    I drive a day cab. I’m driving back home. I don’t care if the dock leaves me hanging for 7 hours to unload 11 pallets. I’m going home. Thanks for playing and be safe.

      If you fall under local short haul exemption you don't even need a log to start with,
      Most time in a day can there never going to ask you for a elog anyway
      Just hand him a set of bol that's not 150 or 180 or whatever it is to qualify

    In addition to being able to travel to and from home/terminal while loaded, there's no limit to how far, as long as the driver is not ill or fatigued.

    You can use pc on 34 hour reset. Just make sure you log on pc before you drive, both to and from wherever you go.

    What if you are laden and you are heading home for time off your truck. But it’s headed in the direction of the laden loads direction, and the carrier is aware that you are stopping at your home? Can you then use PC to get home after you have been in regular drive status? After you have been in regular drive status for the majority of your long haul?

    The book only refers to 392.3 of the FMCSA. Which is vague.. because it states if the driver is ill or tired.

    Thanks for posting informational videos. I'm new. Learning.. I buy Eld mandate plus, they give me demo. Told me u can drive bobtail or empty trailer in personal convenience.I pick load from Fontana Ca dropped Sumner WA. I have 6 hours left from 70 hours. I talk to eld mandate customer service.They told me you can drive in PC to home North CA. i do and doing every time. When i'm unleaden i go shipers in pc 2 hours 4 hours drive. I have doubts. I keep checking videos on you tube incidentally i saw videos saying there is no such rule traveling one state to another in PC. Now i saw your video this makes sense. Is i'm in trouble if i have audited. I'm not doing it next time

    Awesome video. Thank you for your in-depth videos. Very informative and educational.
    We are a new owner operator. We have a scenario where its a Friday and we completed our last load and are ready for our 34 hour reset. We are 1000 miles from home, but there are family and friends about 4 hours away from our drop off point in this distant state. Since we have completed work and looking to spend our reset time with friends and family, would this be a proper use of PC? (What would we indicate in the log?)
    If we have only 2 more hours left on our clock (of both our 11 hours and 14 hours), would it make a difference, if we are not tired or fatigued, to drive those 2 extra hours or all 4 hours as PC?
    Do we have to stop at the closest rest area first (on-duty driving), then proceed to meals or entertainment even though that may be 4 hours away?
    If we know where we are going to spend our 34 hour reset, are we able to schedule a pickup near where we ended our 34 hour reset?
    Does the timing of the receipt of the order matter (if it was received the day before we drove the 4 hours, or the day after we get there) since it may appear we are locating our equipment closer to our next job on PC time which wouldn't look good?
    Hoping that you can clarify all these questions because this scenario will happen to us more than once based upon the lane we travel.

      PC if not limited by your carrier is allowed to be used from drop lot to home even if it's a 3000 miles away as long as your not tired or fatigued. And PC from home back to drop lot. And once your off duty you can PC yo go eat or entertainment. Where Your fam is not your home address so no PC allowed unless you state restuarant or entertainment .

    PC just gets you in a bind, it's all optional up to the dot officer, . Really just too much gray area in it.

    How about owner operators that live on their trucks and don't have a physical address? How would you define personal conveyance to them? I give you one example: the guy is sitting bored on his truck waiting for a load to pop on the board but the zone where he is it's pretty much dead in the next 250 MLS radius so he opted to move to another state where is freight! He is empty and doesn't have a load! He doesn't have a load waiting for him on the other state where he is going! he is just moving to see if he can find loads there so he drives 427mls empty to another state! Can he use personal conveyance in this circumstance?

      Better have proof you didn’t have a load waiting for you when you took off. Just appealed a similar one for a client of ours and was denied because we couldn’t prove definitively there was no load waiting for us.

    1. If driver uses two vehicles in 1 day, then can he use 75 km PC on both(each) of trucks or it is limited to per driver for 1 day?
    2. If there are two drivers in team, If 1 driver uses up 75 km on Truck T1, and will co-driver be able to use PC in canada on same truck T1 on same day upto 75 km?

    My company doesn't have enough ELD's for all the drivers. Can I buy my own and use it in any truck I drive? Or does it have to be registered to the company and matched with one of their trucks?

    I dropped a loaded trailer at a truck. Stop and proceeded to use personal covenants to Bob tail to the terminal. And then from the terminal I use my personal vehicle to go home. My company says I was in violation. Is this true?

