  • Welcome to Wonderhussy Adventure #601
    Date of adventure: 1/13/22
    Out in the middle of the Ash Meadows National Wildlife Refuge, a barren, lifeless Christian camp lies baking in the desert sun. What happened is a thorny tale of water rights: a previous landowner had diverted a natural stream to irrigate the property, but now the biologists at Ash Meadows have restored the spring to its original course...leaving the Patch of Heaven camp high and very dry. Who's in the right? Join me as I investigate this complicated story...and let me know in the comments what YOU think!

Walking to many public places or jobs to see how bad "other people's children" behave but can't locate a simple trash can shows why Christians need retreats. Idiots (bibles call fools before God) believing any world outside their homes is or was theirs to destroy and would shoot everything up, break things, paint tag unintelligent messages, etc. all in 5 years making any such historical places no future museum park or something for generations to visit. These idiot people will die from Earth (thank God for that) but never creatively pass to generations of people to any usefulness in their lives today. Every structure abandoned and given up has history and idiot people of "someone else's children" were allowed to destroy even more information about many historical sentimental values these people walked the Earth to destroy.

    I started working in Ash Meadows in 1995. Prior to that I worked for The Nature Conservancy. Prior to TNC I did several river restorations in Utah. Never worked for the ACOE.
    Ash Meadows is a very special place. It has more endemic species than anywhere in the US. Once the USFWS bought the land and water, their goal was to, to the degree possible, restore the place to its ecological function. The first project I worked on was Kings Spring.

    • @chadgourley2492

      The developers you talked about dug the spring heads into ponds that eventually filled with cattails. They put all of the flow into a concrete ditch. We reduced the springs pools to their original size and recreated the channel in its original form and location.
      The pupfish population exploded as well as other endemic species. The boardwalk has the story and photos.
      I didn't get paid, I did the design and construction oversight as a volunteer.
      We have worked in several western states, plus some large coastal restoration in Florida, very near where you made a video.
      Our main focus is river restoration, but I have an excellent landscape ecologist who worked for me. She studied on the eastern coast.
      I have greatly enjoyed your walking/storytelling videos. If you want more Information about nevada/utah/ California/Florida restoration sites, please contact me..

    I think the pupfish is my hero. Small guys do matter. The water should have been in the deed. From the sounds of how they got the water, the property never had any rights to begin with.

  • @georgem7965
    @georgem7965 2 роки тому +64

    Generally, in the western states, if you divert a natural stream you have to establish a legal water right to do so by filing an application with the state and having that approved through a water court. This system has been in place since the mid 19th century. This gives anyone who might be harmed by what you are doing the right to notice and to object. If you buy a property that has some sort of water use that doesn't have that legal water right you have no legal remedy if it is taken away. The lesson is, particularly in the desert, if you buy a property with water, including wells, you should make sure that you have a legal right to that water. This should be covered by title insurance since water rights are property rights. If the buyers of the church camp didn't get title insurance be it on their heads if they didn't make sure they had a legal right to the water. That is sometimes the cost of not doing your due diligence or doing something on the cheap/

    • @rareroots
      @rareroots 2 роки тому +10

      Title insurance will not cover water rights even if it is on the deed. Title insurance only guarantees there are no encumbrances like liens or another claim of ownership to the property. Doesn't guarantee lot size, easements recorded or not, water rights, etc.

    • @georgem7965
      @georgem7965 2 роки тому +9

      @@rareroots It all depends on what is requested of the title company. Often, title insurance will set out recorded easements since they are an encumbrance on the full fee title. When irrigated farms or ranches are sold the water rights can be included but not all title companies have the expertise to investigate water rights. It is a pretty specialized area.

    • @georgem7965
      @georgem7965 2 роки тому +3

      @@relectric69 If the owners had a legal water right the government would have had to pay them the fair market value of that property right for the "taking" for a "public purpose." This is what the language of the 5th Amendment to the US Constitution protects as well as similar provisions in state constitutions. The rub comes in determining the value of property "taken" which can be a physical taking (as in this case) or a regulatory taking. The owner may say a property right is worth a million dollars and the government says it's only worth $50k. That is why takings cases are usually a war of experts testifying about the value of the property. BTW, the compensation also has to cover any reduction in value of the remaining property caused by the taking.

    • @coloradolandandranch

      You’re mostly right about he water, but Title companies usually do not insure water. Water is often complicated to research & unless you hire a water attorney, or the very rare chance you get a Realtor who knows water law, it probably wouldn’t have been discovered during due diligence.

    • @georgem7965
      @georgem7965 10 місяців тому

      I did not know that title insurance only covers title to the land only. I suppose the owner would still have a remedy against their seller, if they are still around, for failing to disclose a substantial defect (no legal right to the water). Still, it is a lesson to any buyer to check out the status of the water. I reperesented an owner who wanted to put in a large horse operation only to discover that the well was permited for domestic use only. In your business do you research the water rights for property sold or bought?

