  • Bike lanes are for BIKES!!! How many times do I talk with pedestrians, asking them to NOT walk into a bike lane like its just another part of sidewalk!
    My Sunday ride ended in ER because of this man who just did not care to look where he is going, everything happened within 2 seconds, and the rest of the week is very different for both of us!
    PEOPLE, STOP WALKING INTO BIKE LANES WITHOUT LOOKING!!!

      He wasn't even trying to look. He was checking to make sure his car (Black Nissan Rogue) locked when he pressed the clicker. He was completely oblivious of the bike lane.

      Nope , shared blame between idiotic road engineers and idiot cyclist going far too fast for the circumstances ; having parked , the gentleman is entitled to get to the footpath , oh , and with strict liability , the cyclist is at fault ; pedestrians have priority over cyclists .

      @@derekheeps1244 strict liability in a bicycle collision?? Wouldn't that defend the cyclist? I don't know which to judge you'd be able to argue that. Google duty of care and maybe rethink your position.
      There have been cases where a pedestrian has walked out between parked cars and into the path of a *speeding* car and STILL been found liable. It's nowhere near as black and white as you're trying to make it seem, especially given the video evidence.

    Looks like there's some people who think the cyclist is at fault, some think the pedestrian is at fault... Why is no one blaming the street design? Who puts an unprotected bike lane right next to parked cars and their opening doors? It's just a recipe for disaster...

      As a cyclist, I blame the street design, from the pedestrian POV it looks like a faded green walkway, you don’t see the bicycle markings nearby. For the cyclist he could maybe be a more cautious considering the bad design and keep his hand ready on the break, not his fault but could have lessened the impact.

      @@MorganBrown how hard is it to just make a slight buffer of 20-30cm between the parking spaces and the bike lane as well? Just make the vehicle lane slightly narrower and the sidewalk too. That's it.

    The guy stepped into one way cycling traffic and looked the wrong direction. Imagine you do this on a one way street with cars. He was lucky.

    This is the creepiest bike infrastructure I can imagine. No matter how inattentive the pedestrian was, accidents are certain in such set-ups.

      I agree that this type of bike lane only makes sense for riding at walking speed. These guys were riding fast enough to merge in with traffic and that would have been safer overall.

    I see a lot of comments here that are talking about me being the bad guy here... clearly you’re not cyclists from New York, but just to put some comments to rest, both the Police and Insurance company put the blame on the pedestrian for stepping into the lane without looking.
    If a pedestrian steps into a car lane a 1.5 second before he/she being hit by a car, it will be their fault especially if there is a video recording of it happening.
    I am a driver, cyclist and a pedestrian, I wear my brain in respect of who I am in the moment.
    As a driver and cyclist, every time I am behind a wheel or handlebar I can only hope that pedestrians will be smart enough to look before they walk!

      " that's what happens when you don't look at where you're going" which l completely agree was the fault of the pedestrian, there is no argument about that, the guy wasn't even looking the correct way the traffic was heading for a start...I wouldn't worry about those idiots on here who are obviously clueless or blind to facts!

      You don't place a bike lane behind the parking spots. Building a street like that provokes this. Just as having a bike lane at the side of the car lane will ALWAYS get bikers killed by turning cars. The fool is the city planner.

      @@grahvis again , this underlines the stupidity of a narrow lane just inside parked cars , with no space to leave a doors width as you pass ( a legal requirement here in Scotland ) . What a stupid setup ; all victims of this should take out a class action suit against the road engineering department who set this up ; it's crazy .

      @Rye Bread constant threat of being doored, and even bigger threat of pedestrians/car passengers mindlessly stepping into the bike lane, as this video showed so clearly. And to be fair to the pedestrians, the bikes are really not obviously visible. If you've never gotten out of a car in that location, you might have no clue that you're stepping into an active bike lane. It looks like a sidewalk, after all. I think this is a fundamental case of American city planners trying (admirably) to co-opt the Dutch model of segregated car/bike/pedestrian corridors...while having to please another, more powerful, master - those lobbying for more on-street car parking.

