I think it was wrong of the officer to not inform the suspect of being arrested for not doing the breathalyzer, he should know, but the officer should’ve told him.
the guy knew it, trust me. thats why he asked for the blood test. he knew it would involve him going to the station and scheduling a test, it could take up to two hours. they ALL hope the BA level is down to 0 by then. thats the ONLY reason ANYBODY would request a blood test. honestly, think about it. If you were sober and a cop pulled you over, why WOULDNT you just blow?
@@flipnap2112 Because using mouthwash 15 minutes prior can cause false positives. As can some foods and chemical dyes used in nuclear medicine. Any butyl or amyloid embued with propyl or other reactants in the alkyl group will cause false positives. Artichoke hearts, fish and game preserved with nitrites, fruit juices, unpasteurized honey, sugared fruits, all cause false positives in the chemical sensor found in breathalyzers.

If you're driving and you're not drinking, then there should be no reason you would decline a breath test.
I'd prefer cops be tough on drivers going 20 then 25 over the limit, that endangers innocent lives. Especially if they can tell the driver is intoxicated.

@@Questchaun police are supposed to set the example. It's kinda hypocritical to charge someone for something when you're also breaking the law. (I know in this case it wasn't for no seatbelt violation or that he wasn't arrested but in general)
Police dont wear seat belts because it impairs their movement out of a car. They have to get in and out to deal with suspects, and getting snagged on a belt with any of your equipment or body isn't worth it.
Most police don’t wear them durning the night. Some don’t during the day, but it makes it harder to move especially if they have to jump out.
@jay They don't have to. Emergency vehicle drivers are exempt from mandatory seat belt laws.

He was arrested for dui, the roadside breathalyzer would have just prevented the car from being towed if he were under the alcohol limit. He should have said "but I will give you a shot at saving your car from being towed and collecting $100 a day on the lot while you're in jail for reckless driving by letting him do the roadside test when he changed his mind. At least save him some cash!!

Actually based on the guidelines of the field test. He failed to complete the heal to toe test and when asked to perform another part of the test he refused. Officers who do a large number of DUI/DWI are specially trained in driver impairment, and thus can articulate their observations.
If he actually had been drinking than the blood test was actually the smart way to go
Yep a solid 40 min to sober up a little it might help ahahaha unless they have a way to keep track of how long the whole thing took to get him before taking the sample.. then they somehow can judge what the level would have been at the original time of arrest

I thought he did pretty well on the other tests he should've taken the breath test. Also my husband grabs a handful of breath mints when he leaves the house. If he chews on those than he doesn't dip as much. Normally I don't mind police because we only have positive interactions with them but this guy questioned why he had breath mints...that's weird. There could be any number of reasons why he has all of those mints.

When you refuse to take a brethalizer test, you are arrested. He also failed the sobriety test.
place bets on if he's drunk, ive got $50 says he's fine. Not everyone can do those tests easily, if you naturally have bad balance like me a breath test, or blood test is your only way of proof to these cops, but his speech was good, he walked straight just missed a little off the heel to toe, but not wobbly at all, his foot went down common sign of bad balance which if its a bit cold or windy you find even cops giving an example do the same.
if he was sober he wouldve blown in the tube. its simple. the cop knew it, he knew it. thats why he asked to get blood drawn. he knew he had to go to the station and was hoping his BAC would be down to 0 by then. its the oldest trick in the book

There was no indication of impairment what so ever. No probable cause to give a breathalyzer test. The only thing the cop had on him was speeding on a deserted highway in the middle of the night.

єvєrчday αtrσcítчTM the trooper had multiple clues during the SFST’s, you can literally hear him quietly saying “miss, miss” while the driver is taking the tests, that is the trooper marking every time the driver messed up the test. Enough of those clues leads to the conclusion that the driver failed the test.
Not to mention you don’t meed to have probably cause to ASK a driver to take a breath test from a portable breathalyzer on the side of the road. Once the driver specifically asked to have a blood test administered, the trooper has to take him in to custody and transport him to a facility to administer the blood test. Do you expect him just to pull a needle out of his pocket and take the drivers blood right there on the side of the road?
I hate to sound condescending but please leave this to the professionals. I have been a specialized DWI Officer in my state for several years now, and it literally takes hundreds of hours of classes and multiple certifications to be legally allowed to do everything this trooper did in this video. Everything was 100% legal, even if it doesn’t seem like it your untrained eyes.
You're only seeing this from UA-cam, from a camera. And I'm sure you're not a cop, so you can't determine any indication of anything but speech, and that's hardly because they don't put the whole scene on UA-cam sometimes.... stfu.

You don't have to take the field sobriety test or a breathalyzer test. They will bring you to the station and get a warrant for a blood sample and at that point some of the alcohol will have made its way out of your system.
@shadowsai3 no you do not have to take breath test, but upon your refusal, your license AUTOMATICALLY gets suspended for 12 months, if you take test and fail only gets suspended for 6 months, but of course you'll have that DUI on your record.. Here's the trick, NEVER BLOW. The blood sample has to be voluntary also. But you'll need a decent competent lawyer though. If you take no tests, field sobriety or blood breath or urine sample, then they cannot prove WITHOUT A REASONABLE DOUBT that you're impaired 😎

I was on a jury case last year that the guy said he wouldn't take a breathalyzer, only a blood test. They arrested him but denied him a blood test and kept pushing the breathalyzer even once they were at the jail. We let the guy go because there wasn't enough evidence even though he was probably drinking.
For those complaining about this arrest, keep in mind that in just about all states even the amount of speeding he was doing is an arrestable offense by itself

Again, I salute to you all behind my badge. Everyone has my respect, but those in service/ whom have served, they have a different kind of respect. That's not an easy job to take on; if it ever becomes too easy for you, I think it's time to quit. You deal with so much, things ranging from dishonesty to where you're fighting for your life.
There are good cops and bad cops out there, taking negative advantage, but those good ones; we need more of those.
