बहुत सुंदर। अच्छा विषय था। आपके इसी टॉपिक से जुड़ा एक सवाल है।
केस में दो आरोपी थे और दोनों ही विदेशी नागरिक हैं। दोनों पर Crimincal Defamation का केस दर्ज हुआ और दोनों ही कभी भी कोर्ट में नहीं आए। Summons तीन बार जारी हुए। 6 बार NBW जारी हुए और दो बार पुलिस ने, दोनों आरोपियों के भारत में अलग अलग ठिकानों पर जाकर अरेस्ट करने की कोशिश भी की। लेकिन वो दोनों भारत से भाग गए।
कोर्ट ने फिर 82-83 की कार्रवाई भी कर डाली। 83 में कुछ खास नहीं हुआ क्योंकि भारत में उनका कुछ भी Investment या फिर पैसा इत्यादि नहीं छोड़ा उन्होंने।
अब सवाल ये कि अब कोर्ट किस धारा के तरह इस केस को आगे ले जाए या Final Judgement दे - धारा 174A या फिर 299 CrPC? क्योंकि ये साफ है कि वो दोनों विदेशी, अब कभी भी भारत वापस नहीं आयेंगे।
