      Why dose the exhaust make those popping noises anyway?? I've seen comments how owners like the popping noise, but why do hyndai give it that sound (sooner or later someone is going to put flame throwers in😂)

      lol that statement is so true.
      there was a cop that lived across the street from us he was a complete asshole always talked down to us and treated us with complete disrespect.
      the story starts with the lawn care guy he usually showed up cut the grass and was done and gone within 30 to 40 minutes . both me and my girlfriend noticed after seeing him show up and cut the grass he would pull up cut the grass then put away his equipment heather would be standing outside and he would walk back up to the door where she was standing he gave her a hug and grabbed her ass they then walked into the house. i don't know what they did but we sat there waiting for him to come back out he was in there for an hour she let him out and walked out to the truck with him and talked for a bit then she walked back in the house and he drove off.
      we then realized why this guy was in a bad mood all the time the next time we seen him he was rude and i said i know why your always in a bad mood not getting any huh?
      he got so pissed off at me and we got into a heated argument i then slipped and told him about the lawn care guy and his wife.
      was the best thing i ever did, he eventually confronted her i heard them arguing out in there back yard and the following week he got a small u haul truck i thought he was kicking her out but turns out the house was hers she kicked him out.no more asshole cop to worry about.
      and i bet you could guess who lives there now with her that lawn care guy.

      That officer is a perfect example of police overreach. His attitude leaves EVERYTHING to be desired. His personality type should be kept out of uniform to avoid this kind of abuse of power. Not everyone is suitable for positions of authority. A feeb brain cant process the job and it's humanity simultaneously, making officers like this one a liability to the public.

    California is out of control with stuff like that, and the cop was clearly being a complete jerk. If you get pulled, get it into Normal mode and NEVER admit to any wrongdoing. It would be his word against yours, he didn't have a db meter to reference.

      @@opadilla123 Unfortunately there's no timestamp on his footage, however it does appear to be some traffic around and from what I can see, commercial buildings on the right. So I don't particularly have any qualms about him being in N mode. For example, I get home around 5AM, I'm in N mode until I get to a residential area - that makes sense to me.

    The police officer's actions were deplorable, but what really gets me is how the state handled it afterward. How was this not immediately thrown out by the DMV or a judge boggles my mind. Even after it all with the dealership invoice in hand, it still wasn't thrown out or reduced to a simple noise pollution ticket... I can't imagine how this guy feels right now. Modern bureaucracy at work.

      @@ryankwan1934 they’re allowing a corporation to produce products that violate state law. There should be a temporary exemption passed on these models and a mandatory recall to remedy the issue.
      I don’t see how crushing individual citizens with fines or removing their ability to travel to work is the correct solution here.
      The laws as written are more geared towards citizens illegally modifying their vehicles not manufacturers (who are very well regulated by the state and federal government) mass producing illegal vehicles and the buck stopping with the citizen.

      @@AlphabetCo-lk9jo The Track mode is meant for the Track. The State tests it in normal mode. Do we mechanically or software limit cars to 60 mph because that's the speed limit? Of course not. Hyundai provides a disclaimer that the Track mode is not meant for street use.
      Volkswagen also provides a disclaimer that the Golf R's launch control is not intended for street use. The Mustang GT350 comes with a city sound mode in Europe. It's up to the individual not to be aware of local laws and not break them.

      That’s the issue with the ticketing system, it only affects those in the lower and middle classes. Some rich dude will fight tooth and nail in court with a top class lawyer and win because he can.     I’m a cop and I’m about a minute and a half in and I’m literally sitting here with my mouth open at how he’s speaking to you. This makes cops look awful, no other way to put it. To tell someone they’re going to spend 7k removing a factory option and sound like they’re enjoying breaking the news to you, man this guy has some problems outside of work I would guess.
    Edit: also certain laws/rules are a joke and that is one I would never enforce knowing about cars a good amount myself and it being a stock car I would just say have a good night drive safe. This whole thing blows my mind but then again California seems like a pretty terrible place in general these days.

    We need to start holding individual officers responsible and using civil litigation as the consequence. Don't sue the department, sue the individual officer and make them pay. They might think twice about abusing power if someone can sue the crap out of them.

      That'd be great as long as they actually lose in court. Too many times you see cops get away it with nothing but a slap on the wrist even when they were 100% in the wrong (usually a short suspension on paid leave). A crook cop like this guy needs to be sued so badly that they themselves pay for it big time and lose their position permanently to set an example for every other crook cop out there who thinks they can get away with abusing their power.     That officer was trying his hardest to escalate the situation as far as he could. I bet it pissed him off more than anything that the guy he pulled over was polite and completely compliant, so he got petty and pulled his registration just because he could. That officer is a toxic mess!

