When does qualified immunity cross the line into tyranny? Is that line red, white or blue?
As a foreigner who has lived in the US for a few years, I would recommend a juridical system like the one in other democracies: a system based on laws rather than immunity. That is, if law enforcement, MDs, politicians, or other positions must have some powers that the ordinary citizen doesn’t have, those powers are well specified and regulated in law rather than having these vague “qualified immunity”, “executive immunity”, and similar.
Although I have come to understand that the US laws are quite different than I thought: The concept of freedom is in its foundation understood as anarchy. Then what in other nations is regulated by well formulated laws is instead mostly “regulated” by people pushing lawsuits. Although there’s a few vague laws on top of that, but that often has to be processed by non elected but political Supreme Court justices who decides what they mean (i.e. the justices are actually legislators). Those laws essentially being some old English laws from like the 11-12th century. Lol! Why not the old testament when you’re at it? And the Congressional legislators then don’t engaging much in this type of lawmaking… since it is impossible to get bipartisan agreements with the filibuster and two houses. (The basis for American politics obviously being governing status quo rather than governing as in “taking care of the nation and its citizens”).
Some of these laws stand in opposition to each other. I briefly watched an open Congressional hearing with military officials testifying. Where I understood they were both obligated to answer the questions, and to not reveal classified information. And when a Congressman (Gaetz) asked about what was obvious classified information, I saw the Pentagon officials didn’t know how to respond. And perhaps the courts would be called on to interpret what is the Constitutional correct way if either the Congressman or Military leadership would have pushes the DOJ to investigate the poor official to have acted against one of the laws. Instead my recommendation would be that the laws in themselves clearly specifies what action is the proper and legal. As the laws do in other democracies.
And then you have the similar vague immunity for those offices where I similarly would recommend modern laws that instead should be formulated so it’s clear what they can do that ordinary civilians can’t. Like if a POTUS must be able to execute Congressional decisions, instead of granting him some vague immunity from being sued or prosecuted if those actions harms someone or someones business in certain way, the kind of harm the position of the POTUS can inflict (but not the ordinary citizen can) should be well defined. This vague immunity now unfortunately seems to be about to lead to “where law ends, tyranny begins” in the USA.
Qualified immunity always results into tyranny.
