I put it all in another comment. But he should NOT be practicing law from the bench, or medicine as in another case, or anything else. He's right to question jurisdiction, and in my experience, it should ALWAYS be challenged, because they always think they have it, but many times they do not have it, as in my case, or in Idaho, i went through about 100 cases and 98 of them did not have jurisdiction. the respondent was NEVER NOTIFIED. And people were put under guardianship, estates stolen, they were kidnapped, and drugged, and many have died. Everyone should always have the judge confirm jurisdiction. • @ssw7282
      @ssw7282 Місяць тому +1

      Actually, you have to be competent to stand trial. if you don't understand, you can't stand trial. he's using a technique to not put himself under the jurisdiction of the court. The judges and the police have to ask if you understand the charges against you. they cannot try you if you say you don't understand. So, it's a technique he's using. He's not stupid. This relates to a fundamental concept in criminal law known as competency to stand trial. He's also right that there has to be an injured party, and it can't be the government. That's why he was asking about the injured party.
      Key points:
      1. Competency requirement: To stand trial, a defendant must be able to understand the nature of the proceedings against them and be able to assist in their own defense.
      2. Due process: Trying someone who doesn't understand the charges would violate their constitutional right to due process.
      3. Competency hearing: If there's doubt about a defendant's ability to understand the charges, the court should order a competency evaluation and potentially hold a hearing.
      4. Duty to explain: The judge and/or the defendant's attorney have an obligation to explain the charges in a way the defendant can understand.
      5. Interpreter: If language is a barrier, the court must provide an interpreter.
      6. Mental health: If mental health issues prevent understanding, treatment may be ordered before proceeding.
      If you're in this situation, you have to
      - Clearly communicate your lack of understanding to your attorney and the court.
      - Request further explanation of the charges.
      - If needed, ask for a competency evaluation.
      It's crucial that you understand the charges before proceeding to trial. If a judge attempts to move forward despite your expressed lack of understanding, it could be grounds for appeal.

    • @ssw7282
      @ssw7282 Місяць тому

      @@kristophsams5036 While a college education can certainly be valuable, it's not the sole determinant of legal competence. Competency to represent oneself or understand legal proceedings is assessed based on current mental state and capacity in the moment, not just educational background. Various factors can affect a person's ability to comprehend and participate in legal proceedings at any given time, regardless of their education level.
      It's important to note that judges have a responsibility to ensure all parties understand the proceedings, whether they have legal representation or not. This isn't about intelligence, but about protecting individuals' rights and ensuring fair proceedings.
      The complexity of the legal system often makes professional representation advisable, even for well-educated individuals. However, the right to self-representation is an important principle in our legal system, and shouldn't be dismissed outright. Since I won my own case pro se after using 2 different attorneys who kept trying to lie about me, and then in my small town, no attorneys would go up against this judge and two former prosecutors, I did it on my own. My neighbor had a similar issue and won her case as well, and she's not the sharpest tool in the shed.
      Ultimately, competency in legal matters is about current capacity to understand and participate in proceedings, not just educational background or general intelligence. It's a nuanced issue that requires careful consideration on a case-by-case basis.

      @@mars353 , If he wants to go through life without a job and be broke that’s on him. If he one day goes on probation part of probation is getting a job, if he doesn’t he will be sent to jail. Again that’s all on him.
