Haven't finished watching yet, but even 5 minutes into the defense's opening, they are CRUSHING the prosecution in terms of effectiveness. This is going to be a wild one.
Apologies for the length, but I had to rewrite the prosecution’s opening statement… Ladies and gentlemen of the jury, the Commonwealth intends to prove to you without a shadow of a doubt that Karen Read intentionally caused the death of John O’Keefe by striking him with her vehicle in the late night or early morning hours of January 28th or 29th, 2022 and leaving him to die in the snow. The motive for her actions is what could best be described as a scorned lover exacting revenge, as she had recently caught him in the act of cheating on her mere hours/ days (unsure of timeline?) before his death with another woman they were both very close to. This was akin to ultimate betrayal in her eyes which ignited vengeance in her mind. You will hear testimony from multiple witnesses, including family and friends of both the defendant and the victim, as well as read text messages between the defendant and victim, that clearly illustrate the extreme level of anger the Ms. Read was exhibiting towards Mr. O’Keefe. You will also hear from witness that undeniably and wholeheartedly refute the defense’s primary argument for innocence by testifying that Mr. O’Keefe NEVER entered the home that evening once he and the defendant arrived back home after a long night of barhopping and excessive drinking. In addition, evidence in this case will also show that DNA from hair found on Ms. Read’s vehicle as well as fabric particles embedded within the tail light were tested and conclusively matched that the victim. Based on the facts you will be presented throughout this trial, I’m confident you will be able to definitively conclude there is sufficient evidence to prove that Karen Reed is responsible for the intentional death of John O’Keefe as well as the other three crimes of which she is being accused. We implore you to hold her fully accountable for her unforgivable actions by reaching a unanimous verdict of guilty. Thank you.

I had to Google to be sure but I came back here after someone in the second half of today’s trial mentioned something about her reactions. The woman we can see in the gallery sitting directly to the side of defense table does appear to be John’s mother. The camera panned away for the part that the person mentioned, but I noticed her reaction watching it back to the info about the investigator looking for inappropriate pictures of Karen on her phone and John’s mother looks disgusted. I don’t know how she feels about Karen or this trial, but it guts me to think that she lost her second of three children in such a terrible way and that this is what was on the lead investigator’s mind. Not finding out what really happened John, finding inappropriate pictures of John’s girlfriend. This family deserves better than that. Absolutely appalling behavior from that man.
@@Classic-Ov3rThinkerthat was the moment I saw someone mention, but I couldn’t find it. The camera panned away the first time he said it. Do you have a timestamp by chance?
Replay crew here! The defense had an incredible opening statement (I have a degree in English-the prosecution hurt). But man, what really struck me was Paul’s testimony. I’m the oldest daughter, with two younger brothers, and our age differences are very similar. When I saw him, I saw my baby brother, trying to testify after losing both of his siblings…I hope this family finds justice and peace and healing. I send them love and strength in their grief. I think I’ll spend the rest of my life thinking of them and hoping they’re doing well. Especially those poor kids who have lost too many important figures in their lives. I hope this trial brings justice.
Replay crew. I went in knowing absolutely zero about this case and now I’m INVESTED. The defense opening - wow, this guy is GOOD. Doubt abounds in my mind.
Totally off topic: my foster Paw Nerd had her litter Saturday morning… 4 beautiful (not-so) little kittens after going almost a week overdue! I assisted, because of course the first one was breech and stuck, but in the end they’re all healthy and strong and purrrrfect! 🐈
I've seen stiff about this case but have not been convinced either way so im dying to see evidence. Also, the defense attorney is AMAZING. His opening statement is great. Can't wait to see him cross examine.
Officer O'keefe's mom mouthing along with the attorney when he repeats 'Nope' breaks my heart. She absolutely knows that the PD did the absolute worst to find out what happened.
"What if anything..." 🤨 Hi Elaine. This case is tragic and if it is true that this crime wasn't investigated correctly that is an injustice to the O'Keefe's family.
I think there was a purpose to the prosecution’s disjointed & disorganized opening. It wasn’t just that Lally’s not a good prosecutor. The timeline in this case is not the prosecution’s friend. The closer you look the more their case falls apart. Normally, it would be the defense you’d expect to hear throwing up a word salad, hoping to muddy the waters enough for the jury to find reasonable doubt. Here, the prosecution is using a defense tactic to hide the weakness of their case.
