurance, registration, and a license plate. Unfortunately, all these speed crazed idiots are ruining it for those of us who ride responsibly and legally. It probably won't be much longer before motorized bicycles (and they are supposed to still be bicycles) are banned outright, just like they did with those gopeds (motorized skateboards) 20 years ago. Give someone an inch, and they will take a mile. I ride motorized bicycles not only for fun, but because I am 65 and disabled, and can no longer pedal any distance. I have NO problem with the CA law banning throttles on bikes that can go over 20 mph. At those speeds they no longer fit the definition of a bicycle. But while they are not bicycles, they are not fast enough to be ridden in actual traffic lanes with cars, so they are not really motorcycles either. They should be legal for off road use only.

      💯 I agree. What is it with speed? We can’t have anything good without a few idiots ruining it for everyone. These e-bikes are looking more like motorcycles & dirt bikes now. Maybe people don’t have drivers licenses DUIs? You still should pedal SOMETIMES. You want a bike that you don’t need to put much effort into operating, looks like a dirt bike or motorcycle so pay for it like those bikes. 28mph is too fast to share a bike path with pedestrians kids n pets.

      @@Msspinnerb8 First of all, I CANNOT pedal, which is why I ride motorized bikes. And in AZ, if you lost your license because of a DUI, you are prohibited from riding/driving ANY motorized vehicles whatsoever, including the cheapest Walmart ebike. You either walk, pedal, take a bus, or get a ride with someone else.

    Yes they will still sell them as class 2 and you have to unlock it. If you get pulled ovwerr then go to your settings and switch it to PAS only to disengage the throttle.

      They will have it locked into class 2.i talk to goat power and that is what they say. I looked on their website and they do say it is sold at 20 mph. They also include the unlock code lol.
