    0.24 "I do feel like I have a social responsibility..." ^^^THIS^^^ Considering the movement to longer have evictions on credit reports, a separate suit seems like the societally responsible thing to do, even if you never see a dime from it. If most landlords would do this, it would go a long way to improving professional tenant issues.

    I sent 3 notices to the tenant since June to change their Zelle payments to mailing me certified funds due to non-compliance of the lease and chronic late payments. The tenant continued to send payment via Zelle. There is a clause in the lease that states 3. RENT: Tenant(s) agrees to pay Landlord during the Lease Term the monthly rental amount, paid in advance of each monthly rental due date, beginning with the second month (first month collected at move-in). Landlord may require installments to be paid with certified funds or money orders in a single payment. Rent is only paid when received by Landlord. The tenant never follows the lease. I had my bank suspend my Zelle profile after Zelle continued to have my phone number and email on file. Payment is due by September 1. If the tenant contacts me, which I doubt he will to make payment, I won't evict. If the tenant does not, we serve the tenant with eviction.I provided plenty of notice and communication only for the tenant to ignore my demands.

    What if the notice of termination for non-payment of rent has a date that’s different than the actual delivery date via police officer plus the zip code is wrong?

    What do you recommend for a landlord to do if a prospective tenant has a credit score of 625 and has just graduated? The tenant recently found a job, which is why he needs to rent a place in a different state where the job is located. Should his parents be co-applicants? Should I ask for a W-2 form? What documents should I request from him to verify his income/info? How can I protect myself from fraud in this situation? Should I require a larger security deposit from him?Additionally, if I live in one state but the property is in another, in which state should I open an escrow account? My bank does not offer escrow accounts for regular individuals, only for lawyers and businesses. Is it acceptable to place the security deposit in a separate account that is not an escrow account?Lastly, how should I sign the lease when we are in different states? Is it acceptable to do it over Zoom

      @vilentlevale6471 First, if you operate rental property outside of Texas, I cannot counsel you on state laws or regulations pertaining to that state, particularly laws regarding escrow accounts or the limits of a security deposit. As for security, you might want his parents to sign a personal guarantee of the lease while he builds rental history. You will want to verify his employment by calling and confirming it directly with the employer. As for Zoom, I always prefer at least one face-to-face meeting before handing over the keys to a rental. Do you have anyone local who tends to your property?

    My tenant experienced a death in the family and traveled to his home country for the funeral.He asked me for a favor - to use his security deposit to cover his rent for November,which I agreed to.However ,nine months later ,he still hasn't returned the security deposit.he keeps promising to repay it,saying it will be next month,then the month after ,and this has continued for nine months.I even had him sign a paper where he promised to return deposit by July,but he has not done so.What can I do about this situation?

      @vilentlevale6471 That depends on the terms of your lease and that agreement you made last November. If you agreed to use these funds without an adequate repayment agreement, you may be in a bit of a corner. You may want to have your case facts and agreements reviewed by a licensed attorney.

    Great videos Ernie! I’d like to ask a question based on my eviction experience as a landlord. 1. I filed an eviction at the JP court. I won the judgement. 2. Tenant appealed a few days later, Pauper affidavit. 3. I called the court to get the due date the tenant had to pay into court registry. Got the date and set my timer as to when to file for a Writ of Possession. 4. Tenant failed to pay into court registry and I filed a Writ the very next day. 5. JP court notified the constable and a date is set to enforce the writ. 6. I just found out (thanks to you) that the appeal still continues. A date is set for this trial in a few weeks. 7. By the time the trial takes place, I should have my house back but I suspect tenant will not pay into court registry if he hasn’t done it by now. My question is this: if I have my house back, do I need to go to go to trail? If the tenant hasn’t paid into the court registry, what are the chances of my getting any back rent from the trial if I do attend? It seems like a waste of time to continue the appeal if the tenant fails to pay into the court registry and I have my house back. I mean, what are my chances of seeing any back rent at this point? If I was tenant and was already evicted, I would probably not pay anything and just have a judgement against me. Curious to hear your thoughts on this. Thank you!!

      @axc34515 Once you have possession of the property, the only remaining issue is whether you want a judgment or not. If a final judgment is of no value to you, yes, showing up is a waste of time. However, if you believe you can collect a judgment from the tenant, it may be worth it to secure the judgment from the next court and then begin the collection process.     In my legal rental contract ... It does say i must gv 48 hrs notice if for inspection or maintenance. My renters say ... No. I do this 3 times and were in eviction ct and the judge stil gives into the renters. I lose with renters and i lose with the NOCARE judges. I feel like ct are to renters friendly even with LEGAL docs. The judge dont snap at me ... They just gv renters moreeeee FREEEEEEE months

      @lucyhallinan Unfortunately, there are some very tenant-friendly judges out there. You may want to seek out an attorney in your area who can advise you on best practices in those courts.

    Maybe tenants should be managed with positive reinforments instead of only negative reinforcement. My tenants always pay on time because if they do, they get fractional shares of ownership in the property in proportion to the size of their payment. If they pay double, they get extra shares of ownership, so half my properties are now actually ahead on rent, it's incredible, I never thought simply sharing the small benefits of capitalism with my tenants would work out so well, but it did.

    So what is the solution? My company called "FairShares" we help small landlords create shares of ownership for their LLC and distribute these shares to tenants in exchange for on-time payment. Now tenants have the positive incentives of ownership from capitalism, they feel a sense of pride about the property. Furthermore there is opportunity for significant growth for the LLC to become a REIT because one of the requirements for a REIT is at least 100 shareholders.

