Oscar, thanks for the explanation. The VB is mandatory to clear me to get the VB, but we have another line that isn´t mentioned in any video and that can hold the GC. This line is the backlog to schedule the interviews. After the documents are considered complete by the NVC, we need to wait for the interview schedule. This time in Brazil is more than 8 months nowadays and is another big delay in the consular process. Furthermore, if some country has more agility to schedule the interviews, they will get the anual available GC before the country who is having more backlogs to schedule the interviews. If you can, please mention these delays by the countries.

Nice work, Oscar! Could you create a video about cases where individuals submit the I-485 application after I-140 approval? For instance, those from the rest of the world who faced retrogression in Feb-2023 but are now in Jan 2024 visa bulletin become current based on their Priority Date. Some are experiencing a "case remains pending" status on the USCIS portal. Do you have examples or insights into others who've been through this process and what to expect next, including the expected timeline for approval?
Hi, thanks! I could, but probably won't. It's as easy as "just wait". You wait until a visa number is available, and then the process resumes without having to submit anything or do anything actively, just as it would if you PD was current from the start. It will be automatic. Cheers!
Hi Oscar, thank you for the video! If I plan on applying for an EB-2 NIW visa, can I file I-140 and I-485 concurrently as long as I do so before Feb 15, 2024? I am currently in the US Or do I wait for I-140 approval before I can file for adjustment of status? Thank you!
Okay, thank you! Do you happen to have a video on the process / what happens once the I-140 is approved? Meaning, what do I need to do to start working after approval?
You can't start working solely based on an approved I-140, you need to adjust status ua-cam.com/video/OTKlopGf3D8/v-deo.html&pp=ygUaYWRqdXN0bWVudCBvZiBzdGF0dXMgb3NjYXI%3D @@patrickschiwek326

When will be appropriate time to file AOS, I am in the US. I have been getting different opinions and it has been a bit confusing. Country: Nigeria. Thank you
January interview scheduling is complete and i haven't received my notice yet. I guess, i need to wait a little longer. PD: 21 October, DQ: 7 August 2023. Nigeria.

Hi Oscar, thank you for this video! Just to let you know I think there is a typo on your spreadsheet : you write January and February 2023 instead of 2024 - I think (?)
probably the biggest one is that you would be allowed to remain in the US as long as the adjustment of status is pending (which is not true for an approved I-140 only)
@@OscarsGreenCard I thought I still need to maintain my F-1 visa as long as the I-485 is pending. Or can I just use the EAD card as a reason to stay legally?
@abdo199199 I can't offer legal advice . In *general* the best course of action is always continue with a valid nonimmigrant visa until the full process is finished. But, as long as the AOS is pending you can legally stay in the US. Consult a lawyer for advice if you need it
If my pd is feb 1 2023 for eb2 row, can i file the i-485 but it wont be approved until the final action date passes Feb 1 2023? Im not interested in ead.. so should i file now or wait until final action date passes feb 1 2023? Just so i understand correctly
If you can file AOS; I would always file as soon as you can and I would always file for EAD and travel document even if you think you don't need them as of now. Put them in a drawer. They are free to request (this will change in a few months!).
technically, no, according the the definition you can read in the visa bulletin: "Numbers are authorized for issuance only for applicants whose priority date is *earlier* than the final action date listed below"

I think they messed up table b in January.. because when I checked it back in December the dates were different ( I remember for China eb2 it was having Jan 2020 date, and in lawfully historical comparison shows the same) 😮 And I think even in your blog post abt January you can see different date for China eb2 (so it actually moved 5 months), that being said, looks like other dates haven’t changed, so they probably missed that somehow😅

The table to check changes each month, you need to check for the specific month using the step I explain in the video in 11:20
I was looking at the approval percentages and they have decreased significantly (72%) in the last quarter of the fiscal year. What could be happening?
Yes, I talked about it in my latest video on approval rates

Hello Oscar, shall we always follow table A for Consular processing?
Table A is the only one to follow if you want to understand if a visa number is available to you, both in Consular Processing or Adjustment of Status

a few months, it varies case by case
