  • The city officials are confused and have no evidence to support the claim that a 90-year-old man is running My dumpster business from his house.
    They have issued a ticket to the old man, but he is unaware of the situation and has no idea why he received the ticket.
    The city officials are trying to push the situation with no concrete municipal code to enforce, but plan to take him to court.
    They have no concrete proof that the old man is involved in any illegal activity and were a little too hasty to issue him a citation.
    It's been a day! Dealing with the good old fashion government, they always want to make it interesting. Heaven forbid the pick up the phone and handle something civilly.

    Every time you drop a dumpster there make a bill out for 1 dollar to your granpa and set it up like you are renting him all the bins lol. And when the city comes you can say yes i am renting him those bins.

    The only time code enforcement does anything is if there is a neighbor complaint; or worse someone that works for the city (manager, mayor, or even one of your competitors).

      Exactly what I was going to write. I know this first hand. We are on 10 acres and prior to having a permanent structure a neighbor whos over 1400 fr away called the code enforcement on us for having a camper on the property. Come to find our he works for the county. People can’t help themselves. Good luck, if your county folks are like mine you’re in for a ride.

      I believe 1 of your competitors complained and they know a city inspector. The violation with the wrong address, should be thrown out because of the wrong address info on the citation. Sounds like the city inspector did a lazy job investigating this complaint. Because if they knew we're coming by the property several days a week or more, then could have knocked on the door and left a message for you to contact them to get correct info or investigate properly.

I got that menace to society pot-smoker off the streets." or "I got that criminal dumpster storage guy off the streets." Neither action actually helped society..

    Local government, in my experience, is a combination of corruption and incompetence. The victims are always people who don't have a lot of money to fight, and it's sad to see. You never see the rich having to deal with this, there's a reason for that. I do wish more people would stand up and put them in their place - they are supposed to serve the people, not victimize them. I hope this plays out well for you and your family.

    Explain to code enforcement that if they're going to not drop it, that you're going to pay a high school kid to drive street by street and any house that has a business name on the side of a truck or equipment at their home and take a picture. You're then going to file a complaint about every single one.

      He's free to do so. None of them are doing commercial activity on site. This guy is staging commercial equipment out of a residence to avoid paying rent in a commercial zone. You can even get dumpster permits in most towns and just store them on the street. This guy is to cheap to do that and just wants to brag how much money he's making not following the law.
      He's a spoiled whining brat that doesn't even bother to learn the requirements for running a business and instead makes up lies after he got caught.

    I experienced something similar to your situation. I took two days off, drove around the entire area covered buy the same municipality. I proceeded to take pictures of all the same situations within those boundaries. 642 to be exact. All similar offenses. Filled the proper papers to force them to investigate all 642 complaints. They either went to work for the next year or dropped the charges. Needless to say they didn't want to work that hard. All begrudgingly was forgiven

    Just a tip, you can get a lawyer to appear on someone's behalf. This way your grandpa won't have to be there. You as the business owner and operator could hire him to defend on both people's behalf. I don't know the local laws they might prevent this, but if you explain he is elderly and a non English speaker that the court would have to hire a translator for they should except it.

      Stupid regulations should be fought or ignored at every opportunity. The attitude that everyone else has more rights to your property than you do has got to be stopped. My family has been on the same farm for 126 years and has got along just fine. Now there are hoards of people moving out to the country to get away from it all and as soon as they get here, they want tell me how to run my farm and what my buildings should look like. I’m not going to be able to put up with much more of this crap without fighting back.

    You say that dumpsters are moved in and out frequently. The noise and traffic form moving the dumpsters is probably the reason a neighbor complained.

      Yup .He is trying to make it about something it is not and making lame comparisons,The enforcement notices went to the known party.The property owner.the dumpsters are on his property after the first notice no contact to correct the ownership question was made so they proceeded against property owner.Really all moot,either way the dumpster depot is likely not legal and certainly not winning him any new customers un that area.

