It can be over 32gb, you just need to change the format to FAT32 with a 3rd party app (you can find plenty tutorials on youtube). I myself use a 64gb sd card from samsung and after changing the format it works perfectly fine
Do I specifically need a 3rd party app or can I just format it into FAT32? Not all 3rd party's are reliable and would prefer to do it myself if possible.

I'm sure you can. I was able to download a game from the hshop app on my 3ds. It downloaded to my blank r4 card and now it basically acts like regular game cartridge

The stock firmware does have a timebomb. This can be avoided by updating the firmware every year or by using a custom firmware