      I'm sure its some combination of personality, unhappy/depressed for some outside reason personal problems, jealously of other people seemingly having a good life with new car and or adrenaline junky who was looking for a chase etc.
      Like the video said, if cop wants to enforce the noise law fine. All he had to do was give him a ticket for excessive noise/disturbance. He knew it wasn't modified, one of the first things he asked was is it in track mode. Cop can feel like he didn't just let it go, and driver would have small fine and learn not to put it in noisy mode around people again. That would seem like the strict but reasonable way to go. He went with the; lets see how much I can ruin this guys day approach.

      What did being polite and cooperative do to help in this situation? This is why you don't talk to cops - period. you give them your name and birthday and the required registration/insurance and that's it. If the driver didn't admit he was in track mode, the cop would have had less options on what to fine him for. Admitting to being in track mode made his life a lot more difficult. If he hadn't admitted it most likely the cop could only have given him a ticket for being too loud. If he had to go back to the inspector for loud exhaust the inspector likely would have put it in normal mode and inspected it as usual in normal mode. Then the driver would have got a clean inspection report and the driver could have probably got the ticket thrown out with documentation showing it's under the db limit.

    Every car sold in the state of California has to meet the state's standards on noise, pollution, safety, etc. The fact that this car is sold in the state means that there's no legal basis, at all, for his registration to be suspended for driving an unmodified car regardless of how loud it is.

      Absolutely! I own a 2022 Camaro ZL1, which I’m sure most would agree is going to be louder than 95 dcb. If the manufacturer sold it to an authorized dealer, that dealership HAS to follow state guidelines/laws for all of the above mentioned. In other words, even if the owner somehow has to change or sell back the vehicle, it’s the dealerships responsibility to cover the costs.

    I've got to say I'm impressed with the officer. He succeeded at being as unprofessional as possible without literally pulling the citizen from their vehicle and beating them half to death on the street.
    In my years in law enforcement individuals like this officer were the exact ones you hoped would not be coming to your assistance yet they would always need it because they would escalate every situation and try and use their authority to make themselves right when they were almost always in the wrong.

      I've gotten 3 state ref tickets in a miata and 2 in an AW11 MR2 - they've all been interactions like this and all with California CHP. Sherrif and local PD in my counties never messed with it. Highway patrol? Straight to car jail.

      @@404nobrakes well in my mustang I have active exhaust when I put it in track mode it always says “for track only” which is how I assume they get around the decibel limits. So technically track mode is for track use only so I can see how it could be “illegal”

    Cop here and car enthusiast. That’s absolutely insane. I have never I inspected a car nor have I ever sent anyone to inspection, it’s a waste and time and money for everyone involved (mostly the kids that are just doing stuff as a hobby) I was sent to inspection as a kid for having a loud car growing up and made it my goal to never do that to someone.

      Wouldn't the fact that it was presumably sold in, as well as licensed and registered by the state of California completely negate everything the officer was saying. If not how would the dealer be able to sell the car there and how would the driver be able to get plates and insurance for it? All of this assuming the car is still factory standard.

    This is a prime example of community policing vs policing the community. Instead of educating the driver and allowing them to address the issue, he goes straight into a "punishing" mode to teach the driver a lesson.

    No law against sport or track mode use, even on public roads. U can ticketed for loud exhaust, BUT the LEO should document sound level (did he have device to measure decibel level). If not, then go to inspection, get vehicle checked in NORMAL mode and that's all that can be done w/o any lawful justification.

      tack on the extra cost of the trim level, actually tack on the cost of the whole car as it was obviously one of the reasons you bought the vehicle in the first place. then sue for inconvenience and emotional distress facing a large financial burden. the pull over also seems suspicious as they weren't pulled over for speeding, exhibition of power, racing OR ANY OTHER REASON... they are not equipped with db monitors, and its doubtful under normal driving it would have reached full decibel levels. means the officer was fishing.

      I got pulled over for my stereo system being to loud. Tried to argue the dB line and the sound ordinance of that city was "if the cop can hear it with his window up it is too loud."
      I tried to counter that a Harley, a diesel, jake brake etc. No avail.

