    I agree on that DNA used from the rape kit is immoral and unethical. Victims consent to the collection and use of their DNA to solve the crime perpetrated against them and expect it not be used against them. Benson is right on the ethics of what was done because use of the biological evidence in that way will make it so victims hesitate to report the crime committed against them and it destroys the trust they have in the people helping them. I understand why Benson was a witness for the defense. The defendant didn’t need to kill the guy. It was an act of retribution. Benson’s testimony offered insight into the circumstances that led to the murder, but in no way did it absolve the defendant of her actions. In the end Benson acknowledged a crime was committed, and did encourage the defendant to take the deal offered downgrading the charges to Manslaughter and 10 years imprisonment as opposed to the much longer sentence when she was convicted.
    In this episode, things weren’t black and white. It makes you think. I am glad in the end that Baxter made the decision to change policy so victim DNA isn’t used against them.
    This is an interesting topic. I agree with Benson that the unethical practice is wrong. The DNA submitted from the rape kit does not waive their Fourth Amendment rights. Getting evidence in this unethical manner is simply getting it by any means necessary is saying the ends justify the means. This is an interesting topic to say the least. In real life, I can see this going to SCOTUS. It would be interesting to see how the justices interpret the Constitution and how they would rule. If it comes at some point, I hope the justices think about the consequences of their ruling, especially if they rule in Constitutional. Like victims hesitating or refusing to report a crime perpetrated against them out of fear the evidence they consent to provide be used against them when they find themselves at the defendant table.

      @@carlamurphy9328 but wouldn’t you argue that if there was no other evidence present and you can’t cross out a suspect in a murder wouldn’t this unethical choice in using the dna from the rape kit justify it? Like I said it’s definitely not an ethical choice however this is a very specific case where maybe the evidence wasn’t otherwise available to convict therefore there was little choice. Here’s the flip side to this: if they DIDNT use the DNA from the rape kit, the murderer goes Scot free even though the detectives may know it was her but couldn’t prove it. Wouldn’t that be equally unethical?
      As I also pointed out in another comment, how many rapists go on to be murderers? If they weren’t a murder suspect I’d think their personal information wouldn’t have been used 🤷🏻‍♂️

    Really interesting episode. Benson was right about the morality/ethics of the DNA system but WAY off when it came to trying to full out excuse the woman committing murder because she’d previously been through hell. The guy was obviously a creep but wasn’t a threat to her in the moment that she shot him.

    Benson was right to use rape victims dna was unethical / but this time rape wictim totally crossed the line / she commited cold blooded murder/ the murder victim wasnt attacking her / didnt have weapon / they were in public place /the victim didnt have criminal record / wasnt on drugs / drunk / aggresive / wasnt her rapist /

    Gotta go against benson on this, it shouldn’t matter how that dna is collected the person willingly gave consent for the dna, and if she doesn’t want that used against her maybe she shouldn’t murder people… Benson is always too blinded by victims and can’t understand that victims can be perpetrators to and they must face the consequences of their actions

    Once your DNA goes into the system it's there to stay. Benson may not want to believe it but privacy and confidentiality are long gone.

      Yep and it’s even worse in the post-9/11 era, because any agency-state, federal, local can and will use such information if they have the faintest idea or ability to say they “think” you are connected to terrorism or any other inherently political action. Protest forests getting cutdown or oil pipelines going through a reservation? Ecoterrorism. Protest NYPD/LAPD? Anti-police terrorism. Protest controversial public health measures? Anti-public health terrorism.

    She was soooo wrong. The Murderer didn't have cause to kill. She just wanted to get revenge ‼️‼️‼️ Probably a Narrative within the show.
