I think she should have been awarded a percentage of her rent back for all the months she lived there for this violation, because, legally, her space was not 100% habitable every month! I think she was just so frustrated, and creeped out by this woman, that she angrily wrote out her texts, not thinking how they could actually be interpreted, and they did kind of sound like extortion, and THAT is why she lost the case! It's too bad, the judge couldn't take this into consideration, and award her something as compensation! There was absolutely NO consequences for the landlord, which I think is just WRONG!!

She shouldn't have been in the tenants house like that and going through her stuff but the tenant was wrong too with how she handled it. The first agreement came off like the tenant was extremely stressed out and creeped out and was forced to move because of it so yes of course she wanted out of her lease and her security back. Moving isn't cheap at all and the reason she had to move wasn't her fault in any way. The minute the plaintiff took it past that it definitely came off as extortion and that is where she crossed the line and became as wrong as the defendant.

That said, what the plaintiff doesn't seem to get is that she *already got* her recourse when she was let out of the lease, got to extra days without paying rent, and received her entire security deposit back before she left. That's the deal she made. The defendant breached that deal, yes, but that breach was not worth another $3K.

Okay… the defendant reminds me so much of a previous patient I worked with. This woman was I think 76. We had her do random UA one day. She came back for almost everything under the sun and had the most extravagant excuses for each. Doc asks why she has 🍃 in her system: “grandkids smoke and she beats them with a broom but they won’t stop”.. okay, so the ‘crystal m’? “I live in a duplex and the neighbors are up to something. She just knew they were doing something illegal from the smell”… and my personal favorite, why do you have ‘white powder” in your system? “Oh, it was the craziest thing! I came in the house and my grandson was passed out on the ground. There was this powder stuff on the cabinet so I smelled it!” Needless to say, she was fired as a patient 😂

I’m not in total agreement with not suing your mother. My mom was awesome but there are some mothers out there who are absolutely horrible. “Borrowing” large sums of money from their kids and not paying it back, and putting bills in their kids names and then not paying the bills which ruins the kids credit, etc. Mothers are not exempt from getting sued if they’re awful people.🤷🏽♀️

She was forced to keep to the original deal. She was basically trying to get thousands of dollars for not even $20 worth of items. The deal should have had a clause about what consequences the defendant or plaintiff would have if either broke the deal. A magic eraser and some packing tape isn't worth dealing with the defendant again, especially on national TV.

You interpreted the outcome better than anyone in the comments, and there were hundreds. ...If the Plaintiff was your family member, what would you have advised her to do because I'm not sure what I would've advised a family member of mine. I think I might have told them to skip court for now, and file (and enforce) criminal charges against the Defendant, and then after that win, I would suggest that she THEN take it up in Civil Court and sue for punitive damages. Do you think that would've worked?

She was forced to keep to the original deal. She was basically trying to get thousands of dollars for not even $20 worth of items. The deal should have had a clause about what consequences the defendant or plaintiff would have if either broke the deal. A magic eraser and some packing tape isn't worth dealing with the defendant again, especially on national TV.
