      It keeps you from getting charges that will stick, like battery on an LEO or resisting arrest, the second one less so, since the arrest itself was unlawful.

      In most states it's illegal to resist even if an arrest is unlawful. In egregious cases like this they will usually drop the resisting charge but technically they can still try you for it even if all other charges are dropped, which is ridiculous

    This whole let the courts fix it never seems to really work. This impacts the poor at an alarming rate. Years of legal battles almost never work out. Legal Costs and so on AGs, DAs keep charges on the books to try to drag it out. The penalties for the state actors MUST be greater. Or nothing will change.

      @@markbrown8097 I was poor & needed a lawyer for a landlord that was trying to kick me out of apt unlawfully. I went to a place that gives free legal advice & also lawyers that help people free of charge. I was able to get a lawyer & that lawyer was also teaching other new lawyers so he brought 5 other lawyers with him. So I walked into court with 6 lawyers for a landlord/tenant case. It was hilarious seeing my ex landlords face. He immediately dropped everything & I moved out a few months later anyways but was so satisfying. In most cities, they have places like this that'll help people for free. And if not, if lawyers see a case is cut & dry knowing this person's rights were clearly violated. They'll take the case knowing it'll be a win & take their payment when case is won. Dude was obviously arrested along with an unlawful entering into home which means the arrest was unlawful too whether he had a warrant to be arrested or not, there was no warrant to enter which makes anything after that unlawful. He'll 100% win & get a payday. Size doesn't matter bc either way, he'll win something & lawyer will win something as well.

    So, if his window was open the same rule applies? "I climbed thru your window because it was open... oh, and now you're under arrest." No qualified immunity. Sue the PD and this guy personally.     “You won” Interesting. Let’s see what “winning” looks like:
    - Arrest, fingerprints, mug shot, jail all now on your record.
    - Every time you encounter law enforcement, your record comes up, and augmented.
    - Criminal charges to fight, with months to years out of your life, and legal expenses.
    - Likely career suicide, due to above.
    - A civil suit to compensate for the egregious violations (more months and years, but must wait for criminal adjudication).
    - Cops get qualified immunity by default.
    Cops beat James King into a hospital 10 years ago, and other than acquittal of the criminal charges (yes, they charged him with felonies for getting beaten unconscious and paid 6 figures for a lawyer), SCOTUS ruled he has no civil case, due to qualified immunity.
    This is what “winning” looks like in this country.

    I recommend saying "I would like you to leave my property, this is no longer a consensual encounter" and then get illegally arrested. Having it clear on video dispelling any and all doubt that could be argues in court is a great way to earn some settlement money.

      You are totally right to delete the first one, but that would give the dozens more legitimate probable cause to respond and investigate the scene. They will not get a warrant and will cite exigent circumstances and it will hold up in court.

    If this happened to me and I complied I would possibly lose my job if I didn't get to see a judge for a few days, if my bond was high it could financially damage my family or be completely unobtainable depending on the amount of the bond and my current financial situation. There are way too many consequences to accept for me to just comply. On the other hand, not complying including using my 2nd amendment to address the situation would most likely end in even more immediate consequences. At the moment that cop illegally entered my house I am facing severe consequences while being not only innocent, the victim of a crime.

    Too many people don't understand this very simple concept. By all means assert your rights and make it clear that you understand what is happening is unconstitutional. And by all means demand to see a warrant before even opening your door. But once they've already made entry into your house and are making demands under color of law, do not resist in any way other than verbally voicing your objection and making it clear that you are complying under duress and without your consent.
    Physically resisting might result in a bigger settlement down the road if they decide they're going to use overwhelming force to get you to comply. But it is also very likely to result in serious injury and a very real possibility that you end up dead. Not really a gamble worth making. Let an attorney handle the fight in court.

    I get the comply and fight it in court but a lot of people can't afford to fight it in court. I got a bogus P.I. years ago and hired an attorney. Told him the details and asked if he could get me off. He said yes of course. Your options are $500 tp plead guilty and take a years probation or fight it and very possibly be found not guilty, but that will cost about $10,000.

      This is a state by state law, but in most US states citizens can’t legally resist (even if it’s illegal). Because if the citizen is wrong and it was a legal arrest, now you have resisting lawful arrest, assault and battery on law enforcement, and many more charges included in the arrest.
      It is always recommended everyone look up and study local laws and ordinances.

    Technically it would be defending your home from an intruder. If he has no warrant, he’s not acting under the color of law, which makes him an intruder 🤷🏽‍♂️

    Apparently, UA-cam has a problem with me, saying you should protect yourself and your property with deadly force. UA-cam doesn’t believe that Americans should have the right to defend themselves.

    The process is the punishment. It's so easy to say "just fight it in court" - but who has time or money for that.
