Been punished twice, in the state and in federal is ridiculous. I call that double punishment anyway.
Do they find people innocent? I thought they only find people not guilty.

There is no such thing in verdicts. Judges and juries say not guilty. Because in our system, which is the best but still, not perfect, it is not because they let you go that mean you didn't commit it and the other way is also true. But once they give a not guilty verdict, it is over, even if they find something new, it is over.

if you dont understand what the double jeapardy clause is trying to protect then you need to do some homework because the court systems violate the double jeopardy clause everyday when someone violates their first probation thing because every court in america always illegally coerces people to waive their rights in court and take bargains in which has a hidden clause of waiving even more rights , the system is totally unconstitutional and people want to get rid of the court systems thinking that those courts are operating within constitutional law , we havent had a constitutional government since before the civil war ..... the north was constitutional during the civil war until they printed the green backs , the confederates were being directed and funded by the britith , the british had a control over the north as well , see people who want to talk about politics dont understand things like how the rhodes scholarship is for world british rule ... or other endless complexities
I had actually learned about this when we had our brief on the Uniform Code of Military Justice (UCMJ)
Before I was of the belief that you could only be tried by one jurisdiction one time. But leadership informed us that if we do something dumb (such as a DWI) out in town, we can be punished both by the state and sill be NJP'd or court martialled. It would not be double jeprody because the UCMJ is it's own jurisdiction

I've been to court about this property damage issue. I will say in one part. I went to court with the owner of property. Now about being dangerous
California doesn't recognize or practice this in the least.
When is Jeopardy attached?
Idc, the murders of Emmit Till should’ve been sent to prison!! They were found not guilty even tho it was quite apparent they were. Then 4 months later, they admitted to it in a MAGAZINE !! With no remorse, they said they killed that 14 y/o boy and I hope they rot in hell

I just read an article about ASL (Administrative Suspension of License) as a form of Double Jeopardy. Courts have ruled that you cannot be charged Criminally and Civilly for the same office. In the case of ASL this is having your drivers license suspended on a mere DUI/DWI arrest rather than conviction. In other words you are already punished without proper due process.

The constitutional prohibition on Double jeopardy only applies to criminal proceedings.
You can absolutely face civil proceedings for criminal actions, examples of this are tort actions (suing for assault, wrongful death), losing license (professional, driving) or immigration (denial of benefit, loss of visa, deportation)

Someone help i went to court in september and the case was dismissed then come November I was arrested and charged with the same crime that had beem dismissed in september now here i have court in march

If someone was convinced of rape yet not for other serious offenses on a young childs health, like drug & alcohol abuse, is it double jeopardy if the og crime is of association.

New evidence should be an exception to this. I'm all for civil liberties and the constitution, but if new evidence comes out that they may have committed a crime the accused should be tried again. I don't see why potential criminals shouldn't be challenged or even have to formulate any argument and defence against the new credible evidence.
Ok I have a question. I know double jeopardy works with murder. So if someone dissapeared, and you were found guilty of killing the person. But the person was found alive a few years later, cant you just walk right up to her and kill her? Because he just served a few years for killing her
@@savagejack5714 Yes, I would have thought so. Although I believe they can be charged with a related sentence such as manslaughter, even if it was blatantly murder, due to this legal catch.
@@Based_Stuhlinger but wouldnt manslaughter be if they accidently killed them. So they would be charged for a "fake" accusation or something like that
@@savagejack5714 They would be charged for the next heaviest crime from murder. Since the murder sentence was used last time. Double Jeopardy only affects a charge I believe meaning a different one can be used the second time.
@@Based_Stuhlinger It actually doesn't at all, if I "murder" you on December 1st, that's a completely different crime then if I did it 'again' on December 2nd. It's why I can steal your phone one day, then do it again and be charged twice. Same thing, different times, different charges. If you killed someone but they were resuscitated later miraculously would that mean you can kill them again free and clear? Time is a factor in determining a crime, if you do the same thing twice, at different times, they're two separate actions. Just because it's not possible to double murder someone doesn't mean if you get convicted of it once you're free and clear to murder that same person again at a different date.
"Gamble" is wrong - it need to be reversed.

So let me get this straight. The same number case same victim same charge same date of charge. And they can't charge you for the same offense again. But if you did you did the same offense to the same person the next day is it still considered double jeopardy?
For example: someone parks on my property. I still his car unfortunately remove it off my property. He calls the police I turn myself in. I post bail and on the same day go home and see his car parked in my property again. I do the exact same thing I steal his car he calls the cops. All understand of the 24 hours. Can they still charge me with the same exact crime twice?
Yes. You can't be charged for the same crime twice. Stealing the car in the morning, and stealing the car in the evening, are two separate crimes. There's no rule where if you do two similar crimes really close together it counts as one crime.
Ok so let’s say I murder someone, they take it to court and I was found innocent, the next day, can I shout that I really did it and nothing will happen to me?

I completely understand Double Jeopardy…However, video did nothing to clarify the law and or nuance that was added with the state/federal cases against the criminal charged. You guys made it more convoluted.

Keep in mind this doesn't apply if they find new evidence but hit you with a new crime for the same incident.
Newly discovered evidence isn’t an exception to double jeopardy. In fact this is the most common type of case in which courts apply double jeopardy.
Wrong. When the judgement fall, it is over. Another new crime, is an other new crime. If you kill an other person, They can't bring anything from the first one which you were aquited
