      Hey should you give any statement at all. Even if its the most basic thing. Like he had a bat. I told him to stay back, he came at me with the bat and i shot. I want a lawyer.
      Or is it better to let the evidence and eye witnesses if there are any do that. Like how do they know its self defense shooting. Or is that the thing you tell the dispatch.
      It a confusing thing. So what do you want to do right from the get go

    It's crazy how complicating and life changing protecting yourself from someone else's actions could be. It's already a challenging enough scenario unfolding if you have to use a firearm, but I could only imagine the challenge sitting in prison contemplating decisions looking back with all of the free time.

      They make it sound that way because they want you to pay for a USCCA membership and you'll only do that if you think you need it. USCCA does offer some good advice, but their videos sell memberships by using scare tactics against the viewers. As an LEO, in California of all places, I can say it's exceptionally rare for the shooter in what outwardly appears to be a justifiable self-defense shooting (particularly in the persons home after a break-in) to ever get arrested or booked, let alone be charged with a crime. You might be asked to go to the station or the sheriff's office for a formal interview, but you can only be arrested if the officers or detectives have PROBABLE CAUSE to believe you committed a crime. If they believe the shooting was legitimately a self-defense shooting, that removes probable cause and negates the authority to make an arrest. You might even be detained and brought to the station (as you certainly would if you declined to make a statement), but you can only be arrested and booked if the police believe it's more likely the shooting was unlawful than it is that it was self-defense. And in order to actually be formally charged, the prosecutor would have to agree with them on that. Shooters in legitimate self-defense cases very rarely see the inside of a jail or a criminal courtroom. (What's more likely, unfortunately, is to get civilly sued by the family of the dirtbag criminal who caused you to shoot them - but that's a problem related to the civil tort system and not related to the criminal justice system.)

      @@bocefusmurica4340 As far as qualified immunity goes: Yes, I have qualified immunity 1) when I'm on-duty, 2) acting in an official capacity, and 3) acting in a lawful manner. Qualified immunity is a protection against a personal civil lawsuit, not criminal charges. My agency can still be sued and I can certainly still be charged with a crime if prosecutors believed I acted unlawfully. I can also be personally subject to a civil lawsuit if my agency determines I knowingly acted outside of policy and law. If I did not have the limited protections of qualified immunity I would have left LE a long time ago - and so would every other peace officer I've ever discussed qualified immunity with.
      As far as "special privileges" go: I do have the ability to legally carry on and off duty as long as I am employed and in good standing. But that doesn't shield me from the same legal scrutiny that is applied to anyone using deadly force. The rules set out for the use of a firearm by a peace officer are pretty much no different than the rules that apply to a non-LE citizen using a firearm. In fact, the peace officer is likely to be scrutinized to a greater degree than a citizen in their home or a private person with a CCW on the street in any use of force situation because the peace officer has more training and experience in the use of deadly force - therefore has a greater expectation from the public and the courts to use that force in accordance with existing statutory law, case law, their training, POST standards, and their own departmental policy. (In other words, it's more forgivable for a private citizen to use what could be considered by experts an excessive amount of force when presented with a real potentially deadly threat than a peace officer due to the private citizens relative lack of training and experience in dealing with such scenarios as compared to a fully trained peace officer.

    Pretty scary stuff. I am elderly, diabetic, 4 stents in my heart, insulin dependent and other health problems. I would worry about having my medications, food and water available to me.
    Would I be alone in the holding cell, what about my personal security from the other prisoners?
    If it was a home invasion, would we have to leave the house for a few days since it is a crime scene? Who would pay the motel bill? It sounds stressful and complicated.

      @@muddog1561 Hi Two Bears, thanks for responding! Poor health in our old age is not something we think about as a youth, however, it is a problem to deal with for sure.
      Do you live in Florida? I looked up Lake George and is seems to be a great lake for fishing. I subscribed to your channel and thumbs up. I live in Central Alabama in the Birmingham, metropolitan area. We need rain.

