      @@bookworm2625 it got stretched out until March 15 so I had to keep going BUT he faked a seizure at the courthouse & they did not like that so I ended up winning without having to testify!! :)

      I shouldn’t say without testifying bc technically I wrote what happened and submitted evidence but I didn’t have to relive anything verbally which was better than I expected!

    So is his case just for a protection order or is it the beginning of the criminal assault prosecution? I notice neither is represented by councel. Most judges would advise against that. Also, I wonder why the woman didn't want heer mother to testify if she was willing to? Would her testimony hurt her side of the case?

      This is just an example and not a real case, but this appears to be civil court. A lot of people do not retain a lawyer for civil protection orders, but you are allowed one. Rather than a jury and several days of trial, it's just a few minutes and the judge makes a ruling on the spot.
      As far as her mother testifying, I'm not sure what the strategy would be, but I'm guessing they just wanted to show that you bring your own witnesses and decide whether to have them testify or not.

    He literally admitted to the crime by saying he hit her back being that he's the defendant and by stating that he can't remember if he said he would kill her. Some men only have semen and no neurons.

    I’m going to court tomorrow for same thing my ex said that she’s signed her physical custody over because I was charged with reckless driving and she’s stated she registered a domestic violence protection order 3-14-22 but it’s was dismissed now she’s claiming I’m harassing her with email and court order for anything other than what’s she’s claims I’m coming to kill her and take my daughter all because she’s lost primary physical custody again 1-18-22 she’s didn’t come to court

      @@mtbiker4life918 The judge wants to be extra careful probably. That's okay, I guess, if it's temporary. The really bad part is that he's the one whose going to 'saddled' with court costs and there has also been a "finding" against him which could really hurt him 'psychologically' and could be used against him later. Also 'housing.'
      Those are really the worst parts I feel. I understand her taking a side, but not that. I feel judges should be more careful.

      The night I was arrested, every single person booked into the jail that night was a domestic violence accusation. I spoke to a few, including an older gentleman with defensive wounds on his forearms. It's mind-boggling. I know DV is an issue, but this isn't the way out.

      Hi I'm John Bonacci and I bring awareness about the few women who abuse the NJ DOMESTIC VIOLENCE ACT OF 1991, N.J.S.A. 2C:25-17 to their advantage.
      The woman Jodenise Muller that I have documented in my videos are to show you the hidden way they abuse the law enforcement system. These women like Jodenise Muller abuse the NJ Domestic violence act by calling the police on their ex-boyfriend, ex-husband, or their husband and tell a very compelling story to the police. The NJDV Act doesn't give law enforcement any other choice but to establish the so called victim, a Pro Se court hearing between only the NJ judge & the Victim. I bring to light through my videos women like Jodenise Muller put real victims at great danger by lying, and knowingly creating a false police report that leads to a Judge unknowingly establishing a Temporary Restraining Order that will restrict a innocent man of his rights all without any DUE PROCESS.
      Due Process is the core of our American court system. Women like Jodenise strain the NJDV system that could be saving lives that are in real danger. By Jodenise Muller & Brian Conrad using the system to gain personal power they have deprived the citizens of Vineland NJ their safety, and police protection. There are so many reactions that happen because of their own greedy actions. Now Judges, and any other court system that helps NJDV Victims have to be very careful to every DV case so the NJ courts do not put a Final Restraining Order on a innocent person. Watch my videos how a made up story has created Chaos to my family, the courts, and to a real victim of Domestic Violence.
      A real domestic violence victim could have been saved if Brian Conrad & Jodenise Muller never lied to the police by using the NJ domestic violence act system to their advantage.

      when I was in jail, most men were there for child support, DV issues, and violating probation, it's a damn shame.

    They forgot to say if she loses the case then she will file another one the next day. I have had to pay a attorney to attend like 5 of these. It’s funny they use this system to harass people.

      @@Nyree129 they absolutely can, as a matter of fact they can actually file in another courthouse the very same day with the exact same allegations.
      Now if the judge is sympathetic to the respondent and realizes there is an ABUSE OF PROCESS going on then the respondent can then sue the plaintiff, but it's still very hard to accomplish.

    In PR...she complains to police...straight to jail, never allowed to speak...46 days before bail, then ankle monitor until trial...again, only one side, men cannot speak

    Does anyone know:
    1. If the defendant doesn’t suggest someone to help with the child’s visitation, does the plaintiff choose?
    2. Do the pictures submitted by the defendant have to be taken by the police? And, if the defendant took her own pictures would the police include it as evidence?
    3. If the plaintiff never filed a police report for an event, can it be brought up? And can witness testimony be submitted as evidence for that event?

      Obviously I'm very late, but in case this helps anyone else:
      1. Technically it's up to the court, but the court will tend to be very open to suggestions at this point.
      2. Absolutely not! It's possible that this may influence the weight with which the court (judge) will see the images, and open the door for objections if their probative value cannot be demonstrated, but a court should be open to viewing and evaluating pictures no matter who takes them.
      3. It absolutely can be discussed. Witness testimony is ideal, but most courts will even be willing to admit notarized affidavits from witnesses who are willing to explain in writing what they saw. Other forms of evidence may also be admitted to help the court determine that such incidents did, indeed, take place. For instance, if one of the parties fled to stay at a hotel for the night, or if there are medical reports or other forms of circumstantial evidence which tends to support a party's description of events.

    I would have liked to know where Mr Smith got the idea from that Mrs Smith was cheating on him. He just said "he knew." Neverhtless, even if true, it doesn't excuse his behaviour but at least gives a reason. Anger management might help.

      he didn't articulate in the best way, the argument swayed to her and he didn't defend himself properly! There is no equality it's a lie, even if she hit him first he should had left filed a police report and brought that to custody court!

      he allegedly threaten to kill her, just what ever she is saying, she has to prove what she is saying. the alleged threat goes to her because maybe she is a pos person, that doesn't mean he is threatening to harm his son!
