Hey, im from New Zealand, we dont have words like probable cause etc. Its like ur police come up with words to try and sound official. But what do they mean when they do say Probable cause?
It basically means they have to see you doing something illegal or at least highly suspicious for them to supersede your various rights. Like you have a right to not be searched but if they see you with a bloody knife or something they can search you without your consent. But they need to be able to write it down to explain why your right was overruled. It’s a legal threshold that they have to prove the circumstances crossed. I’m not a lawyer btw but that’s the idea afaik

The amount of videos I see of people (unfortunately especially black) being stopped and searched for really no reason other then being near a cop is out of control. I know America does have a lot of great cops, but by the videos I see, they have just as many bad cops. I've seen video of cops letting other cops get away with DUI etc, even domestic abuse. I know that had happened here in New Zealand maybe 30years ago, but these days in new Zealand, cops won't let another cop get away with anything (if they catch them) and they don't care how high up U are. I see and hear Americans having to fight for their rights against egotistic cops all the time. What stopped the whole crap of "cops don't tell on cops" here in NZ was when a lady came forward and took on the whole police force maybe 30years ago for gang rape and abuse on her. Some of them were high ranking. She took all of them to court. Had many arrested. Her story put an end to people being quiet about police actions (not to say it still doesn't happen). But it's easy to change a system in a small country, because there's nowhere for a bad cop to hide. We still have crap cops, they are just caught out AND named and shamed.

I can tell you, as a cop, if I was in uniform and was in this same situation, this guy would be in cuffs, ASSUMING there was some sort of ordnance about smoking. The guy already said he was detained and refused to identify. Done deal, you refuse and an officer determined you were detained, that’s it. But since he had no radio, probably no cuffs, and no backup, it walked himself into a hole he couldn’t climb out of. Mind your own business unless someone is in dire need to police assistance.

For anyone disputing what happened here, we can look at the cops own words of "I'm not even gonna mess with you anymore," which implies that he was indeed messing with the person. The Constitution provides that an individual has no obligation to answer any police questions. The reason they ask questions is to get you to incriminate yourself. If the cop had any true probable cause for detainment, he would not have said that and proceeded with giving the reason for the detainment occurring and started in with the punishment, period end of story.
Example - In a pullover situation, "The reason I stopped you is xxxxx (followed by the punishment of a ticket citation)." The officer, when stopping a civilian MUST give the civilian the reason for his or her detainment. The detainment MUST be for a crime to be committed or a crime already committed. If the officer can't do any of that, then it's simply harassment. This was harassment.

My dad was a cop in the 70s-90s so I know what a real badge looks and feels like. So whenever I see a cop, I always ask to see their badge, number and precinct.

If you commit an offence, and a law enforcement officer has identified him/herself, and informed you of your infraction, yes you have to ID yourself. BUT, if they do not ID themselves properly you do not have to legally act as if they were a law enforcement officer.

If they had legitimate reason to arrest him they would have. Cops don't just buzz off because you're being annoying if you're actually breaking the law.

Lol He told me if I wanted to smoke to stand behind the steps because nobody would see me there and if he doesn’t see me there then he can’t really say anything about me smoking. If you respect them they will respect you in return it’s how it works and how the world operates on respect. If you a disrespectful asshole they’re gonna treat you like one. Police use it as an excuse to search for drugs and check for warrants, when in fact what they are doing is unconstitutional

A cigarette butt saved my ass. lol. In the mid 90s an NYPD street crime unit rolled up in a few vehicles on me and my friend coming back from the store. We were sharing a cigarette when my boy says, "Why's that guy talking into his hood?". Boom! They ran up searched us, shoes off, etc. Cop asked me, "Where's the joint you were smokin?" I pleaded that we weren't smoking weed. Lastly told me, "If you don't tell me where the weed is I'm gonna take your head and run it through all these trash cans (Had 8 in front of my building. heavy metal ones). By then my boy was like we were smoking a cigarette. I yelled "Yeah!! There it is right there still burning!!". No apologies. nothing. Just a "Get the fuck outta here." That kind of shit happened so often it's not even funny. No reason. No apologies. Felt fucking helpless man.