    I had the same problem. I have money so I had 4 rentals in the township so I only rented to sec 8 people and bought two more houses and did the same. There goes the neighborhood .They sent a note to a person that I was trying to buy her house that said don't sell to me and I sued them and they settled. Then I moved

    I hope you talked to the Judge's secretary and she was able to help you rectify this. I have known of things thrown out when someone could just talk 5 minutes to the judge.. You may rent a commercial lot so your dumpsters are all visible from the road. Put up a sign. "Dumpster view brought to you by "inspector gadget" and "alderman whatshisface"...

    This is why I always do everything out in the country because normally you're less likely to get bothered I got a friend that has a shop in town and he just works on his own vehicles and the neighbors are always calling the police on him just cuz his air compressor is running in in a building that he built with surround foam and everything to quiet down

    I would give them a headache by going around and taking pictures of each place that has a residential house with equipment that has been business name on the side of it when you know it's not there at that address and just send a bunch of photos and say here I guess you got a lot of work ahead of you and a bunch of red and a bunch of red tape to do!     If you want to get cheeky, see if your grandfather would sell you the house. If there is another fine, you do not have to take anybody to court with you; it is all in your name. In the purchase agreement, you could have him stipulate who will get the house upon his death. This way no one gets upset about any lost inheritance.
    I would also like to point out that, cities are underfunded. City inspectors have a lot of things to do, which means that they do not get a lot of time to do proper investigations. To be able to fight this out of court, you could go to the city planning office and see if they would grant the property a dual commercial and residential zoning and then you can fix the issue.
    Any way, I hope that these suggestions help that you keep making the wonderful content that you have been.

      @@rollingops You do not even need a duel zoning. Go and ask the city if they want you to take your business out of their area or would they offer a variance. If enough citizens called for service and you said that you cannot service them due to the city code enforcement being unreasonable, your customers would do the complaining for you. Or you could service them but tack on a surcharge for the extra distance you have to haul them now due to the city code enforcement. Tell the story and that you asked for a varience to keep pricing down but the government rejected your offer. An extra fifty or a hundred dollars would get the customers to fix this for you. And you would be compensated for the extra miles until sorted out. Depends on how much competition in your area though. Just be sure to list the extra charge as separate and due to city rules.

      Legal zone variance would require cooperation from nearby property owners. Build a fence enclosure and leave it vacant of dumpsters for a few months. Park a lawnmower in there.

    I worked Code Enforcement for 20 years. The city does not make any money off of that activity. It costs a lot more than it brings in. You may be personally offended with the process, but the bottom line is: you should have stored your dumpsters in a business or commercial area.
    There may have been an error in the letter, not a big problem. If your grandfather cannot handle his affairs, someone from the family should be stepping in and handling all of his affairs. You can not pick and choose what should be handled. Someone, who knows what is going on in the world, should be opening all of his mail and responding to the correspondence. Don't blame it on the letter sender. Your family has some responsibility in this matter. You handled it the right way. It may have pissed you off, but the problem was corrected. There is not just one way to resolve these matters. Sometimes it only requires a knock on the door. Maybe it will take one letter. Maybe it will take two letters. Maybe it will require a summons. Maybe it will require someone to appear in court. That is the way the system works. It may not be pretty, but it usually accomplishes the task to clean up the problem. I had a compliance rate of 100% in one city I worked for. The other city was only 90%. That means 100% of the neighbors were happy in the first city and only 90% were happy in the other.
    Many people do not want a government official knocking on their door. They find that intrusive. A letter is less intrusive and provides all the facts and the solution. If the Code Enforcement Officer went to your Grandfather's door and explained, in detail, the nature of the violation, and the solution, it is doubtful that he would have understood. He surely could not have explained all the information to a family member.
    You did the right thing. Keep it up. The "Process" does work...most of the time. Thanks for helping him out, and keeping the neighbors off his back.