      @@muddog1561 I looked at your videos and they appeal to me. I like the cane self-defense. I have diabetic neuropathy and that along with positional vertigo, I depend on a cane or walking stick anytime I am walking. We have some pretty bad summers in Alabama as well.
      Other than a cane, what do you use for self-defense in Florida. Does the summer heat dictate a compact pistol or small frame revolver?

      If my understanding is correct, if you believe you need medical attention they have to let you go to the ER although they'll go too. If you think you need medical care, ask for it.

    As an officer,I very often told the arrested person [ or "in custody person ] that they had the "right to remain silent".
    And then I would say,"so take a large glass of STFU".
    Many followed my advice.
    Be polite as stated,but STFU !.

      BUT I had to memorize the state USE OF FORCE LAWS,and they are VERY DIFFERENT from a citizen to a officer.
      Maybe not in your state = OR "maybe" you have never actually READ THE LAW ?.

      *...if you're innocent during an investigation because even if you just listen to questions your non-verbal cues & body language can "give you away" & once a person starts talking it is harder to SHUT UP! So unless you intend to train & practice some generic statement that you can unfailingly make flawlessly while under stress & pressure, just lawyer-up! "I want an attorney." Besides, even IF you were skilled enough to pull off such a refined statement due to YEARS of repeating it to yourself, even in your SLEEP, any decent investigator will find it highly suspicious because "innocent" people under such circumstance that choose to talk, can't articulate as well as you did. Thus this may mislead an investigator into thinking your shooting was to some degree premeditated, a "vigilante" just looking for an excuse to get your gun off. So....just shut up.*

      *Reading body language, micro-facial expressions, etc can reveal nervousness vs calmness, generally speaking. But how those cues are interpreted is subject to the bias of those analyzing them. Sadly, it is not uncommon for an innocent person to be falsely charged & even convicted as a result of a body language "expert" overeager to prove his worth.*
      *Hence, simply listening to questions may cause you to react in ways that can be misinterpreted. So, after saying "I want an attorney", don't speak, do not even listen, but start concentrating on a fun & unrelated topic.*
      *If you're guilty of crime nothing will save you.*

      I wish I could say that it didn't.... but I ultimately killed my attacker (He was in the process of beating his girlfriend to death, and when I stopped him and she got away, he turned and went after me and got four Gold Dots for his trouble and died before he hit the ground). I was exonerated of any wrongdoing quite quickly and declared a hero by the DA and the local cops and firemen, but I left a part of my soul behind that night. Even after nearly 3 years (3 year anniversary coming up here October 16th), it still haunts me. Would I do it again? Yes, but the price is high., higher than you think. Its tough to explain to someone that hasn't had the experience, but I am now set apart from most of society.... I performed the most immoral act there is, I ended the life of another human being, someone's father, someone's child, and I can never take that back. Just something to think about.

    The system process is 100% corrupt and is in need of major reform.I say this because even if it is proven in court that a person acted in self defense and is found not guilty that person may have been fired from their job because of being held in jail for 2 to 5 days or longer plus the loss of thousands of dollars paid to their lawyer ect.just for the right to defend themselves...thats not justice its fleecing of the good people for doing the right thing.

    I am a supporter of law enforcement, I truly am, and have many friends in local, state, and federal law enforcement… so I say on good authority that a huge part of the reason for this process, EVEN when things are not all that sketchy, is because a majority of LEO’s are trained NOT to seek truth & justice, but to find charges, because “Everybody is guilty of something.” One trooper works by the motto “Show me the man and I’ll find something to charge him with.” The justice system must stop rewarding police and prosecutors according to arrests, charges, and convictions, and pay them and promote them for the sheer courage and nobility of their character & service.

    So I have a couple of questions. At what point during this timeline of events do you have an opportunity to call an attorney so that they are present with you during the interview process? You're not going to have time to call one before the cops show up and once they arrive you're going to be in custody, so I'm not sure when you'll get the chance.

      Once the police try to interview you, you ask for a lawyer. Pursuant to the U.S. constitution and state constitutions, you are entitled to a lawyer and if you cannot afford to pay for said lawyer's service, the government pays for them.

