    Homicide - any person who shall kill another with the circumstances for Murder - Reclusion Temporal - Error in Personae Homicide committed when Death follow whether the death be the precise & necessary consequence of the injuries or wounds.

      Tell me why you said "mahina ako sa Criminal Law". Let me provide you with some guideposts on how to study criminal Law. Just among us (girls), mahirap talaga nuong ginawa yung Revised Penal Code and the very structure of Criminal Law. How can you appreciate the Justifying, Exempting, Aggravating, Mitigating circumstances unless it is immediately applied to real criminal case. That is the reason why I immediately bring up the KILLING of a Person to understand the structure of the Criminal Offense. !st, Society has declared that NO PERSON is ALLOWED to deprieve another PERSON of his LIFE as enshrined in the Constitution. Then, the Revised Penal Code provided that a person who kills another is immediately condemned by society as a Criminal, who does not deserve to be mixed with the majority of innocent members of society. So, the one who killed another will be separated and isolated from society so he cannot repeat his wrongdoing, by way of putting him to prison. Criminal Law immediately concludes that killing a person is HOMICIDE and the INTENT to KILL is imposed by Law. However, the requirement of DUE PROCESS of LAW will be afforded the supposed Killer. Society, through a complaining Witness & Victim, proves that the supposed Criminal indeed kill the victim or the complainant's relative. There has to be PROOF beyond Reasonable Doubt. Any element of Doubt about the guilt of the Accused will entitle the Accusation against him to be dismissed.
      In understanding Criminal Law, that is how the start with understanding how the Killing of a Person becomes an act punishable by Society. In studying Law, we then bring up the Concepts of Exempting Circumstance - yung sira ang ulo may have committed the Killing but his mind could not have created the INTENT to Kill, dahil sira nga ang ulo nya. So, there is an offense against Society in the Killing but the killer cannot be punished because his sick brain could not have allowed him to INTEND to kill. His mental sickness is the EXCUSE for not punishing him like an ordinary criminal. Society intervenes to isolate him by putting him in a mental hospital so he can be cured. That is how we can readily understanding Exempting circumstance.
      For a normal person who killed, another person, did he really have the intention to kill? Here is where the KILLING can be given a good reason by society to excuse the Killer. This is where SELF-DEFENSE comes in. Pedro, for instance has a right to his life. No person can ever threaten to kill him. It is equally human nature to expect Pedro to prevent another person to kill him. Hence, the JUSTIFYING CIRCUMSTANCE of SELF-DEFENSE. Here, Pedro could have killed Mario because Mario started to attempt to kill Pedro. When Mario got a knife and suddenly attacked to Kill Pedro, his ACT was AGGRESSION against Pedro. So, when Mario commenced stabbing Pedro, umastras si Pedro at sinasangga yung mga saksak ni Mario. Nakadampot ng kahoy si Pedro, kinuha nya yung kahoy, dos por dos, at ipinalo kay Mario - tumama sa ulo ni Mario - napuruhan, patay. So yung kahoy na ipinampukpok sa paglaban sa pagsugod ni Mario ay makatwirang paraan para lumaban si Pedro sa pag-atake ni Mario. The intended Victim employed reasonable means to avoid being killed by the Aggressor/Attacher Mario. Finally, wala namang ginagawang paghahamon, pang-iinis or PROVOCATION is Pedro kaya nagalit si Mario.
      To my mind, the way to start Criminal Law is to immediately bring in an incident that a fresh Law student can readily understand and intelligently react.
      It is after laying this simple Model should the discussion on what precisely is Criminal Law . . .