I’m watching the replay and haven’t finished… but I feel like he’s (Lally) giving a detailed overview to everything they will hear during this trial… instead of telling the jury who John O’keefe was, that on that night in January of 2022 his life was cut short… this is what we believed caused that, you will hear from numerous people to these reasons/facts as to why we believe the defendant is at fault for this.
I am excited to watch this here....no opinions formed in fact know nothing...just decided time for another trial and this one seems to have lots of interest. Thanks for covering it.
Runkle caught something I think EDB missed because she was looking at her notes: defense opening said the German shepherd was re-homed, but he also put quotes around "re-homed".
Take a quick look at any shelters and rescues near you and you will see how hard it is to re-home an aggressive dog that doesn't like strangers. We are told the dog has issues with strangers but then also that the dog's loving family of 7 years sends it off to go live with strangers? Something stinks . . . I am interested to know where the dog ended up and if they have no idea where it went then I have even more trouble with the story. Either way the defense did a great job of insinuating the dog dissappeared to make sure no comparisons to the wounds on the victim's arm could be made.
My sister’s best friend growing up was murdered, and the dad went on trial but was acquitted. All we knew at the time from the news made it seem like he got off, but reading back now it seems there was indeed a lot of doubt, and it was as likely a murder/suicide of the mom’s making. Being able to see the proceedings in real time is very helpful.
That is the worse thing about this cases being brought. If it is not guilty people just assume they got off…because I don’t think people realize how rare acquittal is.
@@sallycinnamon5370yes, and not guilty doesn’t mean innocent. It just means the prosecution didn’t prove guilt to the jury beyond a reasonable doubt. So a not guilty is much more ambiguous than what people realize.
I started the trial on day 2 so had to come back for this. And wow !! What an opening by the defense. It was all great but what I loved the most I think is the “wait for us”. That would stick for me. Especially now after seeing everything so far. I think I would come back to “wait for us”. So good
These opening statements and the difference in how interesting and captivating one was versus the other is a great example of the huge difference that it makes for a lawyer to have charisma.
It’s interesting to watch these statements again after the commonwealth has rested their case. Lally was not able to prove anything he laid out in his opening through his witnesses. Most damaging is that he stated that Karen read was at 34 Fairview until 12:45 am, and their own expert had Karen connected to John’s Wi-Fi at 12:36 am. This whole case has been coordinated from her hitting John at 12:45 am and that has been proven false. The defense has been able to prove almost everything in their opening using the commonwealth’s witnesses. Not that they need to prove anything at all.
My current *speculative* theory: John went in to the house and everyone was drunk. The dog attacked John and in a drunken panic he punched at the dog to get it off and maybe even kicked it. In a drunken rage, the dog owner and his pals beat the tar out of John and kicked him out of the house where he slumped in the front yard and lost consciousness. The one lady made a google search about hypothermia because she saw he was still there out of a window, but was told she was not allowed to intervene and help and that John would eventually shake it off and call Karen for a ride. They all passed out and then got frozen into a pact of silence when they realized John, in fact, died on the front yard. And that’s why the dog had to be relocated out of state. So it would not be possible to match any teeth to his arm injury patterns. *I don’t believe this with enough certainty to support the charging or conviction of any Alberts or McCabes-nor do I support or endorse any bullying or harassment of that family unit. Regardless of what actually went down on that evening, if the prosecution can’t prove that Karen did it beyond a reasonable doubt, then she should be acquitted.*
I'm a day late and didn't know much about this case before it started but wow! I'm glad to be watch another trial with EDB. That defense attorney had a fantastic opening.
During the Commonwealth:s opening. He says "They see the vehicle out front, they see the Vehicle pull away" Did you just admit your witnesses did not see Karen reverse at 27 mph! And hit something. So people in the party were aware the John pulled up in a car with a passenger. How would they know he's in the vehicle? How would they know it's Karen Read dropping him off?
And why didn't they follow up? Like texting is everything ok since they were literally there and then leave. That would be so random to me that I'd make sure there wasn't an emergency or something if I expected them to come inside or maybe show up later.