      It is illegal to refuse to allow you to have a criminal lawyer in the interrogation room with you. Also if you are arrested and not detained they, the cops have to Mirandasize you.

      I thought if you shot a bad guy in your house and you did everything in accordance with the law, basically it appeared to be a clear cut case on your behalf, it still may not be that way in the eyes of the police. As far as I am concerned, your suspect until you are officially declared justified and no charges will be filed and pursued, by then your life is upside down and it may not be over just yet, you still may face civil litigation and that is a whole another story.

    Perhaps seeing the whole scenario from an incident (home invasion, carjacking, pick one or do several) to how to properly handle each step of the fight-after-the-fight (calling 911, to first contact with police, to detainment, to questioning) would be helpful..

    5:41 "That's what 'we' like." in reference to what police officers like during an interrogation. What about getting at the truth? Are all police so simple minded and/or lazy that they don't care what is true or false? Say a person who never committed a crime in their life and has shot someone in self-defense; emotional; extremely nervous; exhausted, perhaps starving or thirsty, all of a sudden is looked at as guilty because they do not have a photographic memory or cannot remember every nano-second of the horrendous ordeal they have just been through? And here you have "Mr. Cop" trying to get them to say something that may help turn their case against them? What about if the person has PTSD due the stress of their encounter? Does that make them guilty too? Police can suffer from it, why not citizens? I think it's time that any law enforcement officer be held to the same standards that any citizen already is during any type of official interview: police should not be able to lie to you, or purposely try and coherence you into saying anything, just because they represent authority or have a gun. We are still Americans (contrary to what many would have you believe) and afforded the right to be innocent -- until PROVEN guilty. We need professionalism, not scare tactics or psychological manipulation. Criminals will have no problem lying to cover their actions. The average person who has never been arrested is not trying to become an actor on L.A. Law or something, and just expects reasonable behavior from the police who work directly for them and who are directly responsible for paying their salary. 11:25 "They are 'probably' not trying to trip you up." Isn't that special? You would think the police - usually being paid by the hour - would have the professionalism and the morality to actually uphold their oath and do their best to serve an protect, which includes the rights of any person suspected of committing any crime also. They should be acting under their sworn oath and capable of properly investigating any situation, to arrive at the truth, as best they can, and not only "trying to trip anyone up?" They are not judge, jury, and executioner.

      You assume a lot about his character. If youve ever watched live police type shows like cops. Youd know that guilty or dangerous people are famous for those excited utterances. In your example its an innocent man contradicting himself in a fugue state. Which can definitly happen. Ive had it happen myself. Not from a cop but other authority figures in my younger life. But what about all the times where guilty people admit theyre guilty.
      Tldr. Cops arent evil.

    The absolutely most dangerous question a cop can ask you is, "So what happened?". An open ended question like that leaves you vulnerable to making any number of questionable comments that can be folded and twisted against you.     What's the point of states having the castle doctrine or stand your ground if doing so can land you in prison.
    And what If you don't have an attorney. Do you sit in the county jail untill you get a lawyer. Also once you say you want a lawyer, how many cops actually stop asking questions?. If their word against yours

    I'm paying these fees to USCCA insurance for my wife & I (for years)...now you're telling me I could be in jail for awhile before I even get to see my attorney for legally defending myself with my gun? I guess this is still better than having to foot the entire bill and then also having to find and secure my own attorney, but you made me believe (upon selling me this insurance package) that you would provide legal representation, available extremely fast (like within hours). This sounds a lot like our wonderful politicians...promise me something to sell me on the issue (shake my hand, hug my wife and kiss my baby), then only to find out that was a crock of BS to win my money/vote. I sure hope I don't have to sit in jail for days before you afford me with a USCCA attorney because your home page specifically states "avoid jail time".

    The one serious time I had to deal with a police interrogation I told the detective first thing that I would answer a question ONCE, and only once. When he tried to play the, "ask the same question slightly different again and again," I just stared at him.
    Guess there was some benefits from dating a former cop who went on to become a defense attorney. She loved telling all about the tricks the cops use on people...

