Honestly you could make a claim for explicit criminal intent to maximize the charges. He knew it was poison, and that the controversial thing was to spray it. He knew that this would be the draw of the video, since there is no other content in the video. His clear intent was to cause harm, which you can prove by him wanting to do it for "entertainment". Prosecution is going to have fun.
I just added this same thing, I fully agree they need to face the max charge and time, that way others will see what happens to you in case some body else thinks of doing this. Like back in the day they use to give folks max terms for other crimes as a way to keep others from trying it. We need to bring that back. Some countries still will cut off a hand if you get caught stealing why not do that here in the US? Granted that part has nothing to do with this crime, but you get the point and in a small way it would be stealing because they had to remove all that product and throw it out, so that cost the company money.

I actually met this guy after work in Tempe, AZ maybe 6 months ago. The same day he did the ice in the fryer prank. He showed me the video and was talking about how he knows he’s going to be famous and nobody else is doing anything the way he does. He thinks his stuff is top tier fever dream material. Goes to show what goes around comes around and putting negative energy out there is going to bite you back to the extent you put it out.

I was a grocery team lead at Walmart for years. Bananas are the most frequently sold item in Walmart. I find it extremely difficult to believe no shopper, or online personal shopper, didn’t grab some of those bananas in 10 minutes.

A detail that got glossed over: He didn't get rid of the contaminated items. He piled them into a shopping cart and wheeled it to the back of the store. They were still in the store. One of the things employees do is find abandoned carts and restock the items, now I dunno if that policy extends to produce, but to "get rid" of all the items he contaminated, he would have been chucking entire displays of food into the cart (The displays themselves are ALSO contaminated if they aren't washed before restocking...) An employee easily could have found that cart, found their entire stock of certain produce piled in it and thought some kid was fucking around and just put them back without thinking they might be contaminated with poison. Thats if he actually did that, thats just his word. He definitely didn't buy them and ditch the cart behind the store at the dumpsters or something because most stores don't let you buy their entire produce section, they need stock for the other customers too (A bulk sale isn't worth dozens of other customers complaining that the store doesn't carry items they need and potentially going to a competing store) so he would have had to tell them it was all contaminated by him. Also the people going "Wash your produce" yeah, sure, but thats probably not enough as the chemicals could soak into the food itself while it sits there, a quick rinse wont solve the problem. If you have kids that also goes out the window, you really thing little timmy, alone in the kitchen, is being a well behaved lad and washing his fruit before tearing in? Also who washes a banana? Maybe you should, but nobody does. That poison could have soaked through the peel but even if it didn't, its getting on your hands when you peel the banana, then on the banana while you eat it. (Same can be said of the chicken. Only Howie Mandel would be deranged enough to wash a plastic bag before opening his food.)

Target cashier here. I don't know how this store does it, but I imagine there's some uniformity. Past expiration or looks gross, it gets the bin. Otherwise, it's donated. Imagine that because you committed a crime, you will be arrested if you so much as talk or appear in a public space. Not, you committed a crime and got arrested. Oh god this happened literally in my hometown, just down the street basically. We don't shop at this location anymore, we go the other way, but to think a guy could spray all of the food and get away with it for even a second is insane. Aside from that, I’ve seen so many people just take a banana or other food item to let their kids eat it and not pay for it. Though it’s rare, there’s only been a few instances where something happened to where a customer had no choice but to eat something on the fly. As a pest control professional, I don't need to tell you that's dangerous, but I can tell you just how dangerous it is. See, pest control as a profession is ever-evolving to maximise human safety while effectively killing pests. I myself am specifically a bed bug specialist, and the three main pesticides I use are completely harmless to people. As much as I don't recommend it, chugging a whole bottle of Aprehend will not kill or even really harm you. In fact you'd kill the Aprehend, which is just a fungal spore suspended in oil. Commercial pesticides are a whole different beast. We actually discourage people from using things like Raid and Hot Shot and actively encourage people to throw those out because they're not safe for people at all. Please, to anyone dealing with pests or have commercial pesticides. Be smart, and be safe.
Absolutely agree, if I remember correctly, RAID uses a chemical compound that disconnects the "signals" between the neuron clusters in bugs' brains, causing them to suffocate. That's what happens when you spray it on a surface and they walk over it, imagine what happens if you eat a fucking surface coating of the stuff directly into your body - you could probably lose motor functions or get brain lag or something. (If I understand RAID properly, of course. I might not understand it, in which case my comment is null. I'm from Europe so that's also a factor, pesticide might not work the same internationally).

Charley is almost right about the Tylenol poisonings. The jerk opened the bottles and added the poison then closed the stuff back up. This was before the sealed bottles and shrink wrapped boxes. That stuff was started because of this.
The Tylenol murderer actually opened up a number of the hard capsule pills to put the cyanide inside, and so the victims wouldn't have even been able to see that they were tampered with. They probably bought some Tylenol pills earlier, swapped out the contents of the pills for the cyanide, and then put those bottles back on the shelves. The media attention from the Chicago Tylenol cyanide poisonings (which ended up killing 6 people, 3 of whom were from the same family) also inspired other people to commit copycat crimes. A couple of days after the 6 people in Chicago died, a man in California nearly died after taking a Tylenol capsule that had been laced with strychnine. To their credit, Johnson & Johnson took the situation incredibly seriously. They issued a mass recall of all Tylenol capsule bottles across the entire country and offered to reimburse customers with either bottles of Tylenol in the hard pill form or just refund the money entirely. Johnson & Johnson also introduced the kind of tamper-proof packaging that we're familiar with today. In addition to that, they actually changed how they produced the hard capsules by adding an additional layer of gelatin to make it much harder for people to try to tamper with them.
I get the impression that this guy basically just realized that laws are made up and thinks he's cracked some kind of code, like everyone would be doing what he does if they knew that they could get away with it. As opposed to having a sense of empathy and generally choosing not to be a terrible person because you don't want to ruin someone else's day whether it's legal to do so or not.

