    I'm sorry I have been a bit sporadic with the posts. I am still in grad school and coming to the completion of two classes, which will leave me with one left. So, in September/October, you guys will be seeing a lot more of me as I will be done!

    Side note: TDIU is based on federal income limitations without dependents. ‘10k’ is just a roundabout # and we chose to my go low. If you’re TDIU, make sure you fall within the income limitation.

    I understand something a bit better because you said it well. Basically if you are P and T you must have static conditions that add up to the VA math 100% - simple. It is such a pain to get the document that says static.

    I retired in 2013 and I’ve not had any reevaluation as of yet. But I see the doc every 3 mos

      #FloridaMan23, you might need to reread your decision letters. I know I missed a bunch of stuff in mine. If you are rated at P&T, they usually leave these "Static (usually meaning 5 years or longer)" conditions alone. Also, keep going to your appointments, as if you sluff them off, they can say you are not participating in your healthcare, rehabilitation, or recovery and close you off.

      I’m in Pensacola and none of my letters have a code but I’ve been to the doc in person or over video almost every month for years. No reevaluation yet either.

    Join pain, back pain, tinnitus, mental, migraines etc don’t get better over time. I guess I am just confused on the difference. Thanks for the content.

    100% P&T…will be 10 years on 1 July 2024 (10 year retirement anniversary as well); and, I turn 55 in November. I get my healthcare both through Tricare (use the family medicine clinic at my closest military base (Ft Detrick) and my wife’s healthcare insurance (GEHA) through her federal job with a local Inova clinic. Only been to a VA clinic once in the past 8 years or so…that was recently in Puerto Rico when I slipped and fell hitting my back on a step at the Airbnb I was staying at.

    Does attending Psychosocial Rehabilitation and Recovery Center (PRRC) - also known as building bridges - reduce your 100 % PT ?

    #TheCivDiv I have asked the VA and various VSOs about Veterans working while getting IU. There is no real answer other than "gainful and sustained employment." Thank you, Gunny Oblivious. We have no ideas about programs or allowances (this is the Ist have heard of $10K or close to as an actual figure), etc. I know many vets are struggling because of the "real/effective inflation rate." Please, won't you make a video on this? I believe most veterans want to know the rules, yet we don't know where to look, so we will tune in here with you.

      Check pinned comment and the VA defines what gainful employment is within M21-1 (I’m traveling right now so you’ll need to do some leg work).

    It's funny. I'm rated at 80% and everything is static except for tinnitus which is only at 10%. The problem comes from raters who don't know that static means don't F around. They like to tinker even though it goes against the rules.

      My tinnitus is 10 and static. Not sure why yours isn't.

      @@axl67 Perhaps because they gave it to me in 2008 and there wasn't a way to verify medically that I have ringing in my ears. I was a helicopter mechanic and I deployed 4 times so it was pretty much a given that I was service connected for that 10 percent, but perhaps because they gave it to me their one requirement is that it's not "static". I'm not really sure, but either way it won't impact my overall 80% rating if they were to reduce that one because everything else is static.

    I hop you can answer a question. I have a 20% rating from ealry 2000 for a MCL and ACL injury. I finally tore my ACL and MVL completly in bicycle accident. in September 2023. I had an ACL and MCL graft done in December. I was out of work for 4 months and now rehabing still. My question is will they consider my disability fixed and reduce my rating? Thank you. I have only been evaluated once and did it on my own.

    Where I could find on my healthy benefit or anything like that? That would tell me how many years I have because I'm coming up on my 5-year and I don't know if it's going to be this year or the next and I'm really worried until at least the 5 year is in effect
    Also, a friend of mine wanted me to ask if you have the 20-year rule and you are incarcerated. Does that overrule the Congressional order that you cannot lower the rating past what it's been for the past 20 years??

      The 5-year portion is predicated on each condition, so you could just see when the effective date was granted for that condition, and that should give you a general idea.
      The incarceration question is a really good one... I am actually not sure, as I have not come across a mention of that in my research. Still, if I had to guess, the incarnation would override the 20-year rule, just like it overrides all rights outside of the 8th Amendment. That is just a guess, but I will look into it and get back to you.

