  • Having a criminal record can feel like a bad secret or a stain that can't be washed off. Those are the words of one Marin resident who worked with the Marin County Public Defender's Office to clear her record. Expunged and inspired, she's now on the dean's list at law school.

    I had no idea you could get felonies removed from your record.

    In California, if a person is found guilty of a crime by a jury and the person is granted probation with Imposition of Sentence Suspended, the person is not considered "convicted". If the person serves the probation successfully, his/her status is as if he/she was never prosecuted.
    This is exactly what the California Supreme Court stated in Stephens v. Toomey 51 Cal 3d 864. This ruling has been endorsed by the Ninth Circuit Court of Appeals and other Federal Appellate decisions..
    However DDAs in Marin County along with the present and past Cal DOJs make intentional misstatements in violation of Title 18 section 1001 to the FBI and claim that such people have been convicted.
    They all know what I am saying is correct but these violators of Tile 18 Section 1001 get extra pay where more dispositions are considered "convictions".

    This such political bias love how they play on emotions like they actually care. With the emotional played up music. The only thing they care aboutvos furthering their political career.
