So true. She didn't get it. I'm an Austrian and my English language skills are limited. But even me (I'm not a lawyer) could understand the issue of the wrong eviction papers/forms. And I was close to smashing my screen.🤯🤯🤯

I'm sitting here trying to figure out how it even makes any kind of SENSE for one person (however competent) to wear both of those hats. Blurring the line between attorney and client like that just seems like a highway to nothing good.

Judge Simpson needs to order a competency hearing for this lawyer.

Actually not correct at all. If they are joint tenants you can evict one, the other, or both. I have seen it many times in apartment complexes (usually section 8) where one tenant is causing issues and problems and they only want that one tenant gone. Judge Simpson acknowledges that at the very start then says it could cause a lot of ongoing related court cases. It's one of the things that irritates me about Judge Simpson he gets these ideas in his head and rules incorrectly on the law sometimes.
This attorney is a mess and isn't doing what I stated above correctly. Not is she explaining it well. Basically she is terrible. She is trying to hedge her bets and do 8 things at once instead of doing what she should.
If she wanted to proceed she should have argued that they are joint tenants and they are only filing against and to remove one of them (the husband) but she really wants to file against both just without doing so.
Her understanding of the law is embarrassing.
At the beginning of the hearing, I was totally confused, all that lease/rent and notice stuff was going right over my head. By the end of the hearing, I'd heard his explanation enough time that even I understood it. That woman! 🤣

If that’s a reference to service, it’s a process called “nail and mail” when it’s been difficult to affect service on someone, in some instances it can be permitted to “nail and mail” where a copy is affixed to the door and a copy sent via registered mail.
Granted, that’s only if that’s the case here.
Before everyone jumps on her to harshly, her laughing and most of what she is saying might mean she needs medical evaluation....

Lucky for her she’s the landlord and the property manager. It’s the only way she could get the lawyer job.
She's not the landlord, she's the management company the landlord (owner of the rental) hired to manage their property. If I'm the landlord, I will fire her, her management company and sue her and her management company for incompetence, mismanagement and misrepresentation.

Admittedly the plaintiff's attorney has messed up, and the defendant's attorney is milking that screw up for all it's worth.
oh yes, she definitely is! this tenant definitely lucked out. I have never seen a lawyer have this level of incompetence. I still cant believe she passed the bar.. she cant even file eviction papers correctly.

The landlord who contacted her company may have written it but with the errors in it, she probably had input. She definitely wrote that lease I’d say. I bet she passed the bar 40 years ago, and hasn’t practiced a day since. Probably a stay at home wife and she created this LLC to use her education but she’s not prepared to do it because she’s never practiced.

I practiced landlord-tenant law in NYC for 20 years, and this is one of the most excruciatingly painful court sessions I've ever heard. That judge exhibited tremendous patience.
I never thought I'd see a sovcit term used properly (subject matter jurisdiction)
As an attorney, I hate that sov cits co-opt actual legal terms to use in their gobbledygook ridiculousness. I watch a ton of sov cit videos and probably 95% of the terms they use ARE ACTUAL LEGAL TERMS they just have no bearing in the context the sov cit is bringing them up. My personal favorite (1A auditors and sov cuts use it) is "soliciting a trespass." It's an actual real thing, but has nothing to do with what they are arguing usually. The other one is article 3 courts. They fail to understand that state courts are formed under the 10th amendment which reserves those rights to the states, and that just because it doesn't specifically lay it out...

I am not a lawyer and have not gone to law school for 4.5 years. But I can see that Judge Simpson should just kick them out of the courtroom until they get the notice properly served and filed. This is ridiculous and a waste of the court’s time.

I started to second guess myself for a min because, for me, it came down to simply recognizing nothing can go forward without the properly served/filed documents. Everything else was just a waste of time.

After listening to the entire hearing, I wonder if she is experiencing early stage dementia. She is just not connecting the dots, in a very fundamental way. Also this judge is exceedingly patient. I think I would have dismissed the case and made her start over.

Geeez I'm not even an attorney and even I'm aware that it doesn't mean diddly squat if the tenants "have known all this time.." or not! What matters is if there's a notice to pay or quit properly filed and *legally served* that is before the court right now!
I wish these older attorneys would either brush up on there education or be honest with themselves and say I can’t keep up with changing laws and statutes and maybe it’s time to retire or find something else to do. Well, which part don’t you understand? I mean, the reason that the judge dismiss the case and he was arguing with her is the fact that when you evict someone you have to serve them as to why you were trying to evict them and there are different reasons for evict someone and when you file the case with the court and then send the person the wrong form, giving them notice of the lawsuit that’s grounds for dismissal.

I guess i should clarify, i have a law background, but, i an not a lawyer. Second, renting to a married couple as independent rentors, then, evict both but then drop one of the married party because the husband asked, then evict the husband but continue to rent to the wife. So, i reiterate, this makes no damn sense. I have been following judge Simpson for quite a while, and he acted completely sensibly.

Honestly, she’s so incompetent that I’m not entirely convinced that the Complainant(s) and she are in good standing. This reads as a “Missing Missing Reasons” situation to me. I would not be surprised in the slightest if it were/will be revealed that they were not actually in arrears.

Yup, I think she believed that they are the type to leave so they don't get a judgement towards them.... But what she's really dealing with is scamers who are going to drag it as long as they can, so she's going to have to get it done correctly

I have my doubts they are "deadbeats", considering how incompetent she is. It's all her.
It appears they've been withholding payment due to incompleted repairs, a violation to their lease agreement (which is held by the lawyer apparently cos she owns the company that owns the house or something) and she didnt serve notice to the people living in the building, just one of them, which is dumb. Cos Judge Simpson could in theory evict the husband.
But he'd still be allowed to live in the house with his wife, so all that would achieve is get him kicked off the lease, which wouldnt achieve the remedy of removing non-paying tenants, so it becomes an ineffective remedy.
Annnnddddd on further watching, she hasnt even filed the correct notice to have any of them evicted for non-payment, she's done this before and filed the notice incorrectly then as well

Did they check to see if she actually graduated from law school? At times, hard to see where she was going with this case.

I'm not a lawyer but have been a landlord and am now a tenant. I'm currently helping my landlord evict a tenant who went to prison, it's complicated but I talked to RCMP, court sheriff, court clerk and landlord tenancy branch (law in my province). Got all kinds of free legal advice and we are removing the tenants property next week, (have to store it for 60 days) and readying the apartment for rent April 15, it is not rocket science.
For what reason are you evicting the tenant??

Her way of doing things sounds like a way to double dip. First you Go after him, get a judgment for X amount. Whether he pays or not, you go after her for the same amount. Then you have two separate orders for the same amount instead of a single joint & several order to be split.

In NC, a Plaintiff must file the complaint in the name of the property owner with the property management company as the agent/by and through. And ALL tenants must be listed as the Defendants. if it's not filed properly, it will be dismissed.

@@calinasagilitypartner4444 Could be chemotherapy. Definitely not a dentist chair as she is eating. I don't think they are allowed to eat during dialysis so I am definitely going with chemotherapy also as she is wearing a headscarf possibly to cover hair loss
