13 years is a long time to be with someone who is living off of VA benefits to be a gold digger. Like usual, the children came and took everything and left this poor woman with nothing. She quit her high paying job and took care of an old disabled man changing his poopy diapers and playing the good wife until he passed. She deserves to claim her share of the inheritance as she not only loved him and cared for him but she also had to deal with a family of "Darrens and Karens" showing her that she was not welcomed on a regular basis. I believed her when she said that they weren't there to care for him. So what do they expect from her? A free nurse for their dad? Shame on them. She is entitled to get her share as she could have had so much more working in her former job. And I bet that 'barking d*g of a defendant was the one that was least involved in his father's care and life. (Hmph!) He wanted to condemn her for eating food on the day he passed away? WHAT?! She can't eat? Bottom line, the family of Darrens and Karens just wanted to punish the beautiful woman. If they wanted her to leave him alone why didn't they tell her that their dad was still married?

The VA pays the wife of record, which has to be proven by a marriage certificate that she had. However, if he failed to provide a marriage and divorce decree to then, she is still entitled to full benefit compensation in addition to what his will says. The estranged family always comes in at the end. It also appears that some underhand dealing was done against her. I hope she is successful in the probate court.

His Kids never came around didn’t call not even a father day or birthday card ever! When he died baby they were at his house taking as much as they could carry! Lol I had to laugh to myself because I told him four years you know you sick get your business in order. Never did. Put him away any kind away. Retired mailman & Marine. It was embarrassing. Didn’t have anyone one his life insurance etc… big mess, all they did was steal from him identity theft smh,but it’s over my daughter got her part & we never have to see those sorry children again ever in life.

It isn't uncommon for that generation to separate from a spouse and just move on without legally filing for divorce. It also isn't uncommon for that generation to never talk about things, so I'm not surprised that she didn't know he was still legally married. If he had a good thing going with this woman, at his age why would he tell her that he's still married.