      @@RichieRich7339 The key is self-control. Cops are trained to get people all worked up and stressed, because that's when people start talking without thinking. If you keep your cool, refuse to play the usual police mind games you take away a lot of the tools they depend on.
      There's a video somewhere on YT that shows how police will even set up the interrogation room to throw off the person they are talking to. Once you are aware of these tricks, you have a better chance of shutting them down.

I know half the times I've been pulled over for speeding I'm always cool and not the slightest bit agitated but the crazy part is how they'll let you off the hook seeing as though we all know some people melt down and go crazy with that level of police interactions. I already do my best to stay cool when police are around since they have the badge and the gun.

      NOTHING you say can be used to help you, (it's all hearsay), and EVERYTHING can be used to hurt you.
      That's the part of the US legal system which is so twisted - confess to a cop and the cop can directly testify to that in court, but explain exactly why it's impossible for you to be guilty and the courts won't let the cop say a single letter on the stand.
      Sounds fair to me.

    I'm a 8 year army veteran and was assaulted by a young black man over a random parking spot. I took two punches to the face without putting my hands up then dodged the rest. I called the cops and the guy lied and said I called him the n word. He did not get arrested. I didn't want to fight back because I outweighed the kid by 90 lbs. I don't know what I did or said wrong. I'm very interested now in learning laws and rights.

    Thank you so much for this video. Killing someone SHOULD BE a serious process, ensuring that it is an absolute last resort! One thing not mentioned… if I shoot someone and get arrested, does my wife or other sympathetic witness have the same rights to attorney/silence? I also don’t want them saying the wrong thing in the heat of the incident. What do they do?

    Ok I am a USCCA member. God forbid ever have to make this call. Yet say you do have to defend yourself & you reach out to USCCA first. Yet there's a witness on scene and they call police before you are able. How can you have someone ready & prepared to represent you in the spare of the moment that same day? It seems nearly impossible to especially considering they're gonna want to question you right away. It's not like they're going to say ok we believe you just come speak with us when you get a chance...

    So I defend myself from a burglar or someone threatening me or a family member and being an older gentlemen I use deadly force, according to all of this I will be put into the same scenario as the bad guy. Tell me that is not screwed up. Our freedom is threatened more then ever these days.

      You are in a vulnerable population, therefore you're likely to get more leeway if you use deadly force. The disabled and females are also considered a vulnerable population.

    Don't talk to the police. There's a great youtube video on it out there given by a law professor James Duane and George Bruch, a cop. Look it up. Don't talk unless you talk to your lawyer first and only through them.

    The notion that police get away with murder is ludicrous, Masaad Ayoob who is a cop also became an expert witness at trials because zealous prosecutors wanted to hang police officers for being involved in shootings in the performance of their jobs. It can go just as bad for a cop as well as civilians. I know several police officers that brag that they haven't had to pull a gun, I can see why.;

    As a USCCA member, the take away from these videos is.
    Never carry your gun, you are better off getting shot/killed, than playing the self-defense roulette.

