    In Scotland statute barring is 5 years. Also the time starts when the debtor last contacts the creditor.

      @@UberAlphaSirus Basically if the debtor ignores letters from a company for 5 years then it becomes statute barred. This doesn't apply to Council tax reminders.

    I have a debt of £10k for a car I got on finance, 6 years 6 months it’s been since last payment (went through hell with insurance and they didn’t pay out) only just received correspondence from debt collector. Is this statue barred?

      @@MoneyNerd the only thing is when does it start (the 6 years) because I didn’t make any payments after the accident however they obviously sent the odd letter to me for about 6/12 months. No CCJ nothing. Now it’s just debt collectors?

    Hi, if someone was to get say £500000 in loans, and then take the money out, would the bank stop you in any way and could it result in any criminal charges?

    What if you paying 20 year old debts cause you thought they was on your credit file what if I stop paying can it affect my credit now can they give me another default ? Does it affect your credit

      @@MoneyNerd but I never acknowledged it just had few debts and set up dd with them not even asking who it was I know I'm stupid but some of them are in 1990 grrr

    So after all of that and you are in a court system like money claim, how long can they keep that going after you have done the back and forth and it is ment to go to court for the argument? Are they still allowed to bombard you with letters asking for deals but not proceed with the case forever. How do you force thier hand to get to court for the argument and final ruling, they started it, we should be able to finish it. Is there an apeal process? Can you use your home insurance legal cover for this?

    Thank you for the video I just received warrant of control supposedly criminal fines back to 2016 I’ve never heard about it or I was aware of I have the bailiffs on my back asking me to pay do you think I should pay or is it statue barred

    Hi great video .
    I have a credit card debt from 2009 , a ccj was put on in 2017 . I have made no payment or had contact with anyone till 6 months ago when a credit agency tried to contact me . Are they allow to do this ?

      A CCJ (County Court Judgement) means a Summary Judgement has been made by a District Judge and if you don't pay it all manner of things can be done eg:
      Debt Collectors can contact you
      Solicitors can act as debt collectors
      High Court Enforcement can visit a residence or premises upon getting a Writ
      If debt isn't paid on request by HCEO by the 15th day - you will be held in contempt of court and it then becomes a Criminal Offense and gets referred to Magistrates Court.

    what happens if you are making regular payments and they take you to court to get a 2nd charge? then you stopped paying them

    Hi could I get some help. I have basically defaulted on one credit card and it's just past 6 years as it has just come off my credit report but now I have received my first letter from a debt collector. What should I do?

    I got a letter from overdales solitors about a 30 day claim before court, within that time. It would be a little over 6 years yet by the time those 30days are up, would my debt be statute barred as they basically ran out of time by roughly 3/4days?

    Hi what if you haven't acknowledged the debt due to change of address but charged for solicitors letters(not received due to moving)and ccj due to not receiving solicitors letters..over 8 years ago..minus £11(debt)now owe £868..need help on this please..as I'm a sensitive case also.

    Hi there, a CCJ was registered against me, and an interim charging order was registered against my property in march/16/2012.
    How could I remove this order off my land registry? Is there a way to stop this? Could I text or email you?

    I moved into my rented apartment in late November 2010. The rent of my apartment includes hot water and heating. I always paid rent and council tax. I never paid for water. In spring of 2011, I answered my door to a waterboard representative. He was inquiring about my unpaid water bills. I never asked for any water or signed contracts to receive any water. I told the Rep I couldn't afford to pay for water and told him to switch off water to my apartment. I've never spoke, sent a letter, emailed or rang anyone connected to the waterboard since that spring of 2010. I've received countless bills and letters from two waterboards, debt collectors and ignored each and every one. I recently had a visit from a Marstons debt collector. I did not answer the door or speak to him at all. He did however shove a letter under my door asking me to contact him. I refrained from contacting him. Am I statute-barred?

    Here in NM, I'm seeing that laws are not being honored regarding time. I have truly seen this happen to one.

    The 6 years starts from the last time you had any contact with the creditor not from the date of the default notice.

      yes, that's correct - from the last time you acknowledged the debt with the creditor to be specific.