    The concept of rent is anti-capitalist and destroying our society. I offered to pay my landlord double if he would give me just a tiny fraction of ownership somehow, he said no. This divorces the concept of work, money, and ownership. Renting is "pretending to sell" and we recognize the symptoms in our society. So many people "pretend to work" because there is no reason for them to work harder, if they make double money they will never be able to own, only get one month ahead in rent.

      I don't agree. Renting is an agreement to use something someone else owns for a determined amount of time. The problem is that ownership is unaffordable for many and they are forced to pay rent which ends up costing more in the long run. I get it, you're mad. I'm mad too (i wish i coul afford a house), but you can't just go around saying things are "anti-capitalist" when you don't know what you're talking about. No one is "pretending to sell". You know they aren't selling you anything. You sign an agreement. If you don't agree, don't sign, but you might be living on the streets

The "Double Security Deposit". How do do you fill about the Landlords only being able to collect 1 security deposit instead of 2 and how do you think Landlords should move forward?

      @@GotDeals410 I think that the solution to a limited deposit is better screening and quicker evictions. Landlords shouldn't rely on the deposit as their only protection. They must be proactive throughout the leasing process.

    Most Section 8 tenants are TURDS. But I did Section 8 my master efficiency to my brother who needs handicap accessibility. I made it so for him only and he gets the master efficiency with own door and kitchenette etc.

    1999, Meril Lester of new york lived in her rental. 2015 she suddenly needed an emotional support parrot ... Now 3. The LL tried evicting her but LOST. She won $165K.this is not FAIR to other renters and to have 3 support animals and the govemt dictating our business. LL ct fees over $20,000

    When the justice court sends up the appeal, all documents presented in the justice court should also be sent along with the appeal. This is a legitimate misunderstanding, she thought the procedure of the courts wouyld have been forwarded to him,.

      That's accurate. All of those documents were sent, but, the Plaintiff probably had a duty to prepare her own marked exhibits for the court record. These instructions were probably mailed to her or posted on the court's website.

    My renter, her friend and i are doing our final walk. Closet rails has cockroaches dropings, i opened the microwave and theres live ones inside, also in ceiling light and bathroom tiles are all cracked, bugs trails outside, wood flooring all scuffed. Renter and her friend say its been like that for long time and after 2 yrs the foor is wear and tear. I took a lot of pic and bills from my pest company. But when i showed them to the judge abd how its on our rental contract .... I felt he was prorenter to no matter what i said or showed. Ernie its the jzdge who had no heart.     I3 mo ago, in the beginning, i talked to my section 8 renters about seeing the home and they agreed until oneday i came and i heard a dog barking. They refused me entry and i gv them notice about our initial talked about visits and how i heard a dog barking. I talked to my sect 8 and sect 8 housing keeps telling me its my rental. I tell my month to month renters that i want to end our rental but now renters are saying they will sue bec theyre sect 8 and now Calif say theres no clause rental law that LL needs a BIGGER excuse to drop sect 8 renters. So i ASK ..... Whose business is it? Mom pop rental is losing business

    Ernie I have a renter who says they can't pay the WHOLE deposit ... Is a sect 8 renter yet the state say it's discrimination and LL will be FINED so the state making me do this a do the renters. I talk to sect 8 and they said .. It's my rental yet the DA say I could be FINED. This is all double talk. So you lawyers out there in the podcast world .... What do you say when the renters wont comply yet the legal system hold us hostage? Us small mom pop business who also PAYING the city to do business in the city? Hippocrites SSSSS

      Unfortunately, unless you personally deliver the notice in-hand to the tenant, they can claim they never received a notice posted on the inside of "the main entry door."

    The problem with any eviction for any reason is that, that. Co op or owners make false claims, and the courts expect you to prove yourself, while the courts don't make the acuser prove their accusations, nor provide thier proof, other than someone claimed something behind the scenes on thier phone or computer, 75% of people are illegal evicted, for smoking, even when you don't even smoke, all this rent crap is irrelevant to the other 25% of cases, in 2024.

      Yes, you can ask the applicant to supply documentation from a licensed medical professional indicating the medical need for an emotion support animal and documentation that this animal satisfies that need.

    I've been renting a bedroom in my small home. Im in Southern California north of L.A. I charge $700 including utilities. I've tried to get first and last, but no one can come up with it. Last two times I've charged $300 cleaning deposit plus $700 rent, total move in $1,000. But I get only bottom feeders with shaky incomes. I have had people tell me they'll only give me $100 cleaning deposit or ask me to waive it. I ask for check stubs but calling employers is harder. Also, I get a lot of people who list relatives as former landlords, so I can't get a good character reference. It's too long a story, but I'm dealing with a grifter now.

      That depends on the rules of your state. In Texas, a landlord must file their Writ of Possession within 60 days of judgment, but can extend it an additional 30 days upon a showing of good cause.

    If a tenant files for appeal & inability to pay court costs form, does the tenant have the responsibility to notify the landlord that they’ve appealed? What happens next?

    In my state, passing a bad check in the range of a rent payment is a felony subject to large fines and even jail time. so I dont have much problem writing or accepting such checks.....Im a real nice guy for a landlord, I am known to be kind and generous and quiet spoken ...people simply call me "Godfather".....

      @@LandlordAttorney the eviction never took place we put in for an ejection trial never took place lawyer kept telling her she had no leg to stand on she told the judge she knows she living for free and didn't give a f she leaves when it came out her azz judge did nothing
