Hi, Great presentation, question for you, for the state of Texas to do an apostille for a birth certificate to be presented abroad in Mexico. This is what I understood, submit the application, submit a statement notarized, obtain a certified copy of the birth certificate at the vital records office and submit the fee, is that it? I do have a question: When the Notary identifies the Signer, what Notarial Certificate is best to use, and is the Notarial Certificate the same always for identifying the Signer..no matter the document that goes to the SOS?
No. Some enterprising Notaries who live near their Secretary of State’s office offer "apostille services" as a way to generate additional income. They essentially provide a courier service to deliver and return the paperwork to customers. Hello. Not sure we understand your question. An apostille is issued by your Secretary of State's office or Notary commissioning agency. The single apostille is the only certification needed. Once prepared and verified, the apostille is attached to and sent along with the notarized documents. Notaries cannot issue apostilles themselves. This all happens after the notarization and requires no action on your part.
GREAT info!! Thank you so much. I remember learning about apostilles as a notary but didn't pay any attention to the information because it was said to be handled by the Secretary of State. I'm sooooo interested.
I am still a bit lost as to what the Notary's function is for an Apostille 😐. To my understanding, it sounds like the Notary authenticates the signature, and then offers to send it to the SOS for the client, and that's it? I understand that the Notary also needs some knowledge of different forms, but basically you, the Notary, are sending on the documents, to the SOS. When approved they come back to the Notary. Then you, the Notary, give these forms back to the client, and the client then sends them to the country they need to go to. So the notary can charge for their notary work and the fee for shipping to the SOS. I am in Virginia, and there's no guidance on how to do this as a notary.

For any non-English document, the best option is to refer the signer to a Notary who reads and writes the language of the document. If that is not possible, the Notary should only proceed if the notarial certificate itself is in English or another language the Notary reads and writes. The letters and characters in the document's signature and in any ID document presented must also be understood by the Notary.
So, client gives me the document that needs to be apostilled. I bring to the secretary of state. They apostille it. I pick it up from sos. Give to client, they send to the country of destination. Is that how it works? Anyone?
Very interesting. Thank you...But I've seen some notaries that offer this service in ALL 50 states. How is this possible if the apostille have to be done in the state in which the documents originated? Wouldn't you have be get a notary in that particular state?
