    In Dallas County judges are no longer requiring tenents to even pay a months rent with the court registry. So be careful. They are sending everything to County Court. And that is another 3 months. Owning property is almost impossible in Texas now.

      There's at least one court in Harris County doing the same thing, and I'm not sure how they justify this.

    But, what about a pauper's affadavit for just any appeal. My situation is not an eviction, its a judgement that this guy is appealing.

    I have a case where my tenant never paid the first month into the JP registry and never paid rent into the County courts and the Judge did not care. I asked for the writ of possession and was told they would deal with that at the court date. We are not set for another two months.
    So Warning... they don't always pay the 1st month's rent into the JP Registry and the Judges don't always care about the law. Judges have too much control over things. The courts have done everything to help her and don't care about what the law says or the damage to the landlord. The tenant even received funding from rent relief and kept it. Again the Judges and Courts don't care. The legal system is a joke.

      Thank you for sharing your experience. The law says what is says. However, someitmes it’s all up in the air until the judge makes a ruling.

It has been a shock to me how much of a difference between what the law says and what those charged with administering it do with it. I always believed in the rule of law. Now I know justice is just a concept. Stay Blessed!

      @@sanchezhandymen3444, just to be clear, did you attempt to set a hearing on the issue of nonpayment? Did you file a motion with the court? This is necessary on the county level. Which county by the way?

      @@LandlordAttorney Yes we filled landlord sworn affidavit in JP court then again with the county court. The Judge said he would deal with it at the trial and ordered us into mediation. The tenant is vacating as we speak but plans on keeping her broken-down car in on the property.

    What happens is they decide to appeal the writ of possession after they paid their first bond and missed the second

      There is no process in Texas for a Tenant to appeal the Writ of Possession. If they fail to pay into the Court's registry as directed, the Court can issue a Writ. This Writ can be stopped with a Temporary Restraining Order if another Court finds that there is otherwise some judicial error, but that action is rare.

      In Texas, the same eviction rules apply. The problem, however, is that a squatter doesn't owe rent, so they can generally appeal for free. This can get tricky with setting a bond in the County Court.
