I am sure what we often see is a rare occasion anyway. We don't hear about police officers being cool or what not. I belive most have common sense and I for ex use PC while going home/back to local yard for a trailer where I live and never anyone asked me anything about that and I use it every week. Had few guys doing inspection and never had a problem except the one I knew I got something wrong.

You don't need paper logs pc does not have a limit. You could even be loaded and it still would be legal.

Correct, in USA you can do split sleeper if you parked 3 hours and then 7 hours. But only for one day 😆
You can switch to sleeper if you are in the sleeper, not sitting driver seat waiting for a green light. Also, if your company maxes your 70 every week, logging sleeper at shipper/receiver will break you bc now you are working 80+ hours. Sleeper during load/unload should honestly be gotten rid of... even if you are in it, you cant really sleep, take off boots etc... goyta move when you hear that knock, get that phonecall, buzzer, green light whatever. If people stopped logging sleeper and stayed on duty, it would more accurately reflect the bs load times and something might actually be done about it, but no... leave it to truck drivers to actively continue sabotaging the industry by saying "just log sleeper dude". smh. You realize it still costs you TIME right? Is your TIME not the same thing as money? Cant drive 700 miles AND noodle around at warehouses for 3+ hours at a time everyday... you'll go bananas if you try. So if youre gonna do 500 instead you might as well log onduty at shipper so the people know why. Abusing the intent of the regs to earn your company more money and sweep the issue under the rug is enabling these shippers/receivers to do it in the first place
Split sleeper is the shix if you use it properly 😊
@@michaelk.3052 using it to freeze your 14 in certain situations can be useful but when it comes the longer 7/8hr break there is rarely a reason for me to ever not just finish out the full 10 and get a full clock. I run w/split ruleset on all the time for that reason only. The problem is, your dispatchers/planners get comfy with this fact and get lazy with planning your loads until you start getting unmanageable ridiculous loads all the time.

My favorite part of flatbedding is that it's true you rarely wait. I can think of ONE load in the past three months where I was waiting longer than an hour to get loaded. Securement and tarping is a challenge, it's true. But, given the choice, I'd personally much rather do that than sit at a dock for hours and hours.
@@1babysun Take your cdl to an electrical lineman apprenticeship with the IBEW and sign their books. Apprentices at 50hr work weeks make almost 90k, Journeyman 130+. gl
We deal with dot. Shitty brokers, shippers and receivers. Some don’t even let me use their bathrooms. Sucks sometimes when I need to drop an extra load lol

You're leaving out a very important element most of these carriers have PC turned off and you have to call them and many of them don't answer the phone at 1:00 in the morning or midnight this is very aggravating and frustrating somebody's telling you to move and you can't turn PC on to even leave until your company gives you permission and they want to make sure that you know you're meeting the guidelines for they will turn it on and you just caught in the middle and you know the whole thing is just you can't win
First off if a shipper or receiver doesn't want to load or unload in a decent time frame I pull out and shut my doors and they can go lump it. I will not waste my time waiting for them. I've done this before and I'll continue to do it. Hrs of service is what it is. The only way customers will learn is to teach them a lesson if they want to ship or receive their products

@hvelez8239 they had no choice hrs of service is what it is. Any company that doesn't support their drivers decisions on that matter is breaking the law. I get safety messages all the time saying preplan your trips accordingly to prevent running out at customers. So I do if they don't supply parking I give them a choice either get me loaded quickly or unloaded quickly or I'll come back after a break. The company has no say since I'm following the hrs of service. If they fire me for doing my job they won't be happy at the money they will lose not only from a law suit but from the esop I have which is quite substantial. Any company that fires drivers for this isn't a company worth working for and should be out of business. Besides I'm too damn old to go playing these types of immature games some companies do. I suggest if you work for one of these you may want to go work somewhere else.

