    It's like borrowing someone's phone, dropping it and cracking the screen, then returning it saying "yeah I dropped it but because you agreed to let me use it, I therefore owned it for the time being so technically this phone belongs to me but, now I am returning it to you and I will not be held accountable because I am now essentially giving you MY phone".

I mean if they ask, then take it depending on your consent and then say that they have "detained" it by being in possession of it and thereby can do what they want with it because of sovereign immunity, then your property can be in danger because of some idiots mishandling your property.

      The immunity shit has to be rained in, it's bulshit that officers can pull this kind of shit and not pay a dime. It's happened a few times before, I know of another case were a guy was on the run from the law and hid in an innocent family' house and the police basically blew it up to get the guy then didn't pay a cent.

    I still want some big name lawyer to explain how the concept of sovereign immunity is even constitutional to begin with. Something about 'Congress shall make no law (...) prohibiting (...) to petition the government for a redress of grievances.'

      That's it. No, really. How could one expect the state to prosecute or judge the state?
      Unless... one had separation of the different aspects of the state's power with checks and balances between them... And just like that sovereign immunity died in the 1700s.
      Except in places that didn't implement separation of powers right...

    Very interesting! I graduated from Villanova University this past May and Algar Ferrari was less than a mile from my campus, so I frequently drove by it always amazed at what they had. I had heard about this story but never knew the full details, very good job!

    on the flip side, how many cars get stolen every day and are never seen again, the insurance companies still pay out on those. this case was special being as the car got recovered without a scratch and MIC had the opportunity to actually get their money back, but got jipped in the end by uncle sam. $370k at a salvage auction isnt bad considering they could have been out the full $630k or whatever they paid out only for the car to disappear

    Thanks for the morality story.... Stealing is bad. I was thinking of stealing a Ferrari today... you set me straight... This "test drive" dash theft is pretty common with exotics..... I have test drove average cars and exotics. Even a Honda dealer will require you give them your DL which they photocopy, hold your car keys and have a sales person ride along. On the other hand I have been thrown the keys at other dealers... One for sale by owner car I looked at, the guy said he was not home, but he told me the car was in the driveway, un-locked, key on the floor, take if for a test drive. He did not know me from Adam. I just called on a classified ad. I did do the test drive. I passed on the car...

As an airline pilot that would be career ending. 2) apparently you've never made a claim on the car but the insurance companies don't pay full price. Selling a good working car is better than making an insurance claim any day of the week.

Yes it has agreed value. Your run of the mill daily driver wirh any ABC insurance company is NOT agreed value. Appraised value IS determined at time of loss 100% by the insurance companies AND it is what they say it is. Hard to replace a cars for that price6. Bottom line no one is getting rich off a stolen car insurance payouts. I have USAA (excellent) and pay a very small premium for appraised plus an extra $2,500. When you ask any insurance insurance company what they would pay for a total loss of your car today they won't tell you. You can dispute it, and show values through reputable sources and negotiate. Again my point is you're not going to get rich off of getting your car stolen. Selling a clean used car by owner is almost always more than insurance.

Let's say for instance they're tired of the vehicle or behind on payments. You mr. PILOT shows up and steals car. They make claim, insurance company pays for the car. Yes you have to have gap coverage just in case the car is worth less than what you owe on it.

    You can be pretty much guaranteed the district judge had little to do with this decision and it had everything to do with the government having zero interest in having the ruling set a precedent that the government is responsible for their actions and destruction of property, especially in custody. I'm sure they leaned on him extremely hard.

    This was, without a doubt, the most interesting and craziest RCR Story thus far. I like to think that I'm relatively well-informed when it comes to the subject of cars, trucks. bikes, and everything else in the 'moto-world;' you've just demonstrated how uninformed I really am. Yours was not only my introduction to this whole case (shitshow?) but it also left me with some persistent questions that I need to research...What happened to the Testarossa? And the 328?! Were there others?
    It's easy to assume that the feds found those cars in response to the initial F50 inquiry (bust), but that wasn't actually addressed in the story.
    What if each car was stored away in a different and distinct hiding place? The F50 may be gone but he can still drive a stolen Ferrari w/12 cylinders and a gated manual. Living the dream!

    So, let me get this straight, guy steals Ferrari, sells it, GM steals the stolen Ferrari, then the FBI steals and wrecks said Ferrari, and the district courts just said "Lol it's not yours who cares, we're innocent" still leaving the dealership technically out a Ferrari that should have been returned for the insurance payout.

    It would have been nice to know if the FBI agent or prosecutor got into trouble for driving the car without a good reason, or if the reason was indeed legitimate... but I guess the FBI aren't likely to leave documents that say that kind of thing lying around...

    I just reviewed the pre-production Roma at Algar 2 months ago, they of course didn't tell me this story, not their proudest moment. This was a really cool thing for me personally!

    I want to give a slightly different account of exactly how the guy got the f50 out of Algar’s possession. This is a second hand story BUT, I will provide these bona fides: my dad knew a couple of guys at Algar, because he bought a car from them and was having it fixed there either very shortly before this happened or at the same time. We lived a mile and a half down the road from Algar in 2003 as well so I remember this happening when it happened.
    The story I heard, again, second hand (from my dad who heard it from someone at Algar) is that this guy got into the car with a salesman and took the car on a test drive, salesman in the car. Through some chicanery (the specifics of which I do not recall) this guy got the salesman out of the car while he remained in it. I *believe* he was driving, the salesman was asked to take over and when the salesman got out of the car to switch seats this dude took off.
    That’s what I heard. I cannot confirm that it was true. My buddy saw the car that day near a park called The Willows which is near where the theft/switch allegedly occurred, but can’t remember if he saw two people in the car. This was 20 years ago (ouch) so memories have faded.

    I feel sorry for the first victim. Truly not his fault. But not for the idiots who gave this guy the F50. You can't even test drive a base model Corolla without showing at least some ID and drivers license

      High-end dealerships just "work differently". The dealer has to assume if a potential customer is interested in a insanely-priced vehicle, then they must have "F*ck You" money. One might argue that it's worth less to lose a car than to lose a customer at this level.

    Algar didn't just hand him the keys to the F50. The salesman took him out for a test drive, during the drive the their asked him if he could drive the car. When they switched seats is when Baker took off and left the salesman out in the street.