    The problem with going to the reevaluation is that they're pretty much out there to deny, that's their sole purpose (tell yourself what you want, but this is the safest and most logical assumption- prepare for the worst and hope for the best). But, you don't really have a choice so go to it and have your appeals at the ready. And most importantly, always maintain your appointments and never tell them you're "OK", be honest about where you stand and if it's bad then complain complain complain, every time you go to the doctor. Bring up the issues you truly have and make sure this gets in the notes. If they don't annotate it then call your team and leave a message stating that x, y, or z didn't make it into the notes and you just wanted to make sure the doctor noted your condition. Use the VA messaging system because this definitely gets into your C-file. Protect your ratings, it's a non-stop gig.

      Ya it's horrible to live disabled and the va is full of people that hate you because you got injured they want you to work in pain with no arms or legs

    I do get TDIU and would love to know what other programs out there to help me with Assistance. I was told that I am getting paid at 100% and looked as such when it comes to VA Heath but while all that is good and all it does not hard to know what other assistance is available and where.

    If i no longer wish to seek treatment for certain conditions because theyre not worth it, is that a problem st P&T? I have a foot condition and the inserts just make my back hurt more, and id rether just use OTC gel inserts but i dont want that to look like im magically cured.

      If you use VA healthcare, I would tell my doctor exactly what you just said. They inserts hurt your back and you buy them over-the-counter that will be in his notes and part of your medical records. If you use your private insurance, I would inform my private doctor that the VA inserts, cause me back pain and I purchased them over-the-counter this way you will still have doctors notes that support your claim that you are continuing treatment just at your own expense. This is exactly what I do. I get treated for my back with my private insurance but once a year at my VA appointment, I inform my VA doctor of all the treatment I had and he put it in his notes, there is evidence for the VA.

      @@Kenbot2 ok, I'll do that. I know that the VA technically isn't supposed to rate on treatment,they're supposed to retenon symptoms, but I don't want to cause any unnecessary issues for myself. There comes a point sometimes where all you can really do is take the meds and cope. As I get older, that's how it is more and more. I might not for surgery in then future, but it's not in the cards for me right now.

      @@DopamineSink no problem. I agree with your statement that the VA rates symptoms not the treatment. Look at it like this you are seeking treatment because you still have the symptoms. Just like your medication always refill them because that is treatment for the symptoms you continuously have.that will always be my strategy and I will always have evidence that says I still have the symptoms. Good luck and I hope you are doing as well as possible.

    What if all your conditions but one are static? Can a T&D still be granted based on majority of conditions being static? My only non static condition is migraines, with no improvement (actually unclaimed worsened symptoms) in over 15 years.

      At 93, you are good to go no matter what. With the 55-year rule, you should be okay with your conditions and not worry about reductions.

      🤣🤣🤣🤣 I’m 60 not 93 I’m at 93% I’m waiting on a response now for a comp increase for a shoulder injury with 3 surgeries I’m at 20% on my right shoulder just for service connection

    My VSO emailed me my Ratings Code Sheet, but I'm questioning where to find the actual rating percentage number. Is it already rounded up, or should it list an actual number (for example 37%, 23% etc.)?

    Well if you're TDIU and working then you don't need TDIU

    I am not sure how I am able to keep a 100% when I am not even sure how to even get it 😂 I try to watch videos and they do not make sense. Nothing about the VA makes sense

      The VA rating system is the equivalent of several math problems that are bogged down by bureaucracy. It's complicated on purpose.

      They will always make you drive hundreds of miles for appts and for revaluation if you miss any appt they will drop you to o

      @@Harlem139Convent1 True do not file for another claim if you're 100% P&T static, just continue making appointment and receive medications, VA can also open your file if they see fraud, if it's physical they usually don't open your file.

    Every day you live as a disabled veteran you live or die homless dead from the street all depends if someone puts what ever in your file its a life of fear disabilty and pain, poverty hell, i should have never volunteered they have murderd me

    I just received a decision letter last week with 16 different claims items from New to Requesting for Increase. They were all favorable and positive findings. Yet, NO WHERE on either form shows the words "Static" or "Dynamic" anywhere at all. So where are you seeing these specific labels?