      I really appreciate you taking the time to write this out. It's nice to see your perspective. Because I don't want to seem like a cry baby here, I like the constructive comments while I'm documenting my experiences.
      Like I said in the video, "I get it, it's just frustrating". The fact that one neighbor can have their property looking one way for 20 years and the city can't get it under control. But they go after another neighbor with some empty cans.
      But that doesn't give me the excuse to break a rule, I see that. Because it's a downhill slide for a community with a "well he does this, why can't I...". I do wish it was clearly written in the code because it is a very gray area.
      I also was just aggravated that it took 4 different approaches, but not one involved calling the number on the can, which would of been easiest. But like you said, it's a process. In the end, their process did work, even if it was messy.

      Revenue is revenue. It costs more to write traffic tickets but hundreds are written every day. The government employees get paid whether they write citations or not. The government doesn't care how much they spend, just what they bring in. The municipality wins when they fine and take your property

    Small towns are scared of dealing with people and do the best they can to avoid any direct contact. During the pandemic I mailed my tax check to the township but my handwriting is lousy and they said they couldn't read it very well so they modified the numeric amount to be $7.00 less than the tax bill. They then mailed me a bill for the $7. They didn't tell me WHY I owed $7, they simply billed me. I called and found out and then mailed them a second check for $7. I got nothing back from them and just assumed they got the $7 and applied it. However they never got it. Did they call me? Mail me? Email me? Nope. Instead they sent my bill to the county seat for foreclosure. Could I go to the county and pay? Nope, pandemic, no personal contact. BUT I could go to the post office and talk to Postmaster Bob and mail it registered letter with a return receipt, for $8.14 by the time they added penalties and interest. All because they were too scared to simply call me or even write me a letter about the $7.

    This story kind of reminds of a state grew up in and I left over 20 years ago before it got really bad. California. About 30 years ago they would tow a vehicle that could be seen from the street with expired registration. Then it turned to backyard. Then it turned to no working on vehicles in your yard or no inoperable vehicles. Obviously this turned into many bs code violations for about anything and everything after I moved. When I lived in Nevada I got a citation for having my box trailer on the street this was a city of 12k btw. My two cents get the violation on you and fight it but don’t throw a bunch of money at it. Basically get your point across that they are wrong and start parking your truck and trailer in the driveway of grandpas at lunch. I had a neighbor like that all they had to do was come talk to me instead of complaining. I did everything legally I could to irritate them after the first complaint.

    New subscriber here and let me start by saying that I love your content. I think the city did what cities do.... they rush, send things through mail for documentation purposes and liability. It's great that the officer reached out when he sensed something wasn't right when he thought that your grandfather didn't understand what was going on. I would check with the code and see what the cities definition of "running a business" is. To me, there is a difference between a landscaper coming home at the end of the day and parking his truck and trailer for the night and having a truck and trailer swapping out cans throughout the day on a residential property. I'd personally knock on doors of the neighbors and see who it may have been who complained if at all. At the end of the day, it may be more of a headache than its worth attempting to keep things status quo. Regardless, I am hooked on the channel and hope you keep up the great videos and keep up the grind.

      I appreciate you man! Yea, at the end of the day this actually ended up being a good thing. Even though my shop is outside of the area and adds some mikes. With us being out there so often and our cans getting swapped in and out, it has drawn a lot of interest into my company, because my shops right off the highway. So at the end of the day, I guess things like this happen for a reasson! I may buy a very cheap piece of land in this town though, just to store some stuff, especially if I expand. But we will see!

    I had a similar problem storing my boat on my property years ago, city said the land under the wheels had to be improved, so I got bricks and stones, set them level with my yard, continued to mow/weedeat all around it, but city still complained, forced me to move my boat into a storage, turns out my neighbor next door was turning me in, I decided to return the favor and turn them in for the green pool, mosquitos and algae and the city fined them multiple times and even came out one time and boarded over their pool. It happens, just move on, not worth your time fighting over this as you won't win.......

