For something to qualify as cruel and unusual it has to be torture, arbitrary, rejected throughout society, or completely unnecessary. Fining and removing homeless camping from public property does not constitute anything cruel or unusual. Especially when you consider that these people can freely travel anywhere else.
I’m from Portland and I went back home for the death of a family member. I was walking around Laurelhurst Park and was disgusted by the amount of trash, tents and broke down cars in and around the park. On my way home I was walking by this car and this man was actively vomiting out the driver side of his broke down car. absolutely disgusting and heartbreaking at the same time because it is not the place I remember growing up in.
I wonder if they could have found an even more liberal law professor to interview, The court decided that the states should decide their own abortion laws. They should be decided by people elected in that state and 9 supreme court members, who were not elected by anyone should not be making that decision for everyone.
People can camp free on BLM lands and there are a lot of them, do they have to camp in the middle of the city? Seems we need a top down management of the problems that create homeless people who are not able to maintain a life style that ables them to maintain shelter, though there are many other support structures available to people like Medicaid, food stamps, food banks, health care for people who are no able to maintain income, to affords them medical care. And, more, there are pieces of an overall structure available but people aren't able to put it all together to maintain a viable life style.

The problem with allowing this behavior is it just gives people incentive join in. We need to centralize homeless in training centers and job placement after learning a trade. Then they can fill jobs desperately needed in this country.
Some can do that but many are disabled, and retired, What used to be a living SS check now won't pay the $1000. Per month rent and even if it does there is not enough left to pay utilities, other bills, and food.

It is absurd when homeless people post up right in sidewalks and set up unsightly camps all over tax payer paid parks. I have been homeless and know how lazy, drug-addicted, rude and entitled MANY homeless people are. I always tried my best to stay out of the sight of people and be respectful of my surrounds, so I wasn’t leaving trash everywhere, shitting in public, using drugs in public, and yelling at 2:00am. Even though it wasn’t completely my fault I was forced onto the street for 2 years, I didn’t play the victim and I focused on getting the help from the state that I could WHILE looking for work. It took over a year of working part-time and odd jobs to get enough money together that I get a place and have enough money left to pay rent for several months while I tried to find stable, full-time work. I know first hand how difficult it is to get a full-time job when you have no address and getting to work until you can get paid with no money is very difficult, but you have to have resolve and not play the victim. Homeless people do not need to be so entitled. You need to see it from a hard-working tax payer’s point of view. The “cruel and unusual punishment” thing is a flat out absurdity. Absolutely ludicrous. It is NOT DIFFICULT not camp in area that aren’t smack in the middle of a sidewalk or posted up right next to the footpath of parks with all your trash and shit strewn everywhere.
The approach to home construction should be revised commensurate with current manufacturing processes. Homes may be mass produced at low cost. There is little reason to custom build a basic, single-storey home. This process may be automated to produce panels that fit together that are insulated, wired and plumbed. Wall panels fasten together and into a floor panel that contains all of the utility lines to form rooms. Infrastructure that comprises a residential base with water, electricity, and sewer connections contained within are constructed beforehand to serve the needs of a city on which homes are erected. Imagine, ordering a home on Amazon for fifteen thousand dollars and being able to assemble it within an hour that has double or triple the space of a million-dollar apartment with state-of-the-art features such as an embossed ceiling that add a whole new dimension to luxurious living. The floor contains all of the utility lines, heating, ventilation, air conditioning, wiring, plumbing, water and drainage. Then it is merely a matter of plugging in vertical panels into the floor to form the outer walls and space for living-room, bedrooms, closets, kitchen and bathroom. This floor is the "mother floor-board" from which all utility connections rise upwards from the lines in the floor into vertical wall panels. No utility lines connect horizontally between vertical panels. Sinks, toilets and shower head are attached to wall panels that also plug into the floor. Wall panels that include lighting and an electrical outlet, which are possibly 4’x8’ or one meter by three meters, are mass produced in an automated process from a composite plastic material in a variety of creative textures. Panels that comprise the floor are one meter by fifteen meters with the edge panel containing utility lines. A ceiling is set on top of and fastened to the walls. The roof is a convex panel that fits on top of and plugs into the outer walls. It is also possible that with this waterproof plastic material each individual room has a bubble skylight dome roof/ceiling with pipes in the walls that drain into the base. Other refinements include the fabric of the dome comprising a solar array and solar collector. Thus, the entire home is made by inserting vertical wall panels into the floor panel that rests on top of and is connected to the city infrastructure slab base. It is not inconceivable that this single-storey home with one, two or three bedrooms be assembled and ready to move into within a few hours of the kit being delivered. Of course, this will never happen. Keep dreaming. It will take China to lead the way and transform housing from the expensive nineteenth century tailor-made suit concept into economical standard ready-to-wear off the rack homes that cost $15,000/$5,000,000 = 0.003 of the present cost of a home in Vancouver. The flaw in the analysis: Citizens may not utilize land that was _not_ promised to them in the presently cozy arrangement-functioning like a monopoly with monopoly prices-that shunts their lifetime earnings exacted through the cost of shelter directly into the pockets of the chosen few that without effort making them rich beyond belief while after a lifetime of hard work residents own nothing and are left to die homeless on the street.

We'll never be able to address the homeless problem if the SCOTUS makes it legal to camp on public lands. Since the constitution is silent on the issue of homelessness and there is no federal law addressing public camping, the states have every constitutional right to regulate homelessness and public camping in any way they deem fit.

Homeless tents on the steps of SCOTUS next? This is a tough one, Parks are not designed for Homeless encampments, neither are Public Restrooms with homeless living in the stalls or on blocking sidewalks outside businesses. That said; Cities or Counties need to establish places where Homeless can temporarily stay, it's not right to just outlaw them. They exist and will continue to exist until we can find a solution, but people living in places not designed for them are frequently not safe for the Homeless or the Public. We also need to quit sending people in need of mental help to the Streets. What ever happened to Mental Hospitals?, I'm not even sure they exist anymore. We can solve this problem if we are determined to fix it, but it doesn't make money or empower many voters so there is little political will. One way of the other this is costing us all much more than dollars.

Why can't there be a ruling that goes by population of the city or town. That if the population is under a certain amount say for example 200,000 people. Due to the fact that smaller towns don't have the funding etc. To handle homelessness that those smaller towns have the right to give citations. But the larger cities that have the funding etc. Don't have that right to give citations.