    New Safety Director here. I've been addressing PC with my driver's this week and I've have some very grumpy driver's. The issue most are upset about is when they go to drop off a load and get told to come back the next day why can't they PC back and fourth from the closest truck stop. My answer is no they can't because it is work related and they don't have a empty trailer. I've told them to ask themselves 2 questions before using it "Is it work related?" "Am I using it to extend my day?" and if either are yes then don't use PC. Am I wrong? Would I be a jerk to just get rid of PC all together?

      The PC guidance allows drivers to use PC to get to the nearest safe location if they run out of hours while detained at a shippers or receivers. The return trip in the morning would be a different story…no PC allowed. Many carriers choose to turn off PC and count all drive time as driving. It’s up to you.

    I’m looking for parking by Atlanta in personal my carriers limited 50 miles but I go trucks stops are full I keep using personal maybe to 60 o 70 not sure so my pc after 50 miles automatic go to driving mode and make violation is no place to parking to sleep in I 75 north passing Atlanta what happened why my personal convenience screwed me maybe because I don’t go off duty first to set personal looking for parking

    Does personal conveyance put me as the driver and/or the company at risk if I get involved in an accident? Would their insurance company say nope not covered and would I incur a violation barring any fault of the particulars about the accident?

      Certainly could. Most commercial AL policies exclude personal use, which is why non-trucking liability policies are a thing.

      Current DOT guidance says it doesn’t matter if you’re loaded or not. You can use PC if you’re truly off duty (eg going to the movies).

      Yes, as long as you aren’t working at the direction of the carrier or enhancing its operational readiness, you can be in PC status during your 34 hour restart. Also, check with your carrier to see if they have a policy on PC use.

    "Commuting between the driver’s terminal and his or her residence, between trailer-drop lots and the driver’s residence, and between work sites and his or her residence. In these scenarios, the commuting distance combined with the release from work and start to work times must allow the driver enough time to obtain the required restorative rest as to ensure the driver is not fatigued."
    You stated in your video that they can travel to or from a driver's home and their terminal.
    The regulations state "Commuting between the drivers terminal and his or her residence or between trailer drops to their residence". It does not say that they can travel from their home to their terminal. This would be a move for the motor carrier. They are going to the terminal in readiness to transport a load. " Commuting between a drivers terminal and their Home" You can go home free but you cannot go to work free in a CMV. Nowhere does it say driving from their home to their terminal. Why are they going to the terminal? To work. No difference than going from home to a loading point.

      The agency guidance doesn’t address it, but if you are proceeding directly from your house to the first pickup or from the last drop off back to your house, I believe they would say it needs to be logged as driving time.

    Park the truck before your time runs out.
    A lot of small companies have no clue about PC.

      The regulations don’t prohibit passengers-they just require your carrier to give you authorization to have passengers. So you’ll want to check with your carrier.

    You didnt touch the topic of PC from drop lot to residence residence to drop lot and or terminal to residence residence to terminal??? There is no limit to hours or miles on PC in those cases as long as driver is not sick or fatigued so technically you can pc from drop lot in Dallas and Pc to residence or entertainment purpose to Milwaukee and its legal

    What about using PC for mechanic test drive truck?

      Since mechanics are typically operating within a 150 air mile radius, they’re normally exempt from logging altogether under the short haul exemption, so PC may not even be an issue in that context

      Usually companies or the mechanic can log in under a maintenance account so the truck logs the drive time on that. Make sure you log out before they go driving it around and ruining your breaks

    What happens if you been in the sleeper birthday for 5 hours on a 10 hour reset but noticed you need gas ... can you use personal convenience to get gas especially if your truck is your home aswell

      The DOT would tell you no…that time needs to be logged as driving and would interrupt your 10-hr break.

    what happened to useing a Relief of duty or rod from dispatch. thats what we did years ago . as far as im concerned person conveyance is a lawyers wording for whether ur under dispatch or or relieved from dispatch.

      The agency would tell you that you need to leave yourself enough driving time to account for that possibility.

      What I do is pretend you only have 10 hours not 11. Sometimes you have to stop at 2-3 places to find parking. Even giving yourself 30 minutes isn’t enough sometimes. A good way to fix this is adjust schedule to be ending your day when parking is more available if possible. What I do is typically spend my day 4am-6pm. If I have to split sleeper to extend 14hr day or I had a later start and I end up looking to park after 6pm I then start looking for rest areas/lesser known truck stops so I don’t run into the issue of no parking at major truck stop. Another possibility if you want to push it to the limit but want parking is reserving in advance, some companies will reimburse reserve parking.

    Is there a certain stated limit of how many consecutively time PC can be used? Lets say could it be used more that 3 or 4 consecutive days in a row for maybe 30min -1hr at the end of the day trying to find Safe parking?