    My town did this to big trucks in the late 80s finding out that they were trying to get people who work out of there own property to buy there commercial condo garage units that there friends had built. The big truck guys said they same thing everyone with a commercial vehicle with lettering on it can't be parked at a residential property. Such as land scapers, plumber, elections and so on. Hope all works out for you.

    In our city, they do home outside inspections once every 3 years. They are not allowed to step on the property. I'm thinking they couldn't read the side of the dumpster. Three dumpsters also makes it appear that the business is being run out of that address. The assumed the homeowner is also the business owner. You say they are empty, which would lead someone to believe it is a business and weren't there for self use.

    It’s just like parking an RV or a large boat in your driveway for long periods of time. Neighbors usually don’t like it. Code Enforcement says if a neighbor complains you must park them in your backyard out of site. This can include yard maintenance trailers.

    When laws or codes are not evenly applied to everyone is when there is a problem. If it applies to you, it should apply to them. I'm not sure why a doctor's note wouldn't have sufficed why grandpa wasn't able to come to court.

    Nothing makes my blood boil more than zoning barking up trees and picking a choosing which trees. I agree they could of handled it better, I also agree with them on how its zoned and how it's being used but on that note I agree with you that the need to go after the lawn care guys too. I fight with zoning in the country at my parents place and in town where I live, both have me on their radar which is not a good place to be.

    Have a simple question...is there another dumpster company in the area? If so, does the owner of that company have an "in" with someone in the city/town government. Could be a relative, friend, etc. and if so...that could be the "issue" that you need to look into.

    They're not going to call, ever. It's like the IRS calling. It doesn't happen. Philly's L&I will come to our property, could easily tell us right away in person but they send letters weeks later.
    And storing containers on the property is part of your business operations, the property owner is always going to be the person getting the violation letters. The city has policies they have to follow, even if you think they're not following. And many people aren't confrontational, they'll be nice to you and not complain about your dumpsters there, but then call and complain to the city scout them.

      Yep calling isn't legal process nor has it ever been. Claiming someone should have called shows this guy doesn't know jack.
      He complains that proper process was followed.
      Then he brags he's going to get violent in a city building because he got caught running a commercial staging yard out of a person at risks home who didn't understand what was happening.

    Received a notice from my town that my garage needed to be repaired or removed due to damage. Called them and asked what they were referring to as there was nothing wrong with my garage. They said an inspector had been there and considered it a hazard. I ask if he could come out and explain what was wrong. The garage they were referring to collapsed in heavy snow. It was not mine. Not even on my land. The inspector had the wrong address and never verified who owned it.

    The whole idea of county code enforcement is revenue, so why would you waste time trying to contact anyone before issuing fines? They often have administrative kangaroo courts where you are automatically guilty until proven innocent. I was wondering how long it would be before your local government started harassing you a new business owner. To survive in my area I did surround my home with trees and bushes to hide my activities. Remember, the government is never, ever liable for incompetence. They face no consequences so why would they ever want to do the right thing?
    Don't waste your time or money on an attorney. The county owns all the properties and they make the rules, you only lease it from them (property tax).

    There is a single form you can fill out to take care of these matters for your grandfather. Have him sign over power of attorney to you and a few other selected family members. That allows you to legally represent him in all such matters now and in the future. You can specify on the power of attorney conditions, times, or for specific limited situations; but since your grandfather is 90 and having some issues it’s probably best just to have an open ended one for at least one relative. Once you have that on hand you are officially their agent and you can represent them in all matters.
    The only downside is it has to be notarized, but a lot of local companies, banks, etc will do that for free. There are many people who will also come to the house and notarize things.

    I'd go to court as it may be the only way to find out what caused the incident. City personnel would have to testify under oath what the information was that they used to issue the citation. You could provide pictures of other homes nearby to bolster your claim that they were picking on you. Why were others not given citation?