I did the same / The big company I used to work for pretty much understood me. They are strict on following hours of service/ smaller company, however, did not like what I did, but I didn’t care/ my priority was my CDL, not the company I work for / can’t do shit with no CDL

The e l d has made trucking worse... It turns a good Trucker into a bad trucker I've got all kinds of stories on bad shippers and receivers... One example, Costco unloades at four o'clock in the morning, They made me stand on the dock Well, I'm not a graveyard truck driver... Many Shippers and receivers are very uncooperative and give a truck driver a hard time... California is the worst, They all hate truck drivers.
I'd like to ask a question. I called someone's husband a 'trucker' on a youtube comment, and they were insulted. I thought it was a completely acceptable term. She said "He is a man who drives a truck, not a trucker". My husband is a teacher, but apparently people are supposed to refer to him as 'a man to teaches'? I always thought it was cool when people say, "I'm a trucker". Am I wrong? This woman reported me as being abusive for that.
Teachers are now “educators”.

Had a questionable PC a while back at a speeding stop in Ohio. Trooper talked to a supervisor and was told if the movement wasn’t producing revenue it’s ok to PC!

Retired now but drove otr all thru the covid pandemic. I recall driving legally for 24 hours straight with only a few 15 minute breaks in order to make a Walmart load on time. FMCSA allowed this so the general public could get fed. Shippers/receivers treated drivers with respect during this time because we were considered essential personnel at that time. Many praises were heaped on drivers at that time for continuing to drive. Now the entitled general public and FMCSA consider truckers to be servents due to the actions of a few. Trucking has turned into an even bigger shit show following along with the rest of the country. God bless.
I also remember that we were so "essential " that we were told that we'd be compensated for being away from home and family and making sure that people were fed and had their toilet paper and now today we are the biggest POS out there. I'm so close to pulling the plug and hanging it up

Use the “Split Sleeper Berth”. Put yourself in “Sleeper Berth” when you arrive at the shipper/receiver.
if your company wont allow pc.....and your at a shipper and they need you leave ....tell them they need to tow the truck....when your company pays for the tow tell them to allow pc next time
My company uses drop lots to rest when no other place is available to park.
Trick is to drop trailer. Use PC and then go back to the drop lot under PC.
My trick is to work normal and get paid for my time….PC is free work.

Personal conveyance is the movement of a commercial motor vehicle (CMV) for personal use while off-duty. A driver may record time operating a CMV for personal conveyance as off-duty only when the driver is relieved from work and all responsibility for performing work by the motor carrier. The CMV may be used for personal conveyance even if it is laden, since the load is not being transported for the commercial benefit of the motor carrier at that time. Personal conveyance does not reduce a driver’s or motor carrier’s responsibility to operate a CMV safely. Motor carriers can establish personal conveyance limitations either within the scope of, or more restrictive than, the guidance provided

So he couldn’t just pc to nearest truck stop after getting unloaded, since he was empty? Seems like that should be one of the prime uses. Especially after seeing he was in the same location for 5 hrs and especially if they unloaded him in a normal time frame he would’ve still had time to go park.

Just stay on property. They might call the police. You then explain to the police what happened. If the police tell you to move, ask for name and badge number and put that into your log as the reason you had to use personal conveyance.
If police show up, request an officer with DOT certification. Then let that officer make the call, and if he says you stay for your 10h everyone else can eat crow
You all are forgetting that he's on private property. They're legally able to kick him out.

You are forgetting that the DOT gives no ducks and if you violate the logbook rules you can be/ will be shutdown right where you are caught and maybe even arrested depending on the violations. In the end, no matter what, if you can't pc because of shitty company policy, do not move without written order from a DOT officer.

And you're forgetting that the driver is on private property. If the owner wants him off, he has to go. Hours or no hours. That's why the personal conveyance is there.
Before retiring the carrier I drove for had a simple policy for personal conveyance.... you had to start and end your pc driving at the same location and no loaded trailers.

I’m at Prime and we get one hour of PC per day. If you abuse it, you lose it period. Most of these drivers have lost their PC privileges per their company and just aren’t being honest about it. Yes, it is completely legal but as you said, drivers have to comply to company policy. That driver should have been able to PC to a truck stop and put in the note safe parking or truck stop, something like that.
He could have edited his log to show on arrival on duty 10min comment- "drop load in doc"k, then go on sleeper berth show comment as"trailer disconnected", 2 hr`s will pause clock, then when secutity requested to move go on PC show as run "errands", then when he gets a call back from security sayig box is empty , go back hook empty then go on duty- comment "pre-trip ispection, hook empty, the whole time clock would have been paused..,now there might be several variations to this example but When I sit get unloaded always stop the clock, Manage your time,.

