The swarm detects a combination of lifeforms and electronics. If either of the ones doesn't exist, the swarm ignores it.
Which is kind of logical, because it means that it only attacks civilized lifeforms (threats). It ignores beings like itself, or simple animals.

But the more I think about it, I can come up with scenarios that would at least make half sense. If an emerging civilization for example happened to be ejected from their solar system in some super rare event, somehow barely survived the coldness of having no sun on their now rogue planet and would then happen to arrive here by freak accident a million years later, they might indeed decide to take over the solar system as their new home system. Actually not the worst plot ever.

Wait, so the landed right next to their families is Colorado? I guess they took off from Texas, spent 90 minutes on the moon, then re-entered earths atmosphere on orbit back to Texas? If you know, you know. To hard to explain how an orbit works.

A concept that simply should be understood: a copy/upload of a person's consciousness will not give you a person! Your consciousness is purely a current moment understanding of your body's senses! Any "upload" would hold memories at best and not be remotely close to what an individual is.