      Most people who have dealt with the legal system know that the "everyone else is doing it" defense does not ever work. NEVER. It may be applicable to civil litigation over selective enforcement and should be pursued in that manner after the complaint is resolved.

    As stated, operating a business, banging metal containers, loud PTO trucks in a residential area was cited for operating a business which stored trash containers that revolved out of operation😂 they just need to watch this video as you state that you store containers there for continuous operation😮

But the problem is, instead of addressing the business, which could have easily been contacted and resolving the issue, they blamed the ancient man and did not contact the actual business ... OK, maybe he's wrong on the noise issue (although there seems to be plenty of land around the place). The issue is, that the business should have been contacted and when there is plenty of signage on the dumpsters that indicate the business, and then just not caring that the person they're actually blaming has nothing to do with the business except to let his son in law park a trio of bins on his land ... it could and should have been handled better. I mean, jailing an elder because he didn't understand enough to even contact his son in law and tell him there's a problem ... Not a good look for the city. Especially when ... info, right there, on the offending equipment ... also, wrong address, which technically invalidates the entire citation. But would not keep them from kicking the door down somewhere and arresting someone ... Chilling.

    We used to have a neighbor who was easily upset and knew that she could get away with lying to the government. The police department, fire department, and everybody thought that if the word got out that you can get arrested for calling them, that actual good samaritans would stop calling.

    Most municipalities allow for someone to run a home based business as long as that business is not receiving retail customers at that home.
    Check out those regulations if you’re still having to deal with this.

    So what you are experiencing in your life is when a city auditor and in small towns everyone knows everyone. So first and foremost, You are dealing with the good old boys, and the question you need to ask yourself, Who's tows did you step on or someone you may have offended or made jealous. The second part is you are on the right track, and you have done your due diligence with the dumpsters being labeled correctly with Number name of business, it also wouldn't hurt to have the address on there as well. This completely negates the city and county from saying he is operating a business out of there. obviously it will not have the same address. and the last thing sometimes you do have to take these things to court and thats ok just make sure you find an attorney that is from a different district, this way there is less if not any lawyer to prosecutor relationship.

    I understand the city mishandled, lazy, without professionalism and consistency issue your grandfather the complaint/citation/court date. That is one issue but they do it all to make money and bully. I for one can understand them citing if it is against the code/rules/law... I would not like in a neighborhood buisness/home such as that being used for storage, it is a eye sore. However, they need to apply the rules fairly, consistency and clearly. If it actually is a violation. Selective enforcement is wrong but I think it is all about power, money.

    I am just wondering, Since Grandpa is 90+ years old, Would he be willing to transfer the Title of Property/House to Granddaughter/Daughter/son to you. But, basically Still Have Full Control over everything. Nothing really Changes for him at all. Just On Paper only. Since, He doesn't really Speak English that Well and Unaware of Situations some of the times.
    Unless you do something like a Power of Attorney, Which would Give you or Granddaughter/Daughter/Grandson/son Legal Rights to take over any type of Legal type Contracts and Stuff. Including I think being a Replacement in Court instead of having to bring Him to the Court.

    The city we operate out of send one of these letters to me as well - then I see the bigger guy in my area has pulled all logos from his cans-so I hit him up at the dump, and he said he got 2 of these letters himself (it's a real city violation code here)- so I think I'm about to remove logos from my equipment.

      @oncalldumpsters The cheapest option is to hang a printed banner on the side while they are being used-assuming they won’t get taken. Another is to put your logo and number on magnets (but also could be taken). A third solution is to weld on a frame that allows you to slide a sign board in and out. The most permanent solution is attach a hinged sign that can be flipped as needed.

    Empty dump containers are a fungible commodity. Neighbors see a container when they look out. The fact that they are being turned over doesn’t lessen the damage to the neighborhood. How could you possibly think that industrial storage is permissible, either legally or socially, in a neighborhood of personal residences?