The worst I have ever had happened... I waited for two days to get a trailer loaded, Then they canceled that load.
Now you got a free load to sell. If they still want it after cancelling, 2k fee to unload your truck, and must be cash, no check. They can cancel checks.

An issue like that happened at Target Distribution Center, once they ask me to leave unloaded its an automatic rejection on the load. As an owner operator, with own authority, i personally log off and end my day, commencing an Off duty term.

Guidance: No, except for the one exception described in Guidance Question 26 to 49 CFR 395.8 where a driver who runs out of hours while at a shipper’s or receiver’s facility may drive from that facility to a nearby, safe location to park, provided that the driver allows adequate time to obtain rest in accordance with daily minimum off-duty periods under the Hours of Service rules before beginning to drive. Personal conveyance is those times where a driver is operating solely for a non-business purpose and cannot be used to extend the duty day
This is the problem because companies policy go against federal law and shipping receiving policy
Another scenario. Costco (Tracy, CA) said, "they used to let drivers park on their lot. But drivers leave such a mess that they (Costco) don't allow parking."
I know Alex is covering this pretty well with this refresher video, but will give my 2 cents. Some folks may agree, some may not, but so far 17 years of driving, 3 company audits, 1 DOT full company audit & no issues so far.
Unfortunately I seen a few people on here that doesn't quite understand how the 8/2 or 7/3 split actually works.
(This won't help to get you extra driving time like the agricultural 16hr rule, which extends driving time due to weather & safe haven conditions / once a week only)
As long as you've gone off duty or sleeper birth for a minimum of 2 hours & have your tab set to go to the split setting, you're able to get your clock to stop at whatever time that you went off duty, it will stop counting, technically & will not begin until you start driving once again or go on duty.
(Yes you may see it still counting down but as soon as the 2-hour Mark hits, it will give back that 2 hours automatically to your time along with the remaining part of that day and stops)
(It can be used multiple days)
You use the remaining time for that day, take an 8-hour break & then whatever time you used previously, up to going off duty, to do that split, you gain back for the next morning or you can do a full 10 hour to completely reset.
(This is how some folks are able to deliver loads on time, if they get stuck in an accident or traffic & such, just gotta decide if you want the 2hr break to get that lost time back)
Another major sticking point, if you are not (PHYSICALLY) unloading that trailer, you (DO NOT) have to be in the unloading line. Log it 15-30 mins and go off-duty. (Some companies are A-holes& want you on that line especially for LTL, but again, only if YOU are unloading it, it has to be on-duty)
PC can be used as long as you are not advancing your load, whether it be for mileage or starting point or physically loading. This is why no touch freight is nice.
If you do happen to be kicked off of a property you can PC away from there go do your 10 hour (if needed) or the remaining time needed to drive legally, then return to the property, whether it be at the gate or at the roadway near the gate safely, to where you can begin your day.
As long as you're pretty well within a few hundred feet of the facility, then you're legally staying within the rules for PC conveyance.
I kind of know this. The problem that doesn't seem to have a resolution is when you're working for a local company or I mean it doesn't necessarily have to be it could be corporate and they route you in such a way That if you were to stop to get fuel or if you needed to use the restroom. You have so many stops and anything outside of that and if it's an accident it doesn't matter they don't seem to understand that you need to provide more time for getting back. Because otherwise you don't have personal conveyance or just when you run out of hours. So you might be like an hour or 30 minutes or 20 minutes from the yard but now you're SOL. That's that's something we need some sort of personal conveyance for
One small question on P.C. I delivered into Los Angeles, Ca. ( This was 2 decades ago) on a Monday, nothing Tuesday, Wednesday lunch called in and nothing. Told Dispatcher Have a good weekend and bobtailed to Pensacola, Fl., 3.5 days to arrive at home show P.C. the whole time ? Note in logs Home bound? Took a 10 day vacation at arrival. What does P.C. say for that many days?

I asked if i could use PC to go home and i had only few minutes left on clock. My house was only 1hour away and i was gonna have a day off. I was told NO, that it's only for gettin to the closest safe haven.