Yeah, I'm totally flabbergasted.....I, too, decided to come into this with 0 info, didn't watch anything, had no idea what this was about. I'm floored by the defense opening.

So I’ve been following this case since Day 4, and I’m only now going back to watch these first few days. The Prosecutions opening has been some painful foreshadowing for the kind of representation that Lally will be presenting throughout this trial. It doesn’t get better, and one of the fundamental flaws with their opening that almost feels intentional at this point is not putting all the events into chronological order. He mixes everything up, goes back and forth mentioning details and names that he didn’t provide any foundation for the jury to mount memory or relevance for. Oof, let’s keep it going though!
I'm going for it ! I'm watching this case from the beginning! I wish we had live court TV here in the UK 🇬🇧 I so wish I had discovered Emily back when I was watching Murdaugh and Heard VS Depp. Very sad though that Jury members feel unsafe now.
I literally just zoom zoomed through the final 4 days of Alex Murdaugh with EDB at 1.75x 😅 My reckless decision to embark on that trial about 11 days ago, with a view to finishing by today paid off. Just!
Hahaha I raced through so many hours of that trial at 1.75 speed. I would work and follow a reporter on twitter during the day and watch in 1.75 speed at night. And that southern accent was STILL slow as hell
1:31:17 Holy shit!!!! This is fucking insane!!!! Defense opening is fucking slaying. The major differences between Prosecution and Defenses openings, is it is CLEAR Yanneti comprehends the points he is conveying to the jury, while it is clear that Lally is just reading what seems to be bullet points from a script that he doesn’t properly understand or even possibly believe for all we know. I love that I’m on Day 11/12 of this trial now watching this. It makes this opening land so much harder.
Whether or not she’s guilty it sure seems like the police department left a ton of room for reasonable doubt.

This comment 💯. Thank you
Did u see the mum when Defence says ‘nope’ - 2hr 47mins!! She knew!
@@Classic-Ov3rThinkerthat was the moment I saw someone mention, but I couldn’t find it. The camera panned away the first time he said it. Do you have a timestamp by chance?
Revisiting this coverage now that all of the evidence has been presented. What a journey we have experienced.
Defense nailed this opening! Story makes sense, I know what to expect and if they show me half what they mentioned it will be enough…
The children have had so much loss in their young lives. Hard to feel secure when every parental figure passes.
2:00:46 Mom (in green) saying "Nope," with the defense....
Wow, I didn't notice this! Thx!
@@Alison1973oh, wow :(
Officer O'keefe's mom mouthing along with the attorney when he repeats 'Nope' breaks my heart. She absolutely knows that the PD did the absolute worst to find out what happened.
The opening statements rocked me. I knew little of this trial, I can’t believe all those people and no one saw him as they exited the front door?!?!
"What if anything..." 🤨 Hi Elaine.
This case is tragic and if it is true that this crime wasn't investigated correctly that is an injustice to the O'Keefe's family.
This is the first trial since Barisone that I have zero preconceived opinion. Looking forward to the evidence being presented.
Me too. I’ve had 0 interest and focused on Daybell so I’m excited to see it fresh with no knowledge with EDB!❤😊
Me as well
Same here.
Oooh, Barisone was fascinating
I wish I could start all over, this has been made terribly difficult by Lally playing games.
Emily’s deep seated loathing of the fan will never not be funny. I needed that laugh after brother’s testimony. Because the emotions were real
I live in Mass, and if I'm ever accused of murder I am hiring this defense attorney!
I agree with the second half
But I don't think Lally butchered his opening statement on purpose. He tried his best but he doesn't have a case
Yes I also found to do hard to follow
I’m watching the replay and haven’t finished… but I feel like he’s (Lally) giving a detailed overview to everything they will hear during this trial… instead of telling the jury who John O’keefe was, that on that night in January of 2022 his life was cut short… this is what we believed caused that, you will hear from numerous people to these reasons/facts as to why we believe the defendant is at fault for this.
I knew nothing about this case before today and I am 1. Shocked 2. Invested .
I am excited to watch this here....no opinions formed in fact know nothing...just decided time for another trial and this one seems to have lots of interest. Thanks for covering it.
Know a lot but after listening to the rules of this chat/channel, excited to reset and read the comments and listen to Emily x
I feel for the victims family. This case needs to be investigated thoroughly, too many questions left unanswered.
