  • The plaintiff says he brought his sweet 1988 Mustang GT to the defendant’s shop for a paint job, but she did such sloppy work that he’s embarrassed to drive it. He’s suing for his money back. The defendant says the plaintiff told her he was pleased when he picked up his car, and she denies owing anything.

Time to bust out my favorite People’s Court explanation! “The point of a lawsuit is to make yourself whole, not have a bonanza.” Presumably, there was still work that the defendants completed on the car...I’m not a paint shop or anything, but I would assume there was prep work done on the car before painted, and that’s still technically worth SOMETHING. Also, if the new shop only has to do a patch job for the shoddy spot work instead of a complete redo, that means at least half of the work the defendants did was passable, and thus they still get paid,
It seems unfair, but if the judge awarded all of his money back, she’s basically undoing the contract, and it’s like the plaintiff never went there in the first place (which I’m sure he wishes was true). We don’t know what condition the car was originally in...for all we know, they did a phenomenal job on the roof and shitty everywhere else!

Papa KNOWS what he's talking about.....that car has overspray......and fine dust...
    And if that "yellow" stuff
Is the base color of the fiberglass parts.....then
    their paint should have had
a base coat UNDER the color, because their paint did not grab onto that yellow........😬

Somebody find out the name of that paint business so we can all go elsewhere!!! Who wants to pay over 2,000 dollars for a paint job and have to keep going back for peeling paint, dirt particles in the paint, bubbles in the paint, paint overspray on the windows, etc? AND the contract, she says, states that the customer should *expect* dirt particles? Really?
That's a less than ghetto business with paint techs that should be washing dishes and scrubbing toilets....NOT painting cars!

I totally disagree with the judge. She saw how the defendant was and he shouldn’t have to return to them from the jump. Then the defendant continued to lie and be unreasonable, then she makes the right decision. Full refund is due for that subpar job. She’s being cheap on this one.

These people are oblivious. I've done automotive repair, mechanical work, and refinishing for decades, and what they were looking at on the Mustang was called 'orange peel,' and is caused by improper prepping, which can leave silicone on a panel, which causes the orange peel. The defendant knew exactly what it was since it's so blatantly obvious, so the company that insured her work may not have covered it, and she'd have ended up eating it.

One of the best cases. The plaintiff was very clever and knew what he was doing. It is crass to say "that is tape" indicating you do not really give a damn. The guy is not arguing "some paints go wrong" he is saying he paid for a service and did not get what he was paying for.

I was hoping JM wouldn’t send the plaintiff back to the defendant’s shop. He’d already given them two opportunities to make things right, and at a certain point, anyone would begin to lose faith in the shop’s ability to do the job correctly. I’m glad he won.

The defendant lady appears shady. Apparently she is an owner of an independent shop with a franchise license with one of the national quick auto paint job companies. As such, she is not a representative or spokesperson for the national chain. Which is probably the reason why the name of the shop was never mentioned during this court hearing.

If the big chain company he went to was Maaco then I’m not surprised. I brought my car there to have some body work done and they told me that it would take approximately two weeks to do the work. I was fine with that but when it hit the end of week four… I started to get a little ticked off. After that I called them three times a day figuring the squeaky wheel gets the grease. I got my car after three days of that.

I loved pops. He was so patient and kind. He was very honest and hey come on he owns a mustang as I do. Almost same color. I would ever take it to a popular chain paint store. However the defendant was so ignorant of how a car is painted. Why was she sent to represent the company. Come on “that’s just yellow tape” what paint shop uses YELLOW tape? She was a liar. I’m so happy Judge Marilyn said go somewhere else. That lady embarrassed herself as well as the company she represented. Good case. God bless Judge Marilyn for going outside with pops Kudos to you Judge!

I'm all over this case, 25 years in that business, five of them as a painter. I know a bad paint job when I see one. I can say for sure that it's virtually impossible to eliminate all dust when painting a car. That being said, it's bad prep work, definitely no cleanup before delivery, and the peeling paint definitely could've been caused by him bumping into something; those old Mustang bumper covers are flexible, so even a light bump could've flexed it enough to make a crack in the new paint, and that's all it takes. The Defendant had the opportunity to fix the problem, all she had to do was nod her head and take the first verdict....

I don't agree with partial refunds in situations like this. Should have given him a full refund, so he could have someone else else do the proper full job. The defendant shouldn't be rewarded for doing a poor job. A poor is no better than no job a lot of the times. Also, that defendant isn't a trustworthy person, everything is just brushed away or not their fault.