    Victor and Annette Fuentes have officially started the process of reopening the Carson Slough following years of waiting for a federal agency to do as it was ordered.
    Finally, at their limit of patience, the husband-and-wife team, who own and operate the Patch of Heaven Christian Camp in Nye County, hosted a press conference of sorts on Saturday, July 30 to celebrate their decision to restore their water themselves.
    Patch of Heaven is a 40-acre parcel of private land located within the Ash Meadows National Wildlife Refuge, which is administered by the U.S. Fish and Wildlife Service. When Victor and Annette first purchased the property, it was a lush oasis in the desert, with plenty of water flowing in channels running through the site and filling ponds used for camp activities.
    That all changed in 2010 when Fish and Wildlife altered the Carson Slough, diverting the water around the Fuentes’ property and turning it into a dust bowl. In addition to the lack of water, the Fuentes’s then had to deal with unusual flooding occurrences that they said were a direct result of the alteration of the slough.
    With no alternative, the two took legal action that resulted in a years-long battle between the Fuentes’s and Fish and Wildlife. That conflict seemed to have come to an end in 2017 when the federal agency was ordered to return the water to which the Fuentes’s had a senior vested right. But Fish and Wildlife never took action to restore the water so Victor was preparing to take a tractor out and do it himself.
    Victor and Annette were joined by several dozen supporters on July 30 and the gathering at the Christian camp opened with an invocation.
    “We come before you with humbleness in our hearts to ask you for protection for today, to ask you to give us the ‘OK’ for today, Lord Jesus, and I thank you for each and every one of my brothers and sisters, members of the community, who have showed up here today in support of the right of Patch of Heaven,” Victor prayed.
    Those assembled for the event then stood up and faced the American flag for the recitation of the Pledge of Allegiance, after which both Nye County Sheriff Sharon Wehrly and Nye County Commissioner Debra Strickland were invited to speak.
    Wehrly read from documentation detailing the Fuentes’ right to nearly seven acre-feet of water from the Carson Slough, remarking, “So that’s his permit to have the water come through his property. And it seems that he has been doing everything that he possibly can to get that done.”
    Next, Wehrly read a document outlining the warning notice sent to the U.S. Fish and Wildlife Service, in which the Nevada state engineer had determined that the federal agency was violating the law through its action of diverting the flow of the Carson Slough. In that letter, Fish and Wildlife was ordered to cease the full and complete diversion of the surface water that should move through the Patch of Heaven property. That order came with the possible penalty of a fine of up to $10,000 per day per violation, as well as other consequences, none of which have materialized.
    Strickland stepped up to the microphone following Wehrly and she was evidently fired up about the reason everyone was assembled that morning.
    “We have rights, and the rights have been taken from this man,” Strickland declared, indicating Victor. “Whiskey is for drinking and water is for fighting. You know it, it’s been like that since the beginning of time. Nothing has changed here. We’re still fighting for the water!
    “When did the feds decide that all things belong to them? No way, Jose, ain’t going on no longer,” Strickland continued. “This is the time… And Victor, Annette, you are brave people and we are so proud of you for that. Thank you for the opportunity to be here today to watch you take back your right.”
    At that point, Victor requested that Wehrly call Fish and Wildlife to ask a representative of that office to come down to the camp and talk over the situation. “Let’s reconcile this, let’s talk. We want to see their response,” Victor announced.
    Fish and Wildlife, however, was not amenable to going to the camp but a representative did invite the Fuentes’, Strickland and Wehrly to their office. The discussion, however, apparently ended without the reconciliation that Victor was aiming for. Not deterred from his mission, he and Annette returned to their land and Victor headed out to the area that had been backfilled to divert the Carson Slough, to begin the task of reopening the waterway to its historic flow path.
    This is no simple matter, either. It will take time and patience for the couple to safely and successfully complete the operation but they fully intend to see the historic flow path of the Carson Slough reinstated in the coming days

      Your still telling your lies and destroying critical habitat!! We have videos and pictures of your illegal work and diversion that you preformed without permits from Army Corp, State Engineer and FEMA. Remember you and your friend Tim Mayer WHO by the way was disqualified by the State Engineer as being a Expert on Waters Rights as he is NOT!!! By the way the Carson Slough has always traverses the Patch Of Heaven Camp until the day you illegally and unlawfully diverted it. And yes we do have Water Rights on the Carson Slough and this right is VESTED and the only right on the Carson Slough and the ONLY SENIOR WATER RIGHT . You know that every document every map ever since 1881 shows the water running through the camp! BTW you have a copy of this map that is also displayed at LongStreet Springs. Don’t forget also that the State Engineer ordered you and the department of Fish & Wildlife to return a portion of the water back to Patch Of Heaven and until today it hasn’t been fulfilled bc the system you installed to deliver the water has NEVER worked just as everything you touch is a failure!!! So I would recommend you stop with false information!! Patch of Heaven was an Oasis when we bought it there were bird, geese, wildlife until your incompetence and illegal work!!So when you get ready to give your false information to this lady make sure we are there to show her the pictures of before and after your faulty work!!! BTW let’s NOT forget your faulty Culvert work that you built that was blown out from the flood waters!!Have a great day you lying Scumbag!!

Remember you used to work for Army Corp you should have know you needed that Permit???? Funny how you no longer work for them anymore and have managed to get 99% of the government jobs smells Pupfishy to me when you have no competition!!! I understand saving an ecosystem, and yet, if you bought property with water flowing through it, there should be something on paper regarding water rights. Water rights are defined quite clearly on deeds, (especially in the desert). I bought 1.45 acres of desert, years ago, and listed on my deed was that I had no water rights. I could have drilled a half mile down, found water, and it would be someone else's water ... because I had no right to it. Those persons who bought the Patch of Heaven, either had water rights or not. If they had no rights to the water on the land, the government was in their right to divert the water away. If the deed said, the owners had water rights, the government should not have been able to divert all the water away.

      Yes sir, they should have done more homework on it. Too many folks do not read the fine print and just "assume" that it is this way but are surprise when it changes. If they had a lawyer working on it, they might have a case against him for failing to catch this item, but that is rarely clear cut.

As global warming worsens, these cities will be impacted less, have adequate water supplies and are better designed. I been Las Vegas a year.