      Some people really lack compassion nowadays. Nobody bloody stopped to even check on them.
      The blonde woman going by in the last second is what most people do, looks at them as not to totally ignore and to show some sense of concern, but keeps walking on to the point where in their head won't make sense to stop as they are already far away from the incident, "let someone else deal with it"

      ​@@DvlDg585 Parking a car near the road makes no sense to me personally. It is a private property in a public place. I don't remember ever parking a car outside the parking lot. It just blocks access to firefighters, ambulance, taxi drivers, etc. If the city placed bicycle stands there as in the Nordic countries, the pedestrian would be visible.

      @@dondada7643 It's not about always putting into practice what I've said, but the concept should be quite convincing in order to make people following the rules, since they aren't evolved enough to think whether their behaviour could result annoying or disrespectful (or even dangerous).
      If they don't love you, they'll fear you. It's the concept at the basis of laws and regulations; yet nobody complains about laws. Furthermore, laws are made to grant freedom and safety to people, therefore, if you're obstructing my way (for example) because of your bad attitude as pedestrian, hitting you harmlessly may pass better the message of respecting other people next time, because now you are aware of what might happen.

    As someone who has taken a dive when a pedestrian ran into the bike lane (2x), I feel your pain. 2nd time even bent my breaks, went ass over tea kettle because a child ran full speed into the bike lane from behind a concrete barrier. Parents grabbed the kid and ran before I even got off the ground. Hopefully that man got a good talking to from the cops after he was checked for injuries.

      Yeah, I was wondering about that. Pedestrians in the crosswalk...it's a bike lane not a cycle track. Just like driving a car, there are sometimes just going to be people in the street in a city. You stop for them.

      It's a bike , not going that fast , once he said Woo he was a car length, 3m , away and avoided using his brakes
      1.5-2m is more than enough to come to a complete stop with that thing,
      he didn't give a care because it's "his" lane. Imagine a car doing the same ..

      The rider had already woven his way at high speed between pedestrians on marked crossings. Remember that cycleways are provided by the city authorities who are answerable to their electorate. If cyclists ride in shared spaces within showing due care, attention or consideration for other people, the cycleways will be closed. How can one person be more important than the dozens he abuses every time he switches on his camera and goes looking for trouble?

      @@daifromwales9543 the previous pedestrian were crossing the intersection at a red light (for them) so they weren't allowed to cross at that moment, so jaywalking . But hey, it's Brooklyn/NY manathan area and pedestrian are all over the place as seen in this video.

    People are stupid. That's why I have a loud two-tone bell on my bike, and I try to foresee dangerous places as good as I can. I ring the bell when there is the possibility of someone stepping into my lane. It's kind of lame to find out there's no one even there, but it saved my day once or twice.

      @@MorganBrown there are several brands in the market. I used to have an Electra branded one, which was quite nice. It got destroyed in an accident. Now I have a no-name Chinese one, that is as good, but hasn't got the Electra design. You can find them online, just search for ding-dong bells.

      Agreed, both at fault but the cyclist did have at least 5 sec to react but didnt, perhaps he wasn't looking around either - whole thing could have been prevented if the cyclist was more observant.

      @@TruthHurtsFAFO You were travelling between parked cars and a pavement. This is an area where you will find pedestrians crossing either side. Riding with blinkers on is asking for trouble as well as assuming you are the only person allowed to use or cross the cycle lane.