    I wouldn't want dumpsters being picked up and dropped off across the street from my house on a daily basis. Your use of the property is obviously illegal, and you have now been cited. Man up and store your dumpsters on a properly zoned lot.

    Man that is super frustrating when people can’t mind their own business! I live in a super small town about 1300 people. The kind of place where everyone knows each other, no one locks their doors at night yada yada you get the idea. If you years back the mayor decides to create a position of “city manager “. This is a position we had never had or needed before. Turns out, this person’s primary role was to bust people for anything they were building on around their property that required a permit. We had a wind storm followed by a lot of thick ice that ended up taking down a lot of peoples awnings, sheds and what have you. Suddenly everyone trying to rebuild these things (or just repair what was already there), got hit with a notice from the city for not having a permit to build! Thing was, a lot of these houses are spread out pretty far so no one knew who was ratting people out. The City manager’s daughter worked at the local hardware store!!!🤬😡. Small town drama man…. Once we figured it out, we were going to the hardware store and have long loud conversations about giant shops we were going to build, and how we were going to run the plumbing without the city knowing and yada yada yada just to supply her with false leads and waste her time 😂 Because fuck that guy! 😉

    Your confusing me here , are you admitting to using his home to store and rotate your cans? That's operating a business off the property your saying that your parking them for convenience of your business, the owner .. him, is allowing it and they told him to stop. His living situation may require more family check in and ask him about mail or notices he can't understand. I can't live in city limits because of things like that, I do feel that I understand the social contract so to speak works here. It seems like your building something great for the community, I just think you should consider removing your dumpsters for the sake of people who don't want to live next to trucks coming and going for dumpsters ... it is a level of commercial activity that does effect the idea of a quiet neighborhood. 10 other people may be doing the same but your number came up

      You're a 100% correct. That's exactly why we moved it all out. My biggest Concern was to make sure that he was not involved in the issue. I was more upset with how much easier it could have been handled and the current business operations that are clearly happening all around the neighborhood. Along with the lack of actual verbage in the code itself, but like you said, my number came up and I have to deal with it. I have other options that are more professional and that's the route we're going.

    Well it's dumpsters to haul c&d and refuse.... if your in the city limits... you can't be running a business especially from a residential house.
    Especially a trash business lol...
    They need to be stored in a commercial lot or industrial lot if your in city limits.
    I think a neighbor called that in to the city. Because they are in plain view from a public street.
    If they were stored behind a privacy fenced area.. nobody have noticed it.
    We have our dumpsters stored in the city limits too. Placed right next to the road for advertisement. But we rent a yard thats commercial and fenced in. City haven't messed with us yet.

      I don't disagree with what you're saying one bit. I'm more upset about the way it was handled, and the ongoing condition of several houses on the block....for over 20 years. But they chose this battle because they felt someone would likely comply. Especially with little to no effort or legitimate proof on their part.
      I think I said in the video that those dumpsters sit there no more than 48 hrs. In reality, it usually less than 24 hrs because their always onto the next customer in that town. Just frustrating because the municipal code doesn't directly reflect that this is actually against the rules here. And is very contradicting in a separate section of the code.
      But at the end of the day. Haha, I'm just butt hurt they got my grandfather involved instead of just me as the owner of the cans.

And leaves his dump truck filled with crushed concrete, a skid on a trailer, and his pickup in the street (all branded with logos) nearly every night. He's been doing it for years. Has the city approached him, maybe? It's just odd to me, that's all there is to it.

    Ooof...this does make me sad. I work with the elderly and disabled on a pretty frequent basis. The way all of our systems ignore the needs of our most vulnerable is the standard not the exception. If you don't have people who truly have the time to care for you, you're screwed in this country.

    The first thing I’d be looking for is what code violation was actually cited in the letter. The accusation must be accompanied by a reference to the actual code violation. If it’s not, then they don’t have standing.
