He did pay the pair at the end. However ties aren't based on the initial hand but in the final results after the 3rd card is shown

Tie happens if they hit the same winning number (8 or 9), or after they’ve drawn the third card for each.
Tie can only happen on the first 2 cards if both Player and Banker have 6,7,8,9, otherwise tie can only happen with 3 cards if it’s lower then 6.