    I wonder where was the cyclist looking. He had enough time to break but didn't reduce the speed a single bit. Some cyclists ride the bike lane looking down like if they where on a road.     The pedestrian was looking in the wrong traffic direction. He was looking left when he should be looking right. Impossible for the biker to check for pedestrian coming from behind a car unless someone expects the biker to look through the car's windows but bike brakes do not work that great. Pedestrians treat the bike lane like a sidewalk. This is why many NYC bikers say it is safer on the road than using bike lanes. You are kind of locking a biker within a 4 foot range between cars and curb too where on the road a biker has a wider route to avoid accidents.

      as a mtber it's not hard to check for pedestrians coming from around cars. riding your bike you have higher vision than most cars on the road. i'm just glad i don't ride in new york. looks stressful as hell just waiting for pedestrians to jump out on you. always gotta have your fingers on the brakes

    Pedestrians in bike lanes are worse than living in a city with a total of 500m of bike lanes... Also something similar happened to me once, so I can almost feel the road rash you must've had on your skin, old woman stepped onto the road right in front of me, got hit in the stomach as I went sliding for about 2 meters, had red spots on my legs and arms for a week! Thankfully the woman was perfectly fine.

    I do not know what the rules are for pedestrians and cyclists in America , but it seemed to me that in this case , despite the pedestrian 's inattention , the cyclist could perfectly have avoided the collision .

    In my state the law requires bicycles to have a BELL to warn pedestrians. And brakes that will "lock" the wheel in motion.
    Who pays attention to them?

      And your point? Sure, a bell may have helped, but think about it for a second. The cyclist didn't see the man coming, as he was obscured by parked cars. A bell would have been completely beside the point in this case. Once the pedestrian appeared, the cyclist would first move for the brakes, not the bell.
      Alternatively, are you saying the cyclist should ring his bell continuously? JUST in case someone was going to pop in front of him? Would THAT have prevented this collision?
      But then continue that train of thought. If cyclists were required to have constantly-ringing bells to warn others, the city would be filled with unceasing bike bells ringing all the time. People would quickly become accustomed to this noise and simply stop paying attention. (Like car alarms. I remember how we used to jump when we heard them. Now we immediately disregard them as urban noise.) No, constantly ringing bells aren't the solution either.
      So even though a bell might have helped, it's still on the pedestrian 100%.
      And a locking wheel as required by most state vehicle codes is irrelevant. The incident occurred so fast that a locked rear wheel wouldn't have prevented the collision. Given the laws of physics, a locked (rear) wheel wouldn't have appreciably slowed the cyclist to mitigate the forces of the collision. And a locked front wheel would have simply injured the victim in this case, only worsening the outcome for him.
      Plus, there's no requirement that a cyclist brake IMMEDIATELY when a hazard appears. Cyclists, like drivers, are scanning their environment, watching for road hazards, looking in various places. This cyclist's attention could easily have been elsewhere when the pedestrian appeared. Half a second is all it would take to clock the pedestrian without giving the cyclist the opportunity to brake.
      Case in point: I had a COMPLETELY clueless driver swerve out of her lane of traffic and into ME in a bike lane. She didn't look, signal or make a safe lane change. It happened when my hands were on the flats of the bars. I had to serve to avoid further impact and going down. As I swerved, I assumed I'd hit the parked car up ahead at the curb because my hands weren't near the brakes. I didn't think I'd have enough time to move my hands to the brakes and stop in time. But it turns out I did and stopped in time.
      So there's that aspect as well. A road cyclist may have his hands in a position which (perfectly legally) prevents immediate application of the brakes.
      So this "he should have either avoided or braked faster" argument is full of holes.

    This video is deceptive due to where the camera is mounted.
    Consider the eye level and the height of the car. The car that at first appears to obstruct the view is a Toyota C HR. It is 5ft 1in tall (1.555m). You can actually see the height of the person earlier in the video and he is definitely taller than 5ft 1 in. The camera is mounted quite low and certainly not at eye level. The plants also obscure much less when the eye level is considered rather than camera level as the plants are wider at the bottom. Earlier in the video you can see the position of the rider's companion. He certainly has an eye level greater than 5 ft 1 in. I assume the cyclist that hit the pedestrian was riding in a somewhat similar posture.
    One can then only conclude that the pedestrian was visible to the bicyclist the entire time. This means the cyclist had plenty of time to see the pedestrian, observe their movement and determine where the pedestrian was looking.
    Just because the rider is not at legal fault, riding in this manner is completely irresponsible. You need to adjust for the circumstances. This is not open country roads. I ride daily through a European city. Sometimes there are tourists around, I have to be careful. I look out for them. I use my bell or yell to give them a heads up that I am coming and I check to see that they heard me and that they stop otherwise I stop. Technically I would not be at fault if I hit them. However, as I always stay focused and I don't want to ruin someone's day. I do not do that. When you are using a faster mode of transportation you need to look out for others in situations where something bad could happen. If bicycles are to be taken seriously in the US, cyclists need to be more responsible than this.

