How Can I File Bankruptcy if I Have No Money

  • Obviously if you are considering bankruptcy, you do not have much cash sitting in your drawer or in your checking account. How, then, can you afford to actually file bankruptcy.
    Thanks to Congress and the Bankruptcy Courts, the process for filing bankruptcy has become much more complicated and burdensome over the past few years and the cost of filing has gone up. The courts have raised the filing fees to the $300 range and because attorneys are required to do more, legal fees have also gone up.
    As I discuss in this video, you may not need to file at all if you are truly judgment proof. If you are at risk for wage garnishment, vehicle repossession, mortgage foreclosure or bank account seizure, you have to make a decision. Is it worth $1,500 to $2,000 to get rid of $75,000 to $100,000? Is the short term pain of giving up cable TV, cutting back on dining out, or even getting a second job worth the long term benefit of becoming debt free, protecting your house and car, and living with peace of mind?

    I always thought bankruptcy was the option for those with no money. I see now there are no options for those with no money. Life sure is fun these days

      Correct me if I'm wrong, but he said if you make nothing and have no assets , (living off social security, unemployment, disabilities, etc.) You are judgement proof. And that you only have to write "drop dead letters" I'm guessing a letter saying you cannot afford and will not pay any longer.

    I have absolutely nobody I can borrow from and I work over 60 hours a week normally. I have no way to come up with the $1500 to file. It’ll take 7 months or more to come up with the fees. I’m only in my situation with a secured loan because I ended up with a Covid blood clot which left me out of work for 4 months. Was only $4000 in debt before this paying off a car. Now I’m under $22k because I had to put my car title up to get money to cover back bills and rent. Guess I just get to go through that near death experience and damage from the clot and pay for it now. Thanks Covid

      soooo sorry to hear this, im kinda in the same boat. covid took alot of folks from there jobs... meanwhile ... the bills keep rolling in... its just not fair.

    I had a judge once tell me , I don't get due process, and he didnt care if I sold drugs or stole things but I better pay my civil punishment or go to jail. No kidding. Thats when I realized we live in a defacto state

    Vitally helpful. And I filed
    March 7, 2018.....83 pages and I am relieved I filed....currently waiting for my 341 Meeting with the Creditors. I am unemployed and was worried. But I'm again glad I filed

    The title states "how to file bankruptcy if you have no money" and he advises to beg, borrow, or sell everything???? Just get me the money any way you can. No mention of filing application to waive fee or make payments. Would trust this firm for anything.

      You can file an application to waive fees for the filing fee but the BK Courts will not allow lawyers to take installments on legal fees. Once a case is filed any pre-petition obligations (which includes legal fees) would be discharged. So unless you can find a lawyer who wants to work for free, you have no choice but to save up for the funds to pay for counsel.

    It's always mind blogging to me that you have to have money to pay for bankruptcy. I get that people are doing work to deal with the legal and financial side of things with creditors but I have no friends, no family. I have literally no assets, I have literally no money (if my life depended on me going out and buying a stick of gum I wouldn't be able to). No savings, no 401k. My car got repossessed. So, there's what. Just nothing I can do? Wow amazing lol I love it. 🤣 Not that it really matters I'm probably gonna be homeless soon anyway so oh well. It's still just funny.

      I would tell you to talk to your elected representatives. Back when I started my practice, the filing fee for a Ch. 7 was $60 and the going rate for legal fees was $500. By adding the means test and requiring extensive documentation Congress has made even straightforward bankruptcies complicated, and thus more expensive. And I will also tell you that in most jurisdictions the judges limit the attorneys fees they will approve. So I don't think that attorneys fees in this practice are being driven up by lawyers, but by the extra paperwork and complexity of the cases now called for by the bankruptcy laws.

    I have a disability claim, I hope to get approved, I have severe bi polar 1 disorder. I have $3,000 in credit card. debt. I dont ever plan on working again. Volunteer or work very fews hours. Should I file bankruptcy. I am thinking I have to. I have no assets.

      If you have no assets, send your creditors a "drop dead" letter telling them that you are judgment proof and your only source of income is Social Security which cannot be garnished.

      Generally speaking, credit card companies will not negotiate until you are delinquent 2 or 3 months. Every lender is different regarding what they will accept. Re attorney's fees - the market is competitive enough that attorneys charge what they feel is appropriate for the complexity of the case without regard to a potential client's assets. In your situation, for example, I would be more concerned about the impact of a cash advance or recent loan when there may have been no realistic expectation of repayment. That could lead to a creditor objection which is an added complication. In such a case I would quote a fee based on no anticipated litigation with a provision that in the event of an objection to dischargeability, that work would be based on an hourly fee.

    My problem is I am unable to work and receive 1312.00 a month in Social security and I have a car. I can make payments yet I am not going to the Payday loans to get out of debt. Most attorneys will not take payments. I will not ask my friends for money.

      Dan, your Social Security money is protected from levy (seizure) by credit card and other judgment creditors (with the IRS and student loan creditors being an exception).