Im glad to see someone reads rules. Problem i see is somebody could utilize that time to extend hours. Why a person would move a load for free is crazy but we do live in a crazy world. Fuel is expensive im not going to do the math on cost of 1200 miles doing a pc
If I'm delayed by the customer or traffic from getting to safe parking, I flag it, usually consult safety, then PC then explain in remarks. It's rare and not used to advance loads anymore than the first available safe parking. Haven't had trouble yet.
Did go from North Dakota to east texas on pc with trailer no problems with two inspections by Poe. No problems at all if you know the rules and be polite to officer.
Basically you can use it
If you dont advance the load but with these fuel prices it only makes sense to do so also its ok as long as youre not getting paid

It is unfortunate this driver is not a regular Mutha Trucker viewer. He would have known to just respond "oh, i can't stay? Ok, mo problem. I'll just hit PC and notate "driving to nearest safe and reasonable location per safety official". Have a good night, sir. Zero conflict, PC works for you, not against you
When told too leave and you are out of driving hours make the shipper or receiver call the police and have you trespassed and then have the officer sign your logbook making you drive from the property to a safehaven and your covered. If the company kicks back on you for any reason from this trespass then it's money in your bank account when you take them to court.
Happened to me.. I called the company I’m leased to and informed them that my tablet screen went black.. then they use paper logs til it’s fixed… I just needed to hear the words use paper logs..🤷
I am a single driver of my own company ( authority ) once I used PC miles from Albany NY to Binghamton NY which is about 160 miles and motive eld company dropped my reading.
For those of us driving otr,going home on PC 1200 miles from a so called drop lot is not an option as a company driver.Just think of the cost in fuel.

I hope the driver has a copy of the communication with the company along with the security guard video. An attorney may be able to assist him. So much BS

I.e. Company policy can be more restrictive, as is the case with my company.
I have an ELD exempt truck use paper logs.I run SAFELY on my own terms.If im tired i take a nap otherwise i drive.I dont need the DOT telling me when to drive,rest ,go to the bathroom, etc......

I refuse to work anywhere with unreasonable PC limits.
I mostly drive for small companies but majority of them always tell me to drive on PC and usually give me feedback when I tell them no. After some time I'll leave because I won't jeopardize my license for the sake of an extra hour.
PC is a very useful tool when used appropriately… for those using it inappropriately, they should be fired!
I have told you many times before that legend transport tells us to use it all the time to deliver and or go to pick up a load then once out of hrs they say use it to a truck stop next to you after all that

Va State Police told me I can’t use PC to advance a load even if going to a restaurant or my home is on the way. He said I would have to return to the spot I started my PC and go from there. That was loaded or empty

Most shippers and receivers hate truck drivers, sometimes they’ll be nice enough to have signs that read “no over night parking” and “no driver restrooms”
Nothing new about being kicked off the customers property after your loaded or empty. Call your company logs/compliance/safety line and explain I’m out of hours and they are demanding I leave. There is no legal parking here and I need to go to the nearest safe/legal parking. If your company leaves you hanging to catch a parking ticket I would find another job. 23+ year driver here and I’ve seen different angles and a reasonable company will say they will fix your eld and just go to the closest legal parking. A shit company that you need to leave will say pull out on the street and catch a parking ticket. DONT WORK FOR SHIT COMPANIES THAT WILL LEAVE YOU IN UNSAFE LOCATIONS!!!!!
That's a situation that you take to your company Safety Coordinator when the customer is demanding that you leave there property and your out of hours and it's against your companies policy to move on personal conveyance.
Walmart and Sam's Distribution centers are notorious for this.
PC causes problems...in violation of hours to to nearest rest spot can be dealt with the logs department...drive safe.. Amen
PC was used for after the load is complete, to bobtail to Walmart to get supplies..that was in 2018 tho🤔
Not in California. U can't go from Las Vegas Nevada 2 San Bernardino CA with an empty trailer using PC. California DOT on DOT I 15 South said that No! U can not cross state line

We have to SUE (class action lawsuit) the federal government; for not working with us, & leaving too much grey area for P.C, not providing adequate parking, & unfair business practices