      Currently there is no limit. But CVSA is petitioning the agency to put a cap on it. Not sure if that will ever happen.

      @@Trucksafe Not sure they ever could as they can only regulate when a vehicle is engaged in such use. For example if you own the truck and use it for your own personal use that cannot be regulated. It comes down to jurisdiction and where they have none they cannot regulate that. That's why it's such a grey area. They just never openly admit where they have no jurisdiction.

    I am an OTR driver and keep running out of hours 10-20 min before a truck stop. Can I use PC to get to truck stop safely?

      Probably not, unfortunately. If you look at the FMCSA’s guidance, it says you can’t use PC when bypassing truck stops to get closer to the next origination or destination point. So if you’re passing by rest areas before you run out of time, then you can’t use PC to get yourself a little further down to the road. On the other hand, the guidance says you can use PC in situations where you are detained at a loading or unloading point, run out of hours, and need to get to the closest rest area.

      The FMCSA’s guidance says you can’t PC home from a shipper facility. Only from a carrier’s terminal.

    I would like to ask for some help. Hence, I was on my first day of work traveling DHM, no load was assigned, anything. I was at the end of my hours so I was planning to stop a few miles nearby to do my reset. It turned out that I was not able to find an available parking spot n the way, so I drove 44mi in a direction of where I should pick up my trailer the next day. So I did an 11hrs reset here. (Still, no load assigned) This happened 29th and my first load was assigned on the 31st. How legal is my PC?

      DOT would tell you that deadheading to get closer to a pickup point must be logged as driving. And the PC guidance doesn’t allow PC when you run out of hours on the road while looking for parking. So, in my view, FMCSA would write this up as a false log.

      If you’re generally free to do what you want during that time (meaning you’re relieved of responsibility for the truck and cargo), you can log it as off duty or sleeper (if you’re in the sleeper berth). Otherwise, it would have to be logged as on duty not driving.

    If it's not legally recognized then an officer could potentially nail you for it at their discretion. Seems sketchy until it's implemented correctly. Don't want to hurt the career with murky or grey areas "rules"....like what would "a reasonable distance" be? 50 miles from home? 19 miles? Lol without a real cut off. Isn't it just allbup to how the officer feels that day and if he wants to be understanding or feels like being a ball buster? I don't like that wiggle room for them to potentially use it against me even if I'm using ut by the book

    I disagree with you strongly as to the use of PC . During mass hysteria time known as the pandemic of covid. We were allowed unfettered opportunities to deliver qualified goods under pc guidelines. So it has nothing what so ever to do with safety. This went on for 2 years. Now if a off duty time is marked pc and annotations say entertainment or restaurant. With having no mileage limits nor returning requirements. Then you can drive from say Seattle to Keywest laden or unladen since they removed that restriction. Under off duty pc annotations saying either restaurant or entertainment facility. Now my analogy is that of a rich man with a good cpa who's tax liability is zero because his cpa knows the tax code. And for someone who goes to Walmart and has HR block do there taxes or worse them selves do there taxes. And end up paying taxes on a smaller amount.Who just do a fill in here form. My question who is the smart one.
    Is there abuse in pc rules absolutely. Many just don't follow the rules. Or there company would rather get along then fight it out. That's just avoidance not solving the issue.
    If one follows the rules as written with fmcsa guidance as written and one is responsible enough to do pc with the correct annotation and not drive tired/fatigue. (I know of no test given for this that is approved by fmcsa) or ill. Then i say do what is allowed and go for it. They wrote the rules and guidance. Until they rewrite these rule to where they are beneficial to saftey.

    PC helps nobody but the company and shipper/ receiver. Before PC you had to take the violation make a note of what happened. ( No it still shows as violation but with note it was justified) .
    Now once that occurred you had to take a 8 hour break or 10 and your delivery was usually late.
    Now who does it really help more, ? The driver not really I could careless if some lazy ass at a plant take all night to load a truck I'm glad the stuff is late

    It’s none of the government’s business why I use PC and since the eld is not a law but a mandate law enforcement isn’t legally allowed to enforce it

    If done unloading and told to go home, can this be PC? (From receiver to home for hometime). I’m still confused because FMSCA states PC from offsite location or job terminal. Not sure if receiver would be considered an offisite location.

      FMCSA does not consider an offsite location to include a receiver. They have clarified that part of the guidance to mean offsite carrier locations (ie if a carrier sets up a temporary worksite of its own like construction companies sometimes do).
