    If currently getting TDIU with 70% Rating and then get a Secondary Rating, is that automatically SMC? Or must the 70% be recalculated?

    Hi,I have a question.Can a lpc"Licensed Professional Counselor" write a mental health opinion for my v.a. claim on a 21-4138 and be acceptable and helpful towards my claim?

    I got diagnosed with leg reckless syndrome when I was in the service during my sleep study but I never claim for it.

    Hi…I have a question about secondary conditions. I was medically retired in May of 2020 because an injury to my tibia while on duty. The doctors actually misdiagnosed my injury for 10 months telling me I sprained my knee, then a partially torn ACL but in month 10 I got a second opinion and it revealed that my tibia was fractured. I don’t know how they missed the fracture but every time I think about it I get mad and have bad thoughts. Well my question is, during that 10 months, Atrophy set in on my leg and now 2 years later, my leg still has Atrophy. Can I claim Atrophy as a secondary condition to my knee injury?

      Hi Cheryl,If your one year disability claim already expired you can and should make a new secondary claim . Think about this also ,any injury there is a possibility of you claiming a secondary , even when it is aggravated and worstened due to your in-service injury . Get a doctors nexus / opinion , x-ray exams , hospital records and a short compact direct to the facts buddy letter ( statement ( using a 21-4138 or a newer type of form ) . Always good for each claim to have your claim support statement .p.s. Hope you the best , you deserve it .

      Well you can file for insomnia if your injury doesn't let you sleep, or anxiety if it is causing you worry, or depression if it affects your job performance. Talk to a veteran organization and get some help in filing secondaries

      I'm trying to get Gerd as Secondary to depression with mood swing/ insomnia. I also have migraine with anxiety total disability is 90 %. Recently had a C & P exam doctor stated against me. How can I get a Doctor's opinion on my on and fight hr opinion.

    Based on this discussion I am confused by the VAs decision to deny my claim.
    I’ve had severe MDD for 15 years, taking max dosage of two different medications to help with the symptoms, and recently suffered a major heart attack. There is a lot of literature that links cardiovascular disease with depression, but they still denied it. Any reason why? Or any specific evidence I should submit in an appeal?

      First, you have to find out why they denied it. It should be in your denial letter. You may have to have it service connect via secondary to your already service connected condition

    Would it be best for me to claim depression as a secondary to my bipolar which Is already 70% or to my migraine which is already 50%?

      Mental health is mental health so if you have 70% for bipolar which is a mental health rating you won’t get anywhere

    If erectile disfunction keeps you isolated or unable to achieve higher relationships goals is that depression more harsh because being in and out of relationships can last months or years of isolation and coping

      Hi Kevin,erective disfunction if caused or to you being in-service would definely affect your mental state and in addition to that , everyone who has been in the service suffer from some type of mental condition(whether they choose to admit it or not. Another thing is that with any service connected condition their is a secondary claim you may be able to apply for and get what you deserve.p.s Hope you the best in getting what you deserve.

    I am at 90%
    40% fibromyalgia
    30% IBS
    30% adjustment disorder depression/anxiety
    20% lumbar strain with degenerative arthritis of the spine
    10% left lower extremity radiculopathy of the sciatic nerve
    10% right lower extremity radiculopathy of the sciatic nerve
    20% unspecified morning stiffness and pain, non-degenerative arthritis
    10% left wrist sprain with negative ulnar variance (minor)
    10% Tinnitus
    Does anyone have similar symptoms and was able to secondary connect headaches and OSA. I was denied early on for both. I recently was awarded the depression/anxiety instead of PTSD! Your thoughts?

      Hangar Nut, if you are trying to get to 100%, you will need at least 60% more to get to 100%. So you would need the full max of 50% for the sleep apnea and at least 10% for the headaches. It's a hard battle, but it is winnable.

      I file for insomnia, I am like always awake. I was awarded another 50 pct va math for insomnia and anxiety

      Migrains secondary to tinnitus. If you have migrains you should make a claim. 50% will help you get to 100%

      I'm on the same path. One can only win OSA secondary to mental. In your case, I'd work on 50% mental then secondary OSA and migraine. You might get a bunch of 0% and 30% but it's a beachhead to rack up 50%'s. I'm Gulf War era and got 50% presumptive migraine.

    I was denied migraines secondary to tinnitus, I also have major depressive disorder. Could I change my claim from secondary to tinnitus to secondary to my depressive disorder?

      The VA denied many veterans their deserved benefit ratings often and make it hard and drawn out often times.You need a in-service diagnosis or a nexus"doctor's opinion"connecting a more likely than not letter and a current diagnosis.A nexus don't always help,but most times it can.If you prove or convince the VA that your Migraines was aggravated and due to your Tinnitus with new evidents,write a Supplemental Claim.Also,it may not hurt to have someone close to you or a military buddy who know what you have and are going through to write a buddy letter(you can use a VA 21 - 4138 for that along with your own statement on another 21 - 4138.You need to explain how your condition affects you,your ability to function and work and your personal relationship/s.p.s. Make your 21-4138 short and compact,because the examiner has many claims to go through and definely don't to read anything long and drawn out(so get directly to the point).Don't give up and another thing is that every veteran has some type of mental health condition after being in the service,whether in war time or peace time(be truthful,open and vulerable).Oh,I forgot,write about in short your symptoms you deal with and how often.Hope you the best 🙂

      @@kennethhumphrey981, I have a diagnosis and a doctor's IMO stating that it is more likely than not due to tinnitus, and studies listed linking migraines to tinnitus. My C&P examiner said that tinnitus doesn't cause migraines.

      @@RonMac08 then that "examiner" doesn't know anything about tinnitus or anything connected to it. I would file an appeal to the decision. My V.A. doctor is treating me for my Migraines caused by Tinnitus.

      Tinnitus causes insomnia and anxiety, and that in many people causes depression. My friend got all 3 . Went from 0 to 80 pct