    It was totally his fault, but next time please be more careful also yourself. You had seconds seeing him walking towards the bike lane (at least 2 or 3) you should have expected he'll step on the lane as he obviously didn't recognise you yet and looked only the other way, and if you have tried to warn him or lower your speed and expect braking you probably could have saved this incident from happening.       @obama there’s at least two seconds between the man appearing and the crash, which is plenty of time to ring a bell. Even though you’d only have one and a half hands to keep steering the bike the man would be more likely to react suitably to a bell than a man shouting.     Pedestrian's fault, sure, BUT you could have prevented the accident by braking as soon as you saw him emerging and looking the wrong way. There was easily enough space to stop but you didn't even slow down. Unfortunately it's just a fact of life that a cyclist must be prepared for stupid pedestrians as well as stupid drivers. No matter what your mode of transport, a good road user fixes mistakes made by other road users (and by stupid infrastructure design).

It was exhilarating and without reading the intentions of others I would not have made it more than a few blocks. The more I look at this video it appears the bicyclist had sufficient time to stop. Look at 00:34. There appears to be about 2 seconds from the pedestrian comes into view and the impact. It appears to be a distance of 3 car lengths. If you cannot brake in that time/distance reconsider your mode of transportation.

      Anyway, I just encourage whoever is reading this to look out for themselves.
      And a little anecdote to leave you off with:
      Once as a student driver, I was driving down the street when a person opened up their door about 4-5 seconds ahead of where I was. Since I was so new to driving and young, I kind of kept going waiting for the instructor to tell me what to do. About two seconds later, he said while (probably) rolling his eyes "oh my god... slow down..." and ultimately we stopped because there was no room to pass.
      As we were stopped, I said "But if I hit his door, it would be his fault, right?" and he raised his voice and said: "who gives a shit?! Don't get into accidents to begin with, use your head, people are stupid and will do stupid things. You want to deal with an accident every time someone does something stupid?" (not exactly verbatim, but probably pretty close).
      So the morale of the story is, I suppose when a guy pops out into a bike lane and you hit him, it was that guy's fault. BUT a much better idea is to just use a little imagination and predict that someone will do that for the 15th time on your bike ride, and go a speed that will allow you break in time. Just basic defensive riding.
      I know it's easy to just say fuck that guy and let him suffer, but it's not like anyone is perfect; we all make mistakes.

    Ok, the pedestrian was not careful. But the biker was going too fast in a city centre, where there are lots of people and it's obvious that someone will cross the road without paying lot of attention. I think the fault lies with both.

    Does no one look anymore? Both the biker and the pedestrian had more then enough time to step back or brake... Maybe it is because in The Netherlands we're way more used to seeing cyclists and using them, but seeing someone in your path for more then a second and not even having touched the brakes is just bad. Imagine if this was a car on car situation on the road, you're supposed to be aware of your surroundings and when you see someone on your path brake

    Pedestrian on phone, looking DELIBERATELY AWAY from oncoming traffic. One has to wonder if this person created this on purpose. Even on the phone, you know traffic is coming from the right but this person actually turned their back to traffic and stepped in front of the bicycle. When the lawsuit hits, you know it was fake.