      @@jacehiggs3637 then I would suggest that you made the argument that each person can hear differently, some have better hearing than others. human variables are not admissible in court as evidence. also hearing is subjective just like they cant guess your speed of travel, they must have a machine that is calibrated/inspected regularly. also most "noise ordinance" is not recognized unless zoned and posted.
      the rulings of being able to pull someone over are very clear as to what violations they can act upon. they cant pull you over for suspicion of not wearing a seat belt, they cant pull you over for suspicion of using or having something like NoS. tail lights, head lights, something dragging crating sparks they can. if the car in question was making 110+ db (about twice as loud) that could be enough suspicion to check for illegal modification.
      unless the person in the video was racing to redline to make that 101ish dB and the legal limit being 98. that 3 DB is barely noticeable even at max. under most use even heavier use it wouldn't hit 98. the officer clearly made a guess. and a guess isn't admissible in court, ESPECIALLY in the case of a state actor.
      it sounds like you unfortunately was railroaded in court, which happens far to often.

    As soon as he answered that it was in track mode, the cop knew he had ‘em. This should be another lesson to NEVER answer questions to the police. Give them your license and registration and shut the hell up. It doesn’t matter what mode you’re driving in or where you’re going. It’s none of their business and it is not your obligation to help a cop with their investigation.

      5 cops in 6 cop cars wrote me a ticket back in 2000 for failure to maintain vehicle ride height. I moved in 2003 and met someone with the same lowered truck as mine. He said he lived in the town where I used to. Maybe a couple months after telling him my story, he got the same ticket. It’s usually that one cop with a hard on for anything custom or modified.

    Any time you get an infraction like this you take their name and badge number and make a formal complaint. Don't accept an apology or the ticket being ripped, make sure it's on record or else this will keep happening. We're dealing with this in Vancouver rn and Porsche and BMW are suing the police here sometime next year.
    Cops literally sitting outside dealers giving technicians mandatory inspections it's ridiculous.

    This officer must have gotten picked on a lot in high school for him to have such a massive chip on his shoulder. He sounded absolutely giddy telling the owner of the car he was going to have to 'pay $7000' to 'fix' his stock car. This guy is a good example of what gives LEOs a bad name in the car community. Hopefully the owner gets this resolved and we can all learn from this situation in some way.

    cop is dead wrong. I live in Calif. Yes, Track mode is not for streets, The driver can be given a ticket for unsafe driving. But, It's not the car's fault. Like if you drive with the door open, you get a ticket, you don't make the manufacturer weld the doors shut. If you speed, they don't make the manufacturer remove the engine and put in a tiny engine so you can't go fast. He can't pull the registration on the car because you used it incorrectly. Many cops don't understand the laws. It's like when a cop tried to cite a guy for having a go pro on his motorcycle helmet. It's legal, but cop didn't understand law that says the manufacturer can't make a helmet with protrusions. Owners are allowed to attach mikes, cameras, mohawks , whatever. Take cop to court and it will be thrown out.

      This makes me appreciate my one buddy who went to work for Winter Garden PD in Orlando. He did his 6 months basic, then took an additional year of traffic law, hand to hand, and de-escalation training. Completely optional, but he didn't want to go in half baked. His coworkers though? eeeeeeh

Pulled over for a loud exhaust; cop goes on to tell me that "sport mode is illegal, that's for the track only, you can't drive in that mode on the streets".....I'm pretty sure a prius and most cars these days come with a sport mode.       @@killermogle not true, I’ve seen multiple videos from him that involve positive feedback for the police departments. One I watched just the other day involved a man recording outside of a business that had cranes on the property, the owners of the business went and talked to the man recording, called the police when the man wouldn’t move off the public sidewalk. A lady from inside the building of the business also called stating that she thought he had a gun in his back pocket. Upon arriving, the police did a pat down search, and found there was no gun, radioed the other incoming officers that there was no threat and to lower their response level, and did not escalate the issue by drawing guns or worse shooting. The officer the said to the man recording and the business owner that recording on public grounds and anything in sight while on public grounds are perfectly legal. So no, he’s not giving the viewpoint that the police is bad, he’s giving advice, feedback etc from an unbiased point of view of the situation.

    A few years back I had a friend who lived there show how he would pass the dB test he would wad up and shove steal wool down his exhaust which would quite it down then after use a stretched metal clothes hanger with a hook bent to shove down and get it out. He actually got a cop suspended because of multiple complaints of harassment because he kept getting loud exhaust tickets but each time at state ref it passed. Lol

    "I don't answer questions" and he'll give you a ticket. He'll have to prove it was backfiring, he'll have to prove that it is illegal (which it isn't because it's stock), and so on. But since he admitted to that stuff, now cop doesn't have to prove it, driver has to prove the negative. Much harder to do. Whatever ticket the cop would have given him, take it to court and I guarantee it would be less than the $7,000 the cop states it would be.
    That being said, that's what you get for living in California. I used to have sympathy for them but it's all run out. Anyone who sticks around in Cali and pays taxes, fees, tickets, etc. is supporting that cancerous hell hole so good riddance. At some point, you've got to take responsibility for your poor choices.