I actually met this guy after work in Tempe, AZ maybe 6 months ago. The same day he did the ice in the fryer prank. He showed me the video and was talking about how he knows he’s going to be famous and nobody else is doing anything the way he does. He thinks his stuff is top tier fever dream material. I was a grocery team lead at Walmart for years. Bananas are the most frequently sold item in Walmart. I find it extremely difficult to believe no shopper, or online personal shopper, didn’t grab some of those bananas in 10 minutes.

A detail that got glossed over: He didn't get rid of the contaminated items. He piled them into a shopping cart and wheeled it to the back of the store. They were still in the store.
One of the things employees do is find abandoned carts and restock the items, now I dunno if that policy extends to produce, but to "get rid" of all the items he contaminated, he would have been chucking entire displays of food into the cart (The displays themselves are ALSO contaminated if they aren't washed before restocking...)
An employee easily could have found that cart, found their entire stock of certain produce piled in it and thought some kid was fucking around and just put them back without thinking they might be contaminated with poison.
Thats if he actually did that, thats just his word. He definitely didn't buy them and ditch the cart behind the store at the dumpsters or something because most stores don't let you buy their entire produce section, they need stock for the other customers too (A bulk sale isn't worth dozens of other customers complaining that the store doesn't carry items they need and potentially going to a competing store) so he would have had to tell them it was all contaminated by him.
Also the people going "Wash your produce" yeah, sure, but thats probably not enough as the chemicals could soak into the food itself while it sits there, a quick rinse wont solve the problem. If you have kids that also goes out the window, you really thing little timmy, alone in the kitchen, is being a well behaved lad and washing his fruit before tearing in? Also who washes a banana? Maybe you should, but nobody does. That poison could have soaked through the peel but even if it didn't, its getting on your hands when you peel the banana, then on the banana while you eat it. (Same can be said of the chicken. Only Howie Mandel would be deranged enough to wash a plastic bag before opening his food.)

Target cashier here. I don't know how this store does it, but I imagine there's some uniformity. Past expiration or looks gross, it gets the bin. Otherwise, it's donated. Produce never goes back on the shelves. That's what's so horrific to me-if that cart got taken to reshop and no one purchased them, chances are the only victims are the needy. Utterly revolting.

Aside from that, I’ve seen so many people just take a banana or other food item to let their kids eat it and not pay for it. Most fruits are sold by weight, so yes they are stealing…Hot case food items are sold individually, (or eaches as we say) but there’s weighted items too.
Though it’s rare, there’s only been a few instances where something happened to where a customer had no choice but to eat something on the fly. She had a blood sugar crash, so the staff let her have a banana and orange juice, and paid for it later.

As a pest control professional, I don't need to tell you that's dangerous, but I can tell you just how dangerous it is.
See, pest control as a profession is ever-evolving to maximise human safety while effectively killing pests. I myself am specifically a bed bug specialist, and the three main pesticides I use are completely harmless to people. As much as I don't recommend it, chugging a whole bottle of Aprehend will not kill or even really harm you. In fact you'd kill the Aprehend, which is just a fungal spore suspended in oil.
Commercial pesticides are a whole different beast. We actually discourage people from using things like Raid and Hot Shot and actively encourage people to throw those out because they're not safe for people at all.
Please, to anyone dealing with pests or have commercial pesticides. Be smart, and be safe.

The Tylenol murderer actually opened up a number of the hard capsule pills to put the cyanide inside, and so the victims wouldn't have even been able to see that they were tampered with. They probably bought some Tylenol pills earlier, swapped out the contents of the pills for the cyanide, and then put those bottles back on the shelves.
The media attention from the Chicago Tylenol cyanide poisonings (which ended up killing 6 people, 3 of whom were from the same family) also inspired other people to commit copycat crimes. A couple of days after the 6 people in Chicago died, a man in California nearly died after taking a Tylenol capsule that had been laced with strychnine.
To their credit, Johnson & Johnson took the situation incredibly seriously. They issued a mass recall of all Tylenol capsule bottles across the entire country and offered to reimburse customers with either bottles of Tylenol in the hard pill form or just refund the money entirely.
Johnson & Johnson also introduced the kind of tamper-proof packaging that we're familiar with today. In addition to that, they actually changed how they produced the hard capsules by adding an additional layer of gelatin to make it much harder for people to try to tamper with them.
I get the impression that this guy basically just realized that laws are made up and thinks he's cracked some kind of code, like everyone would be doing what he does if they knew that they could get away with it. As opposed to having a sense of empathy and generally choosing not to be a terrible person because you don't want to ruin someone else's day whether it's legal to do so or not.
Well plus there are areas of high population like new York City and CA where criminals like this guy are likely to never even see jail. NYC decent chance he won't even have to post bail.