    Cyclist all my life and paraglider pilot for a couple of decades. Paragliding has taught me one valuable lesson: you don't wanna be the guy that hit another aircraft shouting the other guy was in the wrong. Yes, the street is poorly designed, yes the pedestrian is a fool for walking in to the cycle lane, but most cyclists would have seen the pedestrian with his head down before passing the car and slowed down...

    poor city planning. dude couldn't see bike, bike couldn't see dude, the real villain is the cars blocking the line of sight. these types of bike lanes are so much more dangerous

    Not everyone can be aware of every single surrounding, i hate pedestrians that think they can walk where ever when talked to about it. This guy literally had less then 5 seconds to react and he seemed older cut the dude some slack, and i also dispise cyclists that just scream when there is something in their way for 5 seconds. Shows to me they have no patience, good lord. It's sickening because i want to support cyclists because i am one but not those who are overly angry and yell at everyone thats setting a bad example

    This is like driving quickly on the right lane when there's line up on the left lane. Someone's trying to make a left turn and you both hit each other. But in this case the pedestrian didn't look. And you didn't anticipate anybody trying to cross.
    I never take these things for granted. I always have my finger on my bell or horn and be on the lookout as I pass stopped buses.

    I’m sorry but as an experienced cyclist I would have noticed at 0:35 that the pedestrian is looking the other way and will most likely walk into you. I would have stopped. I can’t believe the stubbornness of some cyclists hoping or assuming that pedestrians will use their brains. What does that stubbornness get you? A grazed knee and possibly a broken bike. Don’t be stubborn. Stop.

    I can see why he is riding a bicycle. He definitely should not be behind the wheel. Stay on a bicycle if you can, better yet use a kids tricycle. That fits this rider better....

    The pedestrian is at fault here, obviously, but he is not the only one : the driver who parked his car too close to the bike lane and the ones who designed this poor infrastructure are faulty as well. That bike lane is not wide enough and there should be a curb on the edge of the parking lot, high enough for preventing cars to park outside of it.
    The cyclist ? 0% at fault in my opinion. He doesn't even seem to ride that fast !

      No, this is still pedestrians fault. There were clear markings for car parking where the pedestrian decided to cross. If you decide to jaywalk-which is illegal in New York where this was filmed, mind you-you have the responsibility of paying attention to your surroundings. If you're blinded by vehicles or other obstacles, don't jaywalk. It's that simple.

      @@dealloc It's not the pedestrian who's blinded here, and it wouldn't change anything as he is clearly not paying attention. The cyclist, however, could have seen the pedestrian in time if the car was parked regularly.

      There are white lines on the ground, indicating where a vehicule should park. The right wheels of the car are outside of them.

      @@Bipbiprna Right, I agree that is quite dumb parking, but would likely not saved a fall, considering where pedestrian walked and the timing of when he was first seen by the cyclist's point of view. Hindsight is of course always clearer than the moment in time.

    So we are gonna yell instead of simply hitting the breaks? Yeah, I've read comments, the pedestrian is at fault. Ok, fine. There are many pedestrians who are at fault when struck by cars. I ain't got no reason to kill a person to prove a point though.

      i think his friend yelled, we couldn't see the dude until last second, which means the biker whos view we had couldnt see anything since the camera is above his eyesight, there was no way Yan could have stopped in time

    Pedestrian's fault but since you know you're in New York and that many people there are almost completely oblivious to traffic whether a car or a bike, you should've known better to not shout first before hitting the brakes. You're not even going that fast so you should've been able to stop immediately, unless of course if you're holding onto your drop bars which is a no-no when riding through those kinds of streets. Not to mention your slow reaction time.
    And please don't lecture me about your cyclist friend at the back who you'll think will hit you when you squeeze your brakes, you're not going that fast and you should've assumed someone will pop out of that gap from your left. Be careful next time and be a defensive cyclist ;)

    The same argument could be made for bikers riding in the road. Roads are for cars! I'll remember that next time I'm driving, i'll just plow through bikers not following the speed limits, using hand signals, or following the max speed of the roadway(usually 55mph). If you aren't in the bike lane/path you deserve to get hit? like this pedestrian? If only cyclists could get it through their thick bike helmet that roads are for motorized vehicles only.