I have never been more confused during a prosecution opening statement
Runkle caught something I think EDB missed because she was looking at her notes: defense opening said the German shepherd was re-homed, but he also put quotes around "re-homed".
I saw that. I think it's open to interpretation. I read it as that the dog didn't really need a new home, they are hiding the dog etc.
@@TheEmilyDBakerDog's location is an unknown. Personally I think doggie heaven😮
So good
I truly believe if she didn’t call Jen McCabe that morning things would have been very different.
These opening statements and the difference in how interesting and captivating one was versus the other is a great example of the huge difference that it makes for a lawyer to have charisma.
I think Jen planted that idea in Karen’s head.
She doesn't even look mad, she just has sad eyes now. 2 years of this and she lost everything she earned and loved.
My dad is currently battling this cancer, it’s awful. I can’t imagine having young children and dealing with this disease.
💜💜💜
Love the sound clip of Judge Newman!
Bring the jury!!!😊
Regardless of what actually went down on that evening, if the prosecution can’t prove that Karen did it beyond a reasonable doubt, then she should be acquitted.*
i was thinking something similar
Speculation get a job writing for CSI.
@@MyMomo17it’s almost like theory is speculation.

@@--Dasha exactly. Especially since they were there on invitation. You invite someone and they don't come in. This whole thing stinks
If this woman is found guilty we all need to pack up
Seriously. We’re all in danger f she’s found guilty. No one is safe
Yeah, I'm totally flabbergasted.....I, too, decided to come into this with 0 info, didn't watch anything, had no idea what this was about. I'm floored by the defense opening.
NOTHING beats being in court with EDB. Nothing!!!!
At 2:00:46 John’s mother behind him im view mouths the word “NOPE” at the exact time the Defense attorney states it. WOW.
It's been a long while since I've sat through a FULL video of yours @EmilyDBaker but it's soooo refreshing to see lawyers present their cases in a great, awesome & professional way! (All at once of course). And glad that you are pointing out the good lawyering going on like asking questions to the officer while simultaneously drawing the jury's attention to the evidence/issues they want to focus on. Thanks Emliy! 😎
Thank you for your compassion and respect when covering cases. Mr. O'Keffe's testimony was heartbreaking.
These beginning jury instructions are the kind of instructions I think should be given in every case imo very thorough.
Defense got me on the edge of my seat. Giving an overview and points of question/ interest is everything. I really hope they have all of their receipts in order. This is gonna be a good one.
8 weeks in and returning to listen again to opening statements, my oh my, this trial has turned out to be exactly as awful as Lallys opening statement.
That’s exactly what I’m doing while the jury is deliberating 😀
Heartbreaking to think of those kids, and how tragic is it that 3 siblings have died young.
Two of the O’Keefe kids died…John and his older sister. Her husband died months after she did. So sad.
@@MamaBear0417 thanks for correcting - I thought it was John’s brother and sister as stated in various videos but realise it was brother in law. Unbelievably sad.
Wait, so Karen is upset, begging to know if he’s alive, staff can’t tell her bc she’s not NOK, brother mother father show up, hear her begging for info, tell her NOTHING?! Blow her a KISS but freeze her out, don’t check on her, nothing? Wow. 😢
Yeah, it's all really weird. Like, do they think she did it or not?
This is going to be a rollercoaster. Strap in, law nerds!
I work nextdoor to the Courthouse and I'm sitting in trial traffic while catching up on Emily's coverage. It's so meta 😂😂😂
2:23:29 Ok deep breaths every one. I have to pause this and take a beat. It's heartbreaking and his great is so palpable I just can't hold in the tears. I hope this family gets answers
Good lord, the prosecutor sounded like my 10 year old niece telling a story about her day at school.
Like where is this shit going?
Seriously!! Brian told the other Brian they saw Jen's cousin talking to Paul about what Kevin texted to his brother in law Steve about what the other Paul said...😭😭😭😭😭😭
😂
So glad your channel allows me to watch this as a prospective juror without the white noise. Thanks Emily ❤ glad to see you back in court.
Rewatch crew!!! Watching/listening during work. So happy that you are doing this case. I am from MA and I don't hear any accents at all...........LOL!!!
