Divorce advice for you. Quit your job and delete this channel. Income gone. You’re too depressed by Ryan’s infidelity and have quit your job to recuperate. No income to pay alimony. Assets will have to be split. Divorce is what divorce is.

Brittany, I am a lawyer (though not your lawyer, not in California and this is not legal advice). As a long time fan of yours, I need to tell you: if you are considering going to trial, please make sure your next lawyers are VERY experienced in trials. I know it sounds obvious, but many lawyers have never gone to trial because their cases usually settle. You would be surprised about how few lawyers have actually been lead counsel in a trial. Make sure you are asking questions of your next lawyer before hiring them as to how many trials they have been lead counsel on.

Agreed. My dad made sure my mom had everything she needed to raise us. My mom was a stay at home mom and my dad worked and made all the money. He STILL made sure she stayed in the house with us/had enough money for bills, made sure she got the car, and makes sure, to this day, that she has everything she needs. He is re-married. His wife even knows that he will always make sure the mother of his kids is taken care of, and his wife admires that about him. All WITHOUT court. I have learned from him not to expect anything less. Grateful to have an honorable man as my father, and I am sad for Capri to have this example of a man to grow up witnessing. Thank god I’m Muslim, it’s really a fair religion, whatever the reason of the divorce the house is always for the wife to stay in with her children. and if the kids will stay with their mother , the husband is inforced to pay a certain amount depends on his income to his wife for his children. And the husband has no right to have any penny of his wife income or whatever she owns no matter what.

Attorney here. I don’t practice in California, but I would advise you to interview a few more lawyers for a second, third and fourth opinion. There are ALWAYS loopholes in law. Someone will find one that works for you. Be very sure they have documented evidence of beating narcissists in court.

Unfortunately, California is not an "Equitable Distribution" state. It's a community property state, and assets are typically divided 50/50 period. This makes me SO glad I live in an equitable distribution state when I divorced. No way around it - divorce SUCKS. BUT, there is happiness on the other side. I'm more content now (20+ years later) than I was while married. Tough to go through, but as the saying goes, "the only way out is through." Prayers for you, Brittany.

If you are buying that house, I believe there is a HOA Fee you will have to pay every month. If it can go up , I wouldn't buy any house or condo that has a monthly HOA fee. Not sure how close that would be to a 50/50 split, but from how you are describing the value of your channel, it may be close in value. If you are no longer generating income, or your income is (temporarily) less than his income after you give him the channel, you will not be obligated to pay him spousal support. And if he becomes the higher earner, he will have to pay you spousal support. Then start a new channel and your subscribers will follow you. But wait to start your new channel to keep your income low until after the divorce is finalized. In the meantime, do not make any changes like moving, until this is all wrapped up. You may end up complicating things further. I assume you can pay your current mortgage and living expenses on your own. I'm sorry Brittany but you will have to make some painful sacrifices. You need to decide if you want to keep the house or the channel. I'd go for the house and start a new channel. Best of luck to you.

There's a woman I watch on UA-cam who went through a divorce a couple years ago. She was the breadwinner and she also had a brand. I don't know the details of her divorce but she closed her business and started from scratch and it worked out well for her. If you decided to do this we would support you 100%.

My dear Brittany, I feel your pain and can relate 100%. I am a fellow San Diegan, and attorney. California Community Property Law is punitive towards the higher-income generating spouse. There is no legal precedence for valuating and 50/50ing this specific type of businesses. If you went to trial, you'd be making caselaw for posterity. Of course, not sure if you have the funds or the stomach to endure a trial of this nature. Only you can decide what step to take next. I have some ideas, and know few excellent trial attorneys. I am here for you, as is your community.
I’m Canadian so I don’t know how the law works there but isn’t there any change in legal proceedings if the divorce is directly related to domestic violence? I get “no fault” when it comes to most things but if one spouse is the victim of domestic violence there should be differences, in that instance there is 100% an at fault party. No sane judge would read the messages he sent her and be able to say that it wasn’t emotional abuse
CA Community Property law absolutely doesn't make ANY sense. I get it, and agree. But -- absent a solid prenup- California is a no fault state and splits 100% of the assets 50/50 with the higher income generating spouse paying for support into the future and all legal fees. For domestic violence, that would be a case under tort or criminal law, which could be merged with family law case under certain circumstances. She is saying there hasn’t been precedent (prior cases) to establish how to split a business like this UA-cam channel 50/50 (which is the requirement in California), but if she’s willing to go to trial, it could set new precedent/case law for similar cases in the future. This would be costly, but could benefit her and others in similar situations in the future. No one could really predict if the outcome would be better, unfortunately.

He even had to pay in retrospect 50% lawyers fees during my 10 years (bc I was the one paying for the trial- not him). Go to trial, fight for everything you built.
