- On March 28, 2023, a police officer conducted a traffic stop and suspected that the driver and passenger were under the influence of alcohol. The officer initiated a DUI investigation and conducted several field sobriety tests to gather evidence against the driver. The woman was later arrested and charged with reckless driving, but the DUI charges were dismissed. She received a sentence of 12 months probation, 75 hours of community service, and a fine of $900.

Wow this was just awful. I am former LEO. The female officer needs much more time in training. She is unsure of herself, doesn't appear familiar with procedure, and doesn't seem to have situational awareness. Reading aloud from the manual is embarrassing. Either get her trained or get rid of her. She is going to get somebody hurt.
She can also cause people to get hurt. This type of hesitation and uncertainty can cause some people of interest to become unhinged.
The Female LEO was painful to watch her fumble through the tests. DEI baby!

I am an officer with 10 years on the force, this arrest was bs because she passed all the precursor tests. This is the reason people learn to hate officers when they do not do their job correctly. The female officer was nothing short of incompetent, she needs more training, having to read from a book for the tests is embarrassing, I would never have allowed any of my trainees to perform the tests if they were not proficient and capable of memorizing 5 simple procedures. Last but not least they did not even do a breathalyzer because they knew the DWI arrest was bs. and she passed, Any wonder it was dismissed in court. You two give officers a bad name,

Thank you for being honest, I see so many times where police are saying they failed the field sobriety test and I don’t see any incident, and then they tack on that they are slurring and stumbling and this girl was not doing so…. Yes she sounded like an innocent little girl and that’s probably because she is… and she was respectful…. Idk it just bothers me when police try to always give out these DWIs for someone even having a drink or two in the last couple hours. But she needs to be careful for sure… but who knows if she even almost hit that car…. When I was 18 I was pulled over from the freeway because a cop said I “almost” hit their car when I was switching lanes… they did a field sobriety test and I had .01 in my system… then we’re frustrated because I passed the field sobriety test and then had about no alcohol in my system because I drank hours before…. So they towed my car and gave me a ticket for zero tolerance which made my license suspended for a year! Such bs…

She was NOT slurring her words at all and she aced the tests. I'm not saying she wasn't impaired, but their minds were made up before said tests.

She was kind and polite, passed the field sobriety tests, and they arrested her for DUI anyway. I’m glad that the DUI charge was thrown out and that she did get charged with reckless driving, but what a waste of time and energy.

Her arms were supposed to be down by her sides. She had them outstretched. It's about listening to instructions given and responding to them correctly as well.
What's the point of even stopping people anymore? None of these people are ever charged with anything that sticks.

First of all you have to remember ppl have rights… we didn’t see her BAC… like the video commenter said she did better than most on the tests… you wouldn’t want a charge for something when that something wasn’t actually happening right? Innocent ppl do get charged and screwed over daily. Now do I personally know if she was truly drunk… no but neither do you.
Secondly, while it doesn’t pertain to her… a lot of dui cases are the first time someone has been in trouble… therefore they usually get a light punishment… a lot of states have programs set in place for the first time.

The police tend to take seriously when drivers almost smash into them when they are just doing their job on the road. The girl stated she just came from drinking. This lesson for her can save HER life as well as others.

Yeah.. it was click bait. She really didn't act entitled compared to 99.99% of others we see in her same situation. But for the good of herself and society this might be a good lesson for her as she admitted to drinking and granted she was only a bit shaky on the tests almost crashed into a police car with it's lights on.

Agreed. On the side of the road with a drunk is not the right place to learn the basics. The officer clearly has difficulty reading aloud, and, knowing this, she should have practiced reading the instructions, until she could do it clearly and consistently. The long awkward pauses while she tried to figure out words, and the repetitions with yet more pauses, could have baffled some sober people.

Then the other cop has some nerve for getting annoyed at the driver when she didn't understand the situation and was asking for clarification, because they never explained it!

@@kenbaustin4533 It seems a little arbitrary at times doesn't it? The test is assumed to be measuring coordination and balance but really they are especially looking at how well you follow EXACT instructions. I would fail this test while sober had I not known this.

FST's are garbage. Too subjective and open to abuse. How often do you see someone actually do well and get released, never. Do what is done in Australia, just ask have you been drinking, yes or no, then straight onto the breathalyser, no wasting time. If they refuse then off to the station.
I very much agree with this, I think the problem is with other drugs like weed, xanax, etc where a breathalyser wouldn't show it. However they abuse these tests too frequently.
I don't get it either. Just use a breathalyzer. It takes less than a minute instead of 30 minutes of stupid tests to get arrested anyway.

My son had a girlfriend that talked just like this…nothing she could do about it and was the sweetest girl around.
Oh my God watching that female officer read the instructions was painful. I understand people being new to their job and being a bit unsure (at least I hope she’s new ) but, she sounded like she had never seen the FST’s EVER and was completely baffled by the instructions !