Emily, I want to say how much I appreciate your emotion during Paul O'Keefe's testimony. Working as a lawyer for so many years, I'm sure you have seen and heard horrible things. These types of jobs can leave people cold and hardened. I love seeing your natural empathy come through, even as you remain unbiased and professional.
Ok.. I’m dying laughing. I’ve never watched a full trial with you. I’m a newbie. You make it so informative and entertaining… I’m HOOKED!!
Especially since you gasped and said
Oh fucking Hell! 😂
Welcome! It’s gonna be a fun, wild ride.
You will love it here❤! EDB is smart, hilarious and has purple hair.
I love the process of just being juror. I found you from Depp and I love your style and approach. Thank you for covering this.
Glad I’m coming into this case with very little knowledge. We are moving in a month and I can’t wait to binge this like a juror while I pack everyday.
I caught a short clip, several weeks into the trial. of an officer on the stand Playing word games of why throwing his phone away before the trial was just a normal thing. At that moment I knew he was corrupt and HAD to start this trial from day one.
So glad you’re covering this trial. I wouldn’t want to watch anyone else do it. Eagerly awaiting to hear both sides on this. It’s such a mess
I just started watching this case and my goodness I feel so bad for those children 😢. Mom passes from cancer, Dad dies two months away from a heat attack (or broken heart) then Uncle who was raising them dies under questionable circumstances. Just so very sad
On behalf of the Commonwealth of Massachusetts, I apologize for our accents and for that ceiling fan. 🤷🏻♀️😆😆
great opening by defense. I have lots of questions and i am here for it
Yesssss! Love that EDB is doing a MA case. Coming in from Boston (well a suburb 7 miles north of town) and usually part of the replay crew but I’m catching a bit live finally!
“He had been into that pizza shop to get his nephew a slice”
HELLO?? SIR?
I went into this as a juror. I literally went back before starting this & watched your video of the indictments bc I knew nothing. As of the sidebar, I remember absolutely nothing the prosecution/Commonwealth said, but I was awake and remember MANY things Yanetti pointed out. Wow. I HAVE QUESTIONS. Sooooo many questions.
I'm immediately full of reasonable doubt. Score one for the defense
I'm so sorry to all parties involved. Just awful. I have lost just one son and living is hard. I cannot begin to imagine what your family are going through 🙏🏻 😓
So very sorry you lost your son.
Catching up at 1.5... This defense opening is 🔥
Rewatch crew here. So far my absolute favorite moment of this stream is during the Defense Opening Statement, Emily leaning over, out of screen, with only her arm showing, saying “That’s weird. That’s weird.” So Emily. 💕💕💕
😮OMG …. WOW ! Replay crew cause I fell asleep listening to prosecution opening! I knew the defence would be firey but Wow Wow Wow !
I described the commonwealth opening statement as disjointed and sleep inducing.
I started watching the trial live with you after opening statements and had to come back to this to see what the prosecution’s theory even is 😩
Re-play crew OMG. This should never have come to trial until FBI finished their investigation
I think the FBI let it go to trial so they can see how much they lie on the stand. They already said at the last hearing that Higgins was given a proffer from the FBI. You are not given a proffer (basically a deal) if nothing happened!
I'm watching on replay crew and after 5 minutes of the prosecution opening I skipped to the afternoon stream. Only to come back and watch from the defence opening due to everyones comments. Thankyou everyone!
Listening to this is helping me focus on my Legal Research homework.
The Defense killed that opening statement!
Just!
What was your conclusion on that trial?
You did it!! I knew you could!
@@Ashley__Rose you mean the outcome? The end result, ie Alex’s conviction? Or the wild wild ride to get there?
Hahaha I raced through so many hours of that trial at 1.75 speed. I would work and follow a reporter on twitter during the day and watch in 1.75 speed at night. And that southern accent was STILL slow as hell
@@LawNerdAmber I haven’t watched any of the verdict watch or verdict or sentencing, but yes! I did it!!! 😎
Holy crap! 😱. Can’t wait for this one to unfold.
“Wait for us” was brilliant
Holy cow. What a ride. I knew nothing about this case until watching the replay and it is WILD
Totally agree! You read my mind lol
Defense was amazing, clearly stated and all covered!