      In this case, and with this officer this would be the correct response. In most cases if you’re just friendly and polite, the officer will just let you go with a warning. They just want probably cause to pull you over to see if they smell alcohol on your breath or something similar. Once they see your a normal upstanding citizen, they’ll let you go on your merry way…obviously, not with this guy.
      But they video is clearly edited, so I’m not sure what was said in between cuts. I like to give the benefit of the doubt to the police, but something clearly went wrong here.

      As long as you don't use track mode on a public street, there would be no need to refer it for noise testing. Therefore as long as it is used legally there is no need to test if it has equipment that would allow it to operate outside CA standards.

    There should be proof it passed the exhaust and loudness test prior to entering the U.S.A or it wouldn't have been on the dealers lot, all of the paper trail should available some where online for the owner to print out. Since the Hyundai dealership hasn't contacted him to resolve the issue file a case under the lemon law and ask for double the price of the car in damages and mental distress he's had over this issue.

    when he said "you're gonna spend 7 grand on this car right now" I'd have immediately lost it. there's so many better ways that cop could have done his job and gotten his point across without essentially bullying a guy who didn't do anything wrong. all he had to say was "in my county" (or whatever he his state trooper idk) they aren't supposed to sell these cars like this and register it. instead of putting the innocent law abiding citizen out to pasture like he's the bad guy. relax officer, I know you can't afford an ELANTRA but please don't be rude to the guy who can.     You can definitely hear the cop's mom coming out of his voice. She must have talked to him like that as a kid.
    The part I hate is when he assured the driver that the salesman told him he was informed. As if he was presiding over the sale. I can tell you from working in a dealer, many salespeople hardly know the basics of any given model, they'll tell ya anything just to make the sale.

    I grew up in California during the Muscle Car era. Headers, Turbo mufflers and burn outs on the street were the common thing. The car industry was a huge thing in there. The states CARB and other agencies have relentlessly focused on destroying one of the largest single industries the state has. The insane statements by the cop sounded like training has taken place to scare every motorist he stops. I move out of the state decades ago and have no desire to return.

      I’ve lived here for over 50 years and the car culture is just as strong as ever. I was harassed for loud exhausts back when I was 18. This is nothing new. A lot of it depends on where you drive and the car that you drive. The last few years the car scene here has been affected a lot because of the takeovers and similar behavior that pisses off a lot of people who vote. Police is some areas crack down on any car that fits the profile. But most cities like where I live in LA don’t bother anyone with this nonsense. Plenty of cars in my area with obviously illegal exhausts.

    This is a prime example why police are so well liked. I stay as cognizant of my surroundings as possible and put it back to sport or normal when ever I see or WAZE informs a cop is near. I've even programmed a custom N mode without the crackles & pops.

    The legal advice i give to the owner is take it to court and have a judge throw it all out. I was sent to the ref by a cop and I fought it in court and won. Take the paperwork to DMV and boom it all goes away. Also take it to another state ref and do another test with normal mode and they have to sign you off.

      Be aware, while the officer was definitely not very nice, there is no law saying he has to. The officer was legally correct that the exhaust was too loud by California standards at least in track mode. so he would lose the case and it would cost him both his and the police officers lawyer fees which would exceed any gains.

The inspectors said it was "the law" to test the vehicle in it's loudest mode/setting when in fact the law says every vehicle is to be tested in its default normal settings. So of course the vehicle failed the inspection because the tested it in track mode which is much louder than the default normal mode.

The long and the short of it is as long as you don't use the loud mode on the street and a cop cites it, there is never a need to test it in all modes. Simple poor decision making can be seen as "normal operation" as the driver has demonstrated this as "normal".

    Little tips: plea the 5th. Give your driver's and registration and just plea the 5th.
    Cops ask if you are in track mode: tell the cops you didn't realize that this car could act as a locomotive. Being dumb isn't illegal.

    Just bring it to a dealer for an inspection. Have the dealership document there are no modifications. Return to referee and proceed to cram dealer invoice down their throat and get the vehicle registration reinstated. File a complaint against the officer. File a lawsuit for compensatory and injunctive relief in an unlimited small claims lawsuit.