I realize that there is a ‘first time’ of doing things as a trainee but it seemed to me that she was reading the instructions for the very first time and not really understanding what she was reading.

You are correct. I have seen some of these where they passed each test without a problem one and they still arrested them. They are wasting their time. Just do the breath test and move on from there.
@@Bernie28Ing Even a breath test doesn't tell much. A person can be way over the limit and still functional because of their tolerance. And a breath test doesn't deal with other issues like sleep deprivation or substance consumption.

Lol me! When I was 21 my dad owned several bars and I would drink and drive home sometimes (obviously bad, I was young and dumb)! The cops asked me to get out and they gave me the tests and gave me a ticket for going 85 mph in a 60 mph and sent me on my way! I cried and started shaking when I got back in the car hahahaha

Firstly, she was one of the most polite and calm people I've ever seen on one of these videos. Secondly, they can't say much about her acting like she's 5 when the female officer read that test like she was 5. Either she was a rookie due investigator or genuinely was struggling to read the test. At least the girl was polite and I believe she's genuinely that immature acting. I dont think that was a show for the cop.

I had a cop tell me he smelled booze on my breath. Ive been sober 27 years. These cops knew they were gonna arrest this chick as soon as they pulled her over. I'm glad the DUI was dropped, but that sentence was absolute horseshit! 1st time offense she gets 12 months probation and all that community service. Just ridiculous!

It wasn’t dismissed. It was reduced to a lesser charge in a first DUI plea deal. That should have been obvious with the $900 fine that came with it btw 😂

Never consent to any field sobriety tests. Plenty of resources online support this. This video clearly states that the police are building a case against you. Why would you help them build a case against you?
The female officer appears like she had more to drink than anyone else. The way she spoke, the way she moved her hand during the visual test, she appears to either not have the brain and mental capacity to be an officer and to correctly administer these tests and or provide proper “protect and serve” compliance that her job requires. Stop hiring just anyone to be an officer, qualify them and stick to the proper requirements when offering them their jobs.
This was so painful to watch. I could feel the newbies anxiety. It honestly felt like this was her first traffic stop.

She shouldn’t need to rely on the instructions whilst carrying out the test , surely by this stage of her career, she should only be using the instructions as a prompter, just to fall back on if needed.
Some departments require officers to read them like that so there’s never any discrepancy over their wording and possible ambiguity in interpreting the instructions. Same with some departments requiring officers to read the Miranda warning off a card.
Lots of police reas them. No room for a defense lawyer to say instructions were not correctly given.
She really thinks you can get out of a DUI by having someone come pick you up! Woopsies, I'll just call a friend and we can all call it a night.

She was not DUI, she's just a dork. The test was botched by a rookie cop.
Those sobriety tests have a lot in common with the american justice system: a lot of time lost for something that could have been solved in a matter of minutes.
While I was serving in the Air Force on AD, I unfortunately supervised several personnel that were arrested for DUI and saw even more when I managed our personnel security program. The fact is that a fairly competent lawyer will usually be successful in reducing the charges for their clients. It costs a few thousand dollars, but I have seen most DUI's reduced to reckless driving. For these individuals, there are more repercussions because of their military service, but I imagine it is a game of slap on the wrist for civilians. Hopefully, this comes as a wake up call to this young girl.

Yeah. They will spend $100-200K showing horses from Dec thru March. Maybe more depending on how many horses she shows. All the Uber rich go there for the winter including celebrities with their kids that ride.

All these drivers clutch their phones, as they get out of the car for their tests. As if the phone offers some type of magic protection.
But isn’t that the way of the world these days? We take them to the breakfast table, to the bedroom, to watch television, to work, to shop and even into the bathroom. They are an extension of our hand and replace that security blanket or stuffy we had as a child. We check it constantly as if our life depended on it.
I never had a beeper but my first ‘mobile’ phone was in a hard, heavy case weighing a few pounds. I paid $19.95 a month for 30 minutes talk time, and I had minutes left over at the end of the month. No texting, no videos, no social media. I had it for emergencies since I was on the road traveling, sometimes at night, on highways and turnpikes. I sometimes just used it to check in at home to see if we needed anything at the supermarket. Those uncomplicated days are a thing of the past and, just occasionally, I do miss them…. 🌈 ☎️ 😊
Why are these tests even a thing anymore. In my country, cops have a breathalizer in their car, you blow and thats it. No funny instructions and all this wasted time. 🙄
Yes in Australia you don’t do dumb tests. You have to use the breathalyser that’s it.

I too do not understand the point of these tests… you can have ONE very minor thing wrong… you do well on everything else and that ONE bad thing is the reason you get arrested. Seems like she wasn’t drunk since it was dropped.
Why do people think its ok to drink and drive & if they get pulled over it's OK to just "call for a ride". How ignorant. Wake up & grow up! Your supposed to be an adult.
That female officer is totally a rookie, and should not be out there conducting field sobriety test, because even reading from the manual, she still isn’t sure of what she needs to do
