  • The defense argued that a video of Nicolae Miu during his arrest should not be played in court. Prosecutors say that the video proves Miu knew that one of the victims was deceased ahead of his police interview.

    The prosecution comes off like a bunch of lawyers who barely graduated from Ajax Law School and the cops from Mayberry top it off. The witnesses are mostly people who should be in treatment for chemical dependency and couldn't remember what they had for breakfast if their lives depended on it. No way that Mui is found guilty .

      Good thing the video evidence is so damming. Nicolea Miu is a murderer weather or not the prosecution is intelligent, or whether you like the testimony of the witnesses. I’m sorry, but I’ve got to strongly negatively critique the State’s inability to argue their point to get this video admitted…yes, when Miu was FIRST told that he was being arrested for homicide, he did NOT in any way affirmatively acknowledge that he heard/understood that statement….HOWEVER (& this is a HUGE however)- the officer’s SECOND statement contained a reiteration of being told he was being arrested for homicide, AS WELL AS thst he was then being taken to the station for questioning. THIS WAS ALL ONE STATEMENT, CONTAINING MULTIPLE PIECES OF INFORMATION…to which Miu, then acknowledges.
    I am STRONGLY DISAPPOINTED in the State not fighting for their admission using this to their advantage 🤦🏼‍♀️🤦🏼‍♀️🤦🏼‍♀️

    Ever hear of someone being in SHOCK, prosecutor?
    The man has no history of violence and he was traumatized by this assault and having to defend himself which caused the life of a teenager. That has to be traumatic for him too.
    He’s a victim here too

  • @andyr9654
    @andyr9654 Місяць тому +1

    Mmm...misleading caption. There is one thing they did NOT consider in the video. That was his non-objecting demeanor. In other words, he never objected to being under arrest, nor that it was for a homicide. Now with that said, it would be then reasonable to assume that he knew what he did and that said, him not responding self-defense" at that point, could mean he simply was not sure whether it could be considered "self-defense", as most folks do not understand the fine lines between these things. Yes he was entitled to the 5th, but he never stated "I invoke the 5th" either. It is a fact juries may not assume you guilty if you invoke the 5th. It rather seems he looked and realized he was defeated, meaning he knew what he did was wrong or bad.
    Now with all THAT said, I believe the jury will use the video evidence and reason among themselves, mostly disregarding the opinions of anyone else about it. There is great video here. The law somewhat does expect adults to be more responsible than teenagers, but these guys are young adults themselves. It would be interesting to hear the jury instruction to that particular point of age and age differences here. I'm juror number one, and I say the response of this guy outweighed the "fear" he could have felt, as I see no fear really, I see anger and I see defiance and ego being hurt, not fear. I also see no de-escalation from him in the form of words, reasonably expected from someone not wanting to escalate. He never says "come on guys I'm sorry lets just all calm down, and then try to walk away. He sees no weapon in anyone's hands and I think reasonable he saw no weapons yet chose to use a weapon. No-one punched him either, they just pushed him away.
    So he cannot reasonably translate that into a self-defense needed to THAT degree, stabbing them.
    As juror number one, I will give him the benefit of doubt to the degree that perhaps his drunkenness made him reason he was in some danger, so he acted. I will recommend man 1, on the homicide, and reckless endangerment. Both combined to 17 years, 10 for the first and 7 for the latter. Then there are assault as well, public drunkenness, public disturbance, but things are a bit sketchy as to who assaulted who, everyone drank and disturbed the peace. I don't know the charges here, but that would be what I would have charged, man 1 and class A misdemeanor reckless endangerment. Homicide and attempted homicide sounds like murder 2 and attempted murder, or perhaps murder 2. I cannot see murder one charges here, nor attempted murder, it is possible as you can decide in seconds if you want to kill someone, but here it is too sketchy too spontaneous in the heat of the instance.

He can be found guilty with lying with the investigator and police but I think based on how the teenager's cruel treatment to him, he should get lesser prison time. 😢 Obviously he didn't just attack them for no reason. Although, he should had walked away, and the teenagers could of treated him with respect and kindness, it could turn out differently. But he should face lesser prison time.

He stabs and stabs and stabs and stabs and stabs and stabs before leaving. He could have left and any time during the interaction. Are the victims "entitled brats". Doesn't matter, because here in America we have the right to speech. Nicolae Miu thought the words of others gave him the right to murder.