Or do they just have to change the exhaust system? Plus, Harleys are probably the loudest street bike but there are other bike makes louder than an Elantra. And yes, the cop was a complete asshole. They say there are just "a few bad cops"...he found one. The kid didn't argue, he apologized, and so on but the cop immediately jumped in his shit. The kid obviously has audio of what went down. I hope he showed it to the dealer...and I'd love to hear what the dealer said...probably threw his arms up in the air and said "oh well, sucks to be you!" (Sorry but this REALLY pisses me off.       @@maxhunt2644 to answer the Harley question, there are two versions, the normal version and the Californian compliant version. different intake system to make emissions, different computer settings, again to make emissions. and the "stock" exhaust is very weak in the sound department on both versions. anyone outside of California this is the first modification anyone does. if you find a loud Harley in Cali then they are trying to be sneaky with aftermarket pipes. my 2020 Road Glide sounded like a @#$%ing sewing machine til my after market pipes came in.
      also its not the MAKE of the big that makes them loud, my loudest bike thus far was a Honda VTX 1800. and Ive been drowned out by the random passing sport bike. so its not type of bike either. its intake, tune, exhaust, and cam.

    1. Even if the officer is right he was pretty rude. 2. It is legally sold in CA so sounds like a bigger issue than the buyer should be dealing with. 3. Next time you get pulled over flip it to Normal mode and say it wasn't my car let me rev it for you lol. This is another reason on my long list I never visit CA.

    Two options come to mind. First, you can restrict the intake. Meaning, slow the air flow incoming. Like, cover half of the air cleaner in some way. On the dirty side. As not to allow something to get ingested into the engine. Then, see what that does to the noise level. Or find a replacement muffler or add a muffler to the exhaust. I'd try to do the intake first and check the noise level myself.

    Sounds like he should sue both the company that tested his car on the "loudest possible setting" and the department for suspending his registration on a stock vehicle for "modified exhaust", after the vehicle was already stated to be stock for inconvenience, harassments, and court/lawyer cost as well as possibly costs for testing/anything else like registration. That's insane.

    95 decibles only applies to commercial vehicles.. however, he can apeal it to the courts and his registration suspension will be paused until a hearing.
    At the hearing, apeal the cops decision.. most of thr time, they wont show, so automatic dismissal.
    Also, leaving the phone numbe4 to the police station will spark public outcry cuz 1 person alone cant do a thing

    The owner can higher a lawyer and fight it in court since they didn’t test it correctly. The owner can sue the officer for damages after he gets his car registered again. The owner can also move to another state with said vehicle where it can be registered and never deal with California again.

      The problem is that Even though it wasn't tested correctly the car still ended up being able to fail the test after being certified it was stock thus not really giving him much of a stance in court

Not to mention, if the vehicle did not comply with the law when sold new then the owner cannot be held liable, it's an issue between the manufacturer and the state.

    Disconnect the mode button while in normal mode and get it retested. Once it passes, reconnect the button and your good. It's simply removing the trim around the button and unplugging it.

      @@terrybrown6057 no, you disconnect the button, that's it. No warning, nothing. The button is simply a switch that closes an already open circuit. Keeping the circuit permanently open will not cause an error. Of course this is more complicated than pressing a button since it's likely this button is an SMD button soldered directly to a board

    I have a 2016 Jaguar F-type R and I also got pulled over for the same reason. Luckily the cop believed it was stock and didn't state ref me. He also asked if I was in race mode but Jaguars dont have race mode they have dynamic mode and he had me show on the center screen that I wasn't in a "track only" mode. Unfortunately CA laws are way too strict which leads to California cops being very unforgiving, especially motorcycle cops. I really hope this guy gets it resolved with as little cost as possible.

    Reminds me of 2019 Santa Fe owner in another State pulled over for, and I kid you not, 'illegal headlights'.
    Cop was convinced the factory headlights were too low and needed to be put back in the right spot.

    A cop cant suspend your registration, courts can if you dont fix it but that law hasnt been signed it yet at least as of 4 days ago. Loud exhuast is a fix it ticket with a fine attached. He needs to go to the court date with that note from the dealer that shows its stock and get a note from that testing center that they wont recheck him. It will get dismissed. A dealer isnt just gonna remove "N mode" this story is fishy as hell.

      @@ENtense The cops here are VERY uneducated. I was pulled over for an exhaust and the cop told me every car in CA is required to have a muffler. I asked what about the cars that were sold without them IN CA? He said there are no such cars. I said sure are, SRT4 did not have them, and a couple trucks currently being sold do not have them. He called me a liar and said I have no idea what I am talking about and handed me my ticket. Which I wasnt even mad about the ticket, my car was LOUD as I was in the process of swapping out different setups to see what I liked most and was planning to change it anyway. I was mad about his blatant ignorance and actively spreading misinformation.
