DOJ's lawsuit against Apple 'doesn't make sense,' attorney says

  • The Department of Justice has sued Apple (AAPL), which alleges that the tech giant is creating a monopolistic entity. NetChoice Vice President and General Counsel Carl Szabo joins Yahoo Finance Live to discuss why he believes the Department of Justice faces an "uphill climb" in this legal battle.
    According to Szabo, the monopoly accusations "just doesn't make sense." He points out that when Americans buy a smartphone, they have "two clear choices": Apple and Android devices, disbarring any assumptions of a monopoly. He notes as this legal battle continues, Apple's innovation efforts may be impacted "out of fear" of being accused of monopolistic practices.
    Szabo notes that as long as Apple can provide evidence that supports "business purposes for what they are doing," the courts will most likely rule in their favor. He suggests that many of the concerns raised by the DOJ can be "easily dismissed" due to the legitimate purposes they serve in relation to Apple products like security prevention and payment processing.

    Apple is too expensive! my daughter got an iphone 15 for $1,300 and she couldn't even charge it. NO CHARGING DEVICE!! I still have an iphone 7 I'm not giving these greedy corporations that much money for a phone THAT THEY STILL CONTROL!

    Being able to choose between apple and Android is not proof of competition.
    It is a demonstration of all others being blocked from entry, could you really imagine choosing between 2 car manufacturers? Even if many manufacturers buy all cars being limited 2 door or 4 door no other form factors allowed

    I prefer an iPhone, it is more secure from theft and viruses. I prefer quality products and Apple works to guarantee security for their buyers.

    How on earth are other apps going to access the cards on the device without going through Apple's api which handles the alert he is worried about? This take seems very biased and tech confused.

    The Federal Government should disclose how much this lawsuit has cost the taxpayer.... This is where your taxpayer money is going- to frivolous lawsuits that don't really change consumer position. Banning Tiktok and going after Apple: surely there are other areas The US Government can work on..

    It's dumb. I don't get the whole messaging thing. Apple said they are adopting RCS, and according to 9to5Mac, Apple even said they will work with the GSMA to make RCS better. How is that not making cross-platform messaging better on iPhone?

      @@sa34w Apple is innocent until proven guilty. The evidence says that they are adopting RCS, and there is currently no evidence as to how Apple will adopt RCS or if they even will. Therefore, there's no evidence to prove that Apple is guilty, so they are innocent

      you already can because IOS is base off of UNIX & open source code!!! for software. then, hardware is based on ARM which is another open source!! so what is special then, lockdown hardware!!!

      Explain how being forced to use Apple AirTags, Apple Wallet, Apple App Store because I have an iPhone makes any common sense.
      Or why if I want an Apple Watch and don’t have an iPhone I’m forced to go buy an iPhone. Or if want to buy a Samsung watch and I have an iPhone I can’t take advantage of all its features.
      Or why I can’t send videos to anyone other than other iPhone users?
      Intentionally making using other products and services impossible or nearly useless so people are forced to use your products is the entire point of this lawsuit and is long past due.

      @@Busyshark92 All untrue. You don’t have to use AirTags, you can use Tiles. Apple Watch is a completely separate product that requires connection to iPhone. There are plenty of other 3rd party products that have those same requirements that are exclusive to iPhone. You can’t send videos to non-iPhone users? I send videos to my Android friends all the time….thru iMessage. That claim made no sense at all.
      If you don’t like iPhone user experience, then go Android. Android provides the same services, different user experience. That is not a monopoly, sir.

      AirTags - Tile works with iOS
      Wallet - soooooo many ewallets on iOS
      App Store - EU seems to agree with you there
      The watches work better within their parent ecosystems
      Sending videos doesn't work? 🤦‍♂
      Bottom line - there's choice. Nobody's forced to do anything. Your comment simply reads like you made a premature choice given that in your specific use case, you may have been better off on android given that you would've made fewer compromises.

      ⁠​⁠@jds4kThis isn’t micromanaging, this is enforcing the antitrust laws. There is much more to this claim than what JKLiving is referring to. The full claim explains why the DOJ thinks that Apple is using its market power to force developers and consumers into their “ecosystem.” Lots of what they do is similar to Microsoft’s conduct in the 90s. That Microsoft suit arguably opened the door for Apple. That type of competition and open market is what we want.

    This Carl guy is such a joke.
    I shouldn’t be forced to use all apple products and services just because I use an iPhone.
    Apple intentionally makes using other products and services either impossible or completely kneecapped so we have no real choice which is the entire point.
    Just look at Microsoft in the 90s with Internet Explorer.
    This was long past due and entirely warranted.

      Apple makes its eco system the way it does because the software on android devices is in fact highly inferior and more vulnerable to cyber security threats and little to nothing has changed that fact in years. Yes Samsung does outshine in the hardware department often but ultimately I don’t think it could ever match the simplicity of the iPhone or ever overtake it as the top choice.

      Or why I can’t use an Apple Watch unless I have iPhone and can’t use Samsung Watch WITH my iPhone.
      Or can’t send/receive videos, a basic function, to anyone other than iPhones.
      You should respect yourself more.

      @@Busyshark92you can use tile with iphone, "If you have an iOS device running iOS 16 or newer, Tile is compatible with: iPhone 8 or newer. iPhone SE (2nd generation) or newer."
      because the apple watch runs on apple OS, you dope
      Apple is making RCS available this year
      you should research more and maybe an iphone is too complicated for you

      @@吃豆人oPThey could offer this ecosystem while opening the market to others. If you were to stick with the native apps that operate on iOS nothing would change in your experience. The DOJ claims (among other things) that developers and customers should not have to be forced to be stuck in this ecosystem.

    Learned what Apple was all about years ago. Replaced tablets and cellphone with Samsung stuff. Now happy !
