      Although that I agree the rookie officer is a liability.. The problem is nobody has rights because nobody knows the rights as you're reading this. Comment? Can you name the 1st 10 amendments of the bill of rights? Let alone the five elements of the first. Or the principles of the constitution. The principles of law. Do you own a black law Dictionary?     Sean, to be honest, I would not touch a car door handle except it was my own car. Touching the door handle of random cars , it's reasonable that you would be asked why.
    The Police Lieutenant seems a responsible person and was courteous at all times.
    The Police Officer, wasn't listening to what the Lieutenant was saying.
    It was interesting interactions between you and the Police. You did explain, clearly and concisely your viewpoints. Looking forward, to hear how you got on with your complaint.

      I didn't see him touch any cars. At least before being accused. I see him walk up and record a broken windshield and then the cop comes and accuses him of touching the cars. But before this accusation all I see is a minute of recording without touching.

      Those are our "own" cars, what do you mean? When you pay your taxes, you fund those vehicles, making them the collective property of WE THE PEOPLE.
      I get what you're trying to say but that's the whole point of what auditors do. To take away the ownership that public employees seem to take upon themselves and claim the building they work in, the equipment that is provided for them, department vehicles, all of which are publicly funded, as their own and treat US, the citizens, as enemies and others.

      In the end, the lieutenant admitted he was in effect "just following orders". Nuremberg defense. THAT is the hallmark of authoritarianism.
      It's good that you brought that up and mentioned the NAZIs Sean, as that mentality is becoming more common in America today.
      We always "hold accountable" the foot soldiers, but we never directly challenge their superiors. It usually leads directly to the top.

    This interaction really showed that the prohibition of recording in the Police station is ultimately about police hiding from public wanting to hold them accountable. Sean so clearly showed that, if the camera was hidden, they could do nothing about it, during or after the encounter. So that policy is really only geared towards folks openly recording. And as Sean has pointed out many times, folks with nefarious intentions aren't going to draw attention to themselves by openly recording. Thank you Sean for your work exposing this sort of BS.

      ​@@rickybiggie so, you're right. NYPL 140.05 states "A person is guilty of trespass when he knowingly enters or remains unlawfully in or upon premises." The unlawfully part applies if being given a lawful order by police and you don't leave.
      Trespass is a violation.

      Laws are built upon the Constitution, and policies are implementations of laws.
      Policies are the more specific and practical applications of the values and concepts presented in and protected by the Constitution, as codified by federal and local laws.
      You might question if the policies accurately reflect the laws. That is completely legitimate.
      You might question if the laws accurately reflect the Constitution. That is also completely legitimate.
      Such questions are brought before judges on the various levels of the judicial system.
      They are not hashed out with receptionists or individual law enforcement officers.

      Look bro, this lieutenant did a phenomenal job considering the circumstance that he is in. He has a job to do in order to bring food home to put on the table and he did that job well. He doesn't make the policies.     You need to do a FOIA request for the POST training to see what the training curriculum has regarding protecting constitutional rights in a Terry stop, or any other stop. I checkec our local states POST training curriculum and found several issues and contacted them.

    This lieutenant i have to say was really a nice guy but still had you removed from the building because he believed that you was videoing in the building. Yes he was between a rock and a hard place because he knew that the First Amendment allowed you to video in the building but there was a sign stating no videos allowed. Now as for the little sized Tyrant police officer before you even said a word he was yelling at you so unprofessional. He didn't even respect the lieutenant . Typical Bully and definitely a Coward hiding behind the gun and badge. You already said that you was leaving and yet the Little Tyrants had to walk directly towards you and forced you to retreat . Now if you had stopped and they bumped into you im sure that little foot would have arrested you for assaulting a police officer.       It’s usually the police chief. Auditing Erie County just went through this whole ordeal and finally after about 6 months he got the sign taken down.

      So if your wife or daughter is in the station to file for a complaint and some creep is recording it and posting it online for the world to see , will you be ok with that ?? Ppl visit the police station for a reason it’s not a tourist destination. I can guarantee you there will be more strict laws in coming months because of behaviour like this .

    WOW! I've been watching these 1-A Audits for years and NYPD is a special kind of thugs, mugs, and slugs. It's a sad state of affairs when a LEO has absolutely no respect for his superior. I would never have anyone like that under my supervision.

      Thank you, Sean, for dealing with these public failures. I wouldn't have the patience.
      These fools need to comprehend in which country they find themselves, and learn the laws foundational to the nation.
      Laws that override any policy.
      If they wish to live without the constitutional protections, perhaps they'd feel more at home *SWINGING FROM TREES* in a country without such protections.

    Great work ! Now I will say that even being cordial doesn't mean you're icing the cake " I believe you are on a one man mission looking for results for a body of free people whereas the knowingly & un knowingly can define themselves to a better understanding of their rights. Common sense goes a long way, but holding a camara to your chest just isn't rocket science my good neighbor sean !.

    Hello Sean, I like watching your audits. I am from Germany. Germany does not allow taking picture or film humans, if they disagree. This is a civil rights law and totally different to U.S. What it means to Germans nor police and not myself are allowed to film, when someone makes use of civil rights and say no to filming. Police has to accept that also, if not they get a civil law suite.

      Or....he's stuck in a system with things that he knows aren't Constitutional but can't change it. For them most of the time this doesn't come up and the drip, drip, drip of our Rights going down the drain aren't their highest priority. Sean IS changing things and somehow I think the LT might actually have been enlightened a bit by this encounter. Successful.

      @@recoilrob324 for the most part I'd agree but he was adamant on some points that were clearly unconstitutional... meaning he's been brainwashed / confused over time.. you don't become a lieutenant in a corrupt system w/o getting your hands dirty.. and I wouldn't call it an "enlightenment" but more of a smack in the face as a reminder of the oaths he's taken..

      That Lt is a total douche. He came back from getting a complaint form ready to arrest you the first time. Then he threw his subordinate under the bus when he came outside bringing you the complaint form.
      He was running in the same gear as his subs and grinded when he changed gear realizing, again, there was nothing he could do.