    A lot of advice in this series of videos is very good, but the prospect of being arrested and charged after a legit self-defense shooting is always greatly exaggerated by the USCCA lawyers on the panel. They make it sound that way because they want you to pay for a USCCA membership and you'll only do that if you think you need it. It's a good sales tactic, but it's not the legal reality most of the time. USCCA does offer some advice and legal representation, but their videos are made to sell memberships by using scare tactics making the viewer think it's somehow likely they'll be arrested, booked and jailed if they legally defend themselves against a burglar who broke into their home in the middle of the night.
    As an LEO, in California of all places, I can say from my personal job experience that it's exceptionally rare for a shooter in what outwardly appears to be a justifiable self-defense shooting (particularly if it occurs in the persons home after a break-in) to ever get arrested or booked, let alone be to ever be charged with a crime. You will likely be asked to go to the station or the sheriff's office for a formal interview, but you can only be arrested if the officers or detectives have PROBABLE CAUSE to believe AND DO BELIEVE you committed a crime. If they believe the shooting was legitimately a self-defense shooting, that removes probable cause and negates their authority to make an arrest. You might be detained and brought to the station against your wishes (as you certainly would be if you declined to make a statement at the scene), but you can only be booked if the police believe it's more likely the shooting was unlawful than it is that it was self-defense. And in order to actually be charged in criminal court, the prosecutor would have to agree with those officers.
    Shooters in legitimate self-defense cases very rarely see the inside of a jail or a criminal courtroom.
    (What's more likely, unfortunately, is getting civilly sued by the family of the dirtbag criminal who caused you to shoot them - but that's a problem related to the civil tort system and not related to the criminal justice system. In all likelyhood (especially if it's a home break-in), if you fight the civil case in court, you will probably win - but unfortunately the attorney fees to do that could cost you more than it would have cost you to settle the lawsuit out of court. It's the civil court side of things that should concern people the most, and it's also what needs to be reformed the most.)
    Everyone who owns a gun for defense should be knowledgeable of the laws and the criminal justice system, and be prepared to exercise their rights and navigate that process in the best way for them possible, but a fear of automatically being arrested for doing so is an unfounded fear that often gets pushed out to people by the messaging in these videos.
    Feel free (and do) get legal council concerning the potential issues of having to use deadly force, but don't be paranoid to the point where you expect to be arrested if you do have to and it was justified. That's not really how it works in most jurisdictions (even lefty controlled California).

    Why is it that the person arrested is not taken to the Magistrate before bring taken to jail? Isn't part of due process? I thought only a Magistrate can authorize the jailing of man. Why is this not the case? What is the notion that this protection is no longer available? If the process is jail before being seen by the Magistrate where is the judicial oversight? What about probable cause rights being required and the officer not having the power to jail isn't that the duty of the judge to authorize by warrant the jailing of anyone. It seems odd that an incarceration leads to a hearing instead of a hearing leading to an incarceration . Where have the checks and balances gone and why is it the job of the police to do the actions of the judge? Officers now have the right to arrest without warrant or affidavit of fact?

      Going to jail here is not really being jailed. You are however, being detained by the police on a probable cause warrant. You called the Police in a way of speaking and said that you had just shot someone. Say this is the scenario. The police show up and have to find out what really happened as they were not at the scene. Anyway, to make a long story short, when you are detained at the scene of a crime, you will be held while the police investigate, the facts will be taken to the District Attorney in the region in which the incident occurred, who will then take it to a Judge to be heard. As this will be a criminal matter you will have a right to a Jury of 12 of your peers. In this country, realistically, you are guilty until you prove that you are innocent. The Police are simply doing a job. Some are so burned out you cannot imagine. Remember, the Police are people just like you. Mature adults not somebody wanting something their own way like a child. The

    "police are getting more training on what happens to people...." If police are so ignorant of what happens to people in a self defense situation, then why do so many departments have policies that give officers a couple days to cool down, retain counsel, etc, before questioning them after using their service weapon?
    I get that they have a job to do and that it doesn't include just believing everyone who says they're the good guy. But this idea that cops just don't know how psychologically vulnerable you suggest being put in legitimate and reasonable fear for your life seems... Hard to believe

    Interesting topic. I don't carry in public, though I have many friends that do. I do keep a small 380 in my vehicle which is legal in Texas under the "traveling" provision. I don't have a prearranged attorney. I do know a bit more about the courts than from just TV shows. I feel like I lack preparedness in the low likelihood that I should need to shoot someone. With the timeframes you describe, I am 71 and have a number of medications that I take daily. I am curious if that presents me with a health risk to be detained.

    Great information, gun owners we must to be careful and if we have to defend ourselves and it must be dont right. And the great cops who serve ask Jesus Christ for common sense when you are called about a shooting dont assume the one with a gun is guilty and try convict a gun owners when you cops are gun owners too , most gun owners are smart and have knowledge and are law abiding. Judging from this video its like some cops are trying to give us hard time, why are you trying to get a shooter in trouble in the interview room a shooter is nervous from the incident and you are trying to trip them up this not right Mr police officers.
